HomeMy WebLinkAboutPlanning Board Minutes 1990-11-19 PLANNING BOARD MINUTES MEETING OF NOVEMBER 19, 1990 The meeting of the Lexington Planning Board held in Room G-15, Town Office Building, was called to order at 7 37 p.m. by the Chairman, Mrs. Wood, with members Domnitz, Grant, Klauminzer, Williams, Planning Director Bowyer, Acting Assistant Planner Marino and Secretary Peters present. ****************** ARTICLES FOR 1990 SPECIAL TOWN MEETING *************** 228. ARTICLE 2. Pine Meadows Development Mr. Bowyer reported that the State will provide the requested financing for the development, and that it will no longer be necessary to sell any lots on the site for additional financing. The Board reviewed and edited the draft Planning Board Report and Recommend- ation on the Pine Meadows/Meagherville RD Rezoning. On the motion of Mrs. Klauminzer, seconded by Mr. Grant, it was voted 3-2 (Mr. Domnitz and Mr. Williams voted in the negative) to recommend approval of the RD rezoning petition at the Special Town Meeting. On the motion of Mrs. Klauminzer, seconded by Mr. Grant, it was voted 4-1 (Mr. Williams voted in the negative) to approve the Planning Board Report and Recommendation, as amended. 229 1990 Planning Board Report on Affordable Housing: The Board began its review of the draft report, dated November 15, 1990. The members agreed that the report should be reorganized for clarity, and that the method or presen- tation should be changed from the year by year progress report used in the past to a new format which would be summary of the status of affordable housing. A final vote on the revised report will be taken at next Monday's meeting. ************* ADMINISTRATION OF LAND DEVELOPMENT REGULATIONS ************** SUBDIVISION OF LAND 230. Orchard Crossing. Sanderson Road. Street Acceptance Town Engineer Frank Field has reported that the community facilities along the Sanderson Road Extension in the Orchard Crossing Subdivision have not been completed, and has asked that the Board rescind its vote of September 13, 1990 recom- mending that Sanderson Road extension be proposed for acceptance as a public street at the 1991 Town Meeting. On the motion of Mrs. Klauminzer, seconded by Mr. Williams, it was voted 5-0 That whereas the Planning Board has been informed by the Engineering Department that the community facilities along the Sanderson Road extension in the Orchard Crossing Subdivision have not been completed, and the road is not ready for acceptance as a public street, the Planning Board rescinds its vote of September 13, 1990, and withdraws its recommendation that the Sanderson Road extension in the Orchard Crossing Subdivision be proposed for acceptance as a public street by the 1991 Annual Town Meeting. Minutes for the Meeting of November 19, 1990 2 RECOMMENDATIONS ON APPLICATIONS TO THE BOARD OF APPEALS 231. Hearings Scheduled for November 29. 1990 Mrs. Klauminzer gave an oral review of the following applications, scheduled to be heard by the Board of Appeals on November 29, 1990 93 Hancock Street, Lexington Gardens, modification to existing special permit, to delete the prohibition of Sunday openings with hours of 9 00 a.m. to 5 00 p.m. , and extend the special permit for five years. The Board agreed that Lexington Gardens should be entitled to be open on Sundays, as are other nurseries in town. However, it was agreed an opening time of 9 00 a.m. was too early in deference to area residents. On the motion of Mr. Williams, seconded by Mrs. Klauminzer, it was voted 5-0 1) to recommend that the hours of operation should be from 11 00 a.m. to 5 00 p.m. , and 2) to make no comment on how long the special permit should be in effect. 27 Solomon Pierce Road, Appeal of decision of the Building Commissioner that the raising of the grade will remedy the fence violation and satisfy the requirements of Section 7.5.2 of the Zoning By-Law. On the motion of Mr. Domnitz, seconded by Mr. Grant, it was voted 4-1 (Mr. Williams voted in the negative) to recommend the decision of the Building Commissioner be upheld. 10 Maguire Road, Itek Optical Systems, determination that the addition of an 1 optical test tower extending through the roof into a new penthouse is a minor revision. On the motion of Mrs. Klauminzer, seconded by Mr. Domnitz, it was voted 5-0 that the proposed addition should be considered a minor revision, not requiring a public hearing. 196 Woburn Street, Jehovah's Witnesses, Inc. , Reconsideration of the petition for a special permit to modify the 25-foot transition area screening require- ment. Mr. Williams moved and Mr. Domnitz seconded a motion to recommend the court case be continued instead of settling out of court as recommended by the parties. The motion did not pass with Mr. Domnitz and Mr. Williams voting in favor and Mrs. Wood, Mrs Klauminzer and Mr Grant voting in the negative. On the motion of Mr. Grant, seconded by Mrs. Klauminzer, it was voted 3-2, (with Mr. Domnitz and Mr. Williams voting in the negative) to recommend that the advice of Town Counsel as per the "Agreement for Judgement" be followed, and the special permit be granted. 196 Woburn Street, Jehovah's Witnesses, Inc. , Reconsideration of the appeal of the decision of the Building Commissioner's decision denying a building permit for a Kingdom Hall, claiming exemption in accordance with Section 3, MGL, Chapter 40A. The Board had no comment on this application, since it under- stood that the appeal would be dropped if the special permit were granted.
