MEETING OF MAY 1, 1995
The meeting of the Lexington Planning Board held in Room G-15, Town Office Building, was called to
order at 7:05 p.m. by Chairman Davison, with members Canale, Davies, Planning Director Bowyer, and
Assistant Planner Marino present. Mr. Merrill arrived during Item 77 Mr. Grant was absent.

76. Review of Minutes: The Board reviewed and corrected the minutes for the meeting of March 27,
1995 On the motion of Mr. Canale, seconded by Mr. Davies, it was voted unanimously, 3-0, to approve
the minutes, as amended.
The Board reviewed and corrected the minutes for the meeting of March 29, 1995. On the motion of Mr.
Canale, seconded by Mrs. Davison, it was voted unanimously, 3-0, to approve the minutes, as amended.

77 Recent Activity
a. Fox Run Lane. Definitive Subdivision Plan, Rollout: Mr. Marino rolled out a definitive site develop-
ment plan for the Fox Run Lane development, off East Street, that was submitted by Zaroohy Seed on April
21, 1995. The staff has not reviewed the plan in detail yet. The time for action on this plan expires on
July 20, 1995.
b. Denver Street. Preliminary Subdivision Plan. Rollout: Mr. Marino rolled out a preliminary subdivision
plan for the Denver Street Extension development that was submitted by Robert Phelan on April 21, 1995
The staff has not reviewed the plan in detail yet. The time for action on this plan expires on June 5, 1995
c. Garfield Street Extension. Definitive Subdivision Plan. Rollout: Mr. Marino rolled out a definitive site
development plan for the Garfield Street Extension development that was submitted by Ron and Nancy
Gold on April 14, 1995 The staff has not reviewed the plan in detail yet. The time for action on this plan
expires on July 13, 1995.
78. Tracer Lane: Mr. Bowyer reminded the Board that the owner of the Tracer Lane commercial
subdivision has not filed the required covenant. The Board discussed sending Harold Nahigian a letter to
prompt submittal of the covenant.
79 Wellesley Comprehensive Permit Litination: Mr. Bowyer informed the Board that he has been asked to
be an expert witness for the Town of Wellesley in a trial in Norfolk Superior Court involving a comprehen-
sive permit issued to a developer in Wellesley Wellesley contested the permit to the Housing Appeals
Board which overruled the Town. Wellesley is now contesting the ruling that only the affordable units in an
ownership condo development count toward the Executive Office of Communities and Development's
subsidized housing inventory mandate of ten percent affordable housing units, instead of all the units, as
they would in a rental development. If Wellesley succeeds, Mr. Bowyer believes the rule change would
benefit Lexington and all cities and towns in Massachusetts.

PLANS NOT REOUIRING APPROVAL UNDER THE SUBDIVISION CONTROL LAW
80. Form A/95-3. 2 Crest Circle. 100 Blossomcrest Road: The Board reviewed an Approval Not Required
plan showing a change in lot lines at 2 Crest Circle and 100 Blossomcrest Road. On the motion of Mr.
Merrill, seconded by Mr. Canale, the Board voted unanimously
to endorse the plan entitled "Plan of Land in Lexington, Mass.", dated April 13, 1995, prepared by
Noonan and McDowell, Inc., Billerica, Mass., certified by John L. Noonan, Professional Land
Surveyor, with Form A/95-3, submitted by Rosemarie and James Managello and Camblex Realty Trust,
applicants and owners, as it does not require approval under the Subdivision Control Law
RECOMMENDATIONS ON APPLICATIONS TO THE BOARD OF APPEALS
81 Applications To Be Heard on May 11. 1995: Mrs. Davison gave an oral review of the following
applications:
15 Depot Souare, Barber at the Depot, special permit for a barber pole
927 & 945 Waltham Street. Wagon Wheel Nursery renewal of special permit to operate nursery and
roadside stand
54 Woburn Street. Brian H. Naylor, special permit to extend second story of dwelling
23 Columbus Street. Joel and Sheila Taves, special permit for addition to dwelling
The Board agreed to make no comment on the applications. They will discuss the remaining Board of
Appeals petitions that appear on this meeting's agenda at a future meeting.
SUBDIVISION OF LAND
82. Granger Pond Way Acceptance of Covenant. Endorsement of Subdivision Plan: On the motion of Mr
Canale, seconded by Mr. Merrill, the Board voted unanimously, 4-0, to accept the covenant, dated March
28, 1995, and to endorse the subdivision plans entitled " Granger Pond Way - A Planned Residential
Development" by Larson Associates, Inc., and Meridian Engineering Collaborative, Inc. for the Windermere
Group, Inc., dated September 29, 1994.
The meeting was adjourned at 7:57 p.m.
