HomeMy WebLinkAboutPlanning Board minutes 1989-03-27 PLANNING BOARD MINUTES 1 MEETING OF MARCH 27, 1989 The meeting of the Lexington Planning Board held in Room G-15, Town Office Building, was called to order at 7: 06 p.m. by the Chairman, Mrs. Uhrig, with members Klauminzer, Williams, Wood, Planning Director Bowyer, Assistant Planner Nordby and Secretary Peters present. Mr. Sorensen arrived just after Item 100 began. ****************************** REPORTS **************************:eke********* 99. Planning Director a. Farm Road Extension, Sketch Plan: The Board reviewed, prior to staff review, a sketch plan for a subdivision off the end of Farm Road resulting in a dead-end street longer than 800 feet. As the Zoning By-Law limits the length of a dead-end street to 650 feet, the Board agreed this plan is in violation of the Zoning By-Law. On the motion of Mrs. Wood, seconded by Mrs. Klauminzer, it was voted was 4-0 to return the plan as it does not conform to the Zoning By-Law. b. Status Report on Marrett Road and Hartwell Ave. CDs: Mr. Bowyer reported that a reply to the Planning Board's letter of 3/14/89, was received today from the Flatley Company. He characterized the letter as not responding to the points of the Board's letter. He proposed, and the Board agreed, that a "cut and paste" comparison of the two letters be prepared to show what the Board had asked for, and what Flatley's response was to each request. Mr. Bowyer also reported the negotiations with Mr. Colangelo about the Hartwell Ave. CD had narrowed down to two points: 1) the Board's position that the FAR should be reduced, and 2) the amount of the contribution Mr. Colangelo will make for traffic improvement proposals. ******************* ARTICLES FOR THE 1989 TOWN MEETING ********************** 100. Article 43 - Institutional Uses: The Board discussed a draft report dated March 16, 1989, making corrections. Mr. Bowyer reported that he had discussed with BuildingCommissioner Frederickson the points raised by Housing Authority Chairman William Spencer about the zoning treatment of a residence, such as a half way house, which is allowed in a residence district because it qualifies as an "educational" use. Mr. Frederickson said he would use the parking standards for a residential use rather than the standards for educa- tional parking because they correspond better to the actual use. Mr. Frede- rickson also noted that the number of occupants would be important as to whether an educational use would be permitted as a matter of right or not. The Building Commissioner also noted that educational or non-profit uses are permitted in all districts in town, and that in at least two recent court cases it was determined that towns may not have dimensional or other types of 1 Minutes for the meeting of March 27, 1989 2 controls that are so restrictive as to not permit the use to be located in the district. He also said that if a building were non-conforming as to setback requirements as a residence, he would lean in favor of allowing the institu- tional use to occupy the building even if the yard setback for the building, as an instiutional use, was greater providing there is no expansion or addition to the building. Mrs. Klauminzer questioned whether the town should depend on a ruling of the Building Commissioner alone when there is no language in the Zoning By-Law. 1 She suggested the Use Table allow Group Care Facilities in all districts , as a residential use. On the motion of Mrs. Wood, seconded by Mrs. Klauminzer, it was voted unan- imously recommending in favor of the amendment, to accept the wording of the motion for Town Clerk on Article 43, as amended at the March 20, 1989 meeting and to approve the Planning Board report, as corrected. 11 101. Articles 41, 42 and 46, signatures: The Board agreed to postpone signing the Planning Reports for Articles 41 and 42 until its next meeting. so that some minor editing changes can be made. The Board signed the Planning Board report on Article 46 which it had approved at its March 20 meeting. *************************9e4e** REPORTS ******************x***x*************** 102. Planning Board, Subcommittees a. Town Meeting Schedule for Planning Board Articles: Mrs. Uhrig f reported it appeared likely that the Planning Board articles will come l before the Town Meeting beginning on April 10, 1989. b. Meagherville site: Mrs. Klauminzer reported LEXHab had met last Wednesday to hear a report from Peter Smith of Cottonwood Corporation examining various scenarios for development of the Meagherville site. He presented several options ranging from full rental to full ownership with some mixed proposals. They will meet again on Wednesday, March 29 at 7:00 p.m. The Board agreed to cancel their meeting on the 29th so that any members that wish to can attend the LEXHAB meeting.
