HomeMy WebLinkAboutPlanning Board Minutes 1990-12-03 PLANNING BOARD MINUTES MEETING OF DECEMBER 3, 1990 The meeting of the Lexington Planning Board held in Room G-15, Town Office Building, was called to order at 7 32 p.m. by the Chairman, Mrs. Wood, with members Domnitz, Grant, Klauminzer, Williams, Planning Director Bowyer, Acting Assistant Planner Marino and Secretary Peters present. ******************************** REPORTS ************************************* 246. Planning Director a. Rollout. Valod's Way. 246 Concord Ave. Definitive Plan The Board viewed, prior to staff review, plans for a two lot subdivision filed November 30, 1990. 247. Planning Board. Subcommittees a. Lighting Committee Mr. Domnitz reminded the Board that it had not expressed its preference of the two versions of an explanatory sheet, proposed for insertion in the Zoning By-Law, not officially part of it, but to reference sections of the By-Law dealing with lighting. The Board agreed they preferred the longer version, which cites the actual wording in the By-Law. They also agreed to make this sheet available as a hand-out at the Annual Town Meeting, and at the counter in Room G-7 where Zoning By-Laws are sold, and to include it with By-Laws that are sold. At 7 40 p.m. , Mrs. Wood recessed the meeting, and the Board joined the Select- men in their meeting room for the formal presentation of the "Design Guide- lines for Commercial Districts" prepared by David Dixon and Associates. Selectman Jack Eddison expressed the Town's appreciation to the consultant, members of the Center Revitalization Committee, the Lexington Center Commit- tee, and especially to Mrs. Margery Battin who chaired both committees Mr. Dixon presented the report to the Selectmen and briefly discussed how the guidelines could be most effectively used. Mr. Eddison responded that the Town will follow up on the report's recommendations, working with and en- couraging Town merchants, the Chamber of Commerce and other interested parties to use the guidelines At approximately 8 20 p.m. , The Board left the Selectmen's meeting room and Mrs Wood reconvened the Planning Board meeting in Room G-15. ***************** ADMINISTRATION OF LAND DEVELOPMENT REGULATIONS *********** RECOMMENDATIONS ON APPLICATIONS TO THE BOARD OF APPEALS 248. Lexington Ridge, Comprehensive Permits Special. Conditions Mr. Bowyer reported he has accepted an invitation, made by Werner Lowe on behalf of EOCD, to serve on the Community Review Board that reviews Housing Development Action Minutes for the Meeting of December 3, 1990 2 Plans filed by cities and towns for state approval. Mr. Bowyer added that Mr. Lowe serves as Counsel to the state Housing Appeals Committee. The Board reviewed and edited a draft, dated November 30, 1990, of conditions proposed to be included in a decision approving a Comprehensive Permit, with conditions, for Lexington Ridge. The draft was based on a preliminary draft prepared by the Board of Appeals and forwarded to the Town Manager and the Planning Director for them to prepare language on the two unresolved issues affordability in perpetuity and rental in perpetuity. On the motion of Mrs Klauminzer, seconded by Mr. Williams, it was voted 5-0 to approve the wording of the draft, as amended, and to recommend that the Board of Appeals approve the Comprehensive Permit with conditions. SUBDIVISION OF LAND 249. Woburn Street. Robert Cataldo Sketch Plan The Board gave direction to the staff for the preparation of a decision on the sketch plan application. Mrs. Wood said that it was important that the Board decide whether they preferred the development of a cluster subdivision plan over a conventional plan. The Board agreed that they wished to encourage the cluster plan if the proof plan, showing the layout of seven lots, complied with regulations. In a straw vote, the majority of the Board favored approval of the Sketch I Plan, and encouraged the developer to begin preparation of a preliminary plan showing a cluster subdivision. The Board also agreed that the layout of the street and parking areas was poor and needed work. The staff will prepare a draft decision based on the Board's direction. ********************* ARTICLES FOR THE 1991 TOWN MEETING ****************** 250. Planning Board Articles The Board reviewed a draft of two proposed zoning articles, based on amendments to the Zoning By-Law prepared by Mr. Domnitz for its November 19 meeting. With the addition of the Technical Corrections article, that is included in each year's package and is still to be drafted, the package of Planning Board articles for the 1991 Town Meeting will be complete The Board reviewed the language of draft Article B - Religious, Educational Institutions, and draft Article C - Parking Factors, and agreed to go forward in the preparation of Articles A, B and C for Town Meeting. It was agreed to send the draft of Article B, Religious, Educational Institutions, to Town Counsel for his review. On the motion of Mrs. Klauminzer, seconded by Mr. Domnitz, it was voted 5-0 to ask the Selectmen to reserve space in the Warrant for the 1991 Annual Town Meeting for these three articles. **************************** REPORTS ************************************* 251. Planning Board. Subcommittees a. Board of Anneals Decisions Mrs. Klauminzer reported that at the meeting she attended on November 29, 1990, the Board of Appeals upheld the Minutes for the Meeting of December 3, 1990 3 decision of the Building Commissioner in the matter of the fence violation at 27 Solomon Pierce Road; granted Sunday hours to Lexington Gardens; granted reconsideration of the special permit, with conditions for the Jehovah's Witness Church, and continued to January 24, 1991 further consideration of landscaping for the church.
