MINUTES

Chair Phil Hamilton opened the meeting at 6:30pm in the Parker Room of the Town Office
Building
Commissioners Present: Kevin Beuttell, Dick Wolk, David Langseth, Phil Hamilton, Alex

Others present: Karen Mullins, Conservation Administrator and Casey Hagerty, Conservation

Juliana Winters: Save the Trees, Girl Scout Gold Award Project: Long-term management of
Asiatic bittersweet along the Dunback Meadow Allen St. frontage
Ms. Winters explained her Gold Award Proposal to the Commission. The project involves
removing bittersweet from the entrance to Dunback Meadow. This project would take place
sometime in the spring. In addition to removing the bittersweet, she would also create a video
about how to remove the bittersweet so that in the future other girl scouts can lead the same
project. She added that homeowners will also be able to view the video and learn how to remove
bittersweet from their properties.
Questions and comments from the commission:
The commission asked if she was working with the DPW to arrange for removal of the
bittersweet. Ms. Winters explained that Jordan McCarron is coordinating with the DPW.
The commission asked how she will be trained in removing bittersweet as well as organizing
volunteers. Ms. Winters told the commission she will be attending “Stewardship Saturdays” with
the Conservation Stewards to learn both things.
The commission expressed their support for this project and explained that there is a need for it
in the community.
Motion to support this project made by Mrs. Dohan and seconded by Mr. Langseth. Vote: 5-0 in
favor.

Approve Request for Insignificant Plan Change at Shire, Lex Tech Park, DEP 201-719, BL 676:
Modification to install an overflow bypass between rain water collection system and recharge
system to prevent back-ups into roof downspouts caused by surplus overflow that cannot be
managed by the recharge system during significant storm events
John Hart, of Symmes, Maini & McKee Associates, was present to represent Shire. He explained
that in 2008 Shire received a permit from the Conservation Commission for a larger project. Mr.
Hart stated that last year there was a backup in the system because some construction debris got
stuck in the system. They are now concerned that there will be another backup into the building
and want to put in some precautionary measures to avoid this potential problem. They are
proposing to add a bypass over the recharge structure. He added that this would only be activated
if the system is full and not draining. This is still in compliance with DEP Standards.
Questions and comments from the commission:
The Commission asked if the engineering department has reviewed this proposal. Ms. Mullins
explained that she and the engineering department have met with the applicant to go over the
proposed changes. Ms. Mullins added that this project was approved before the one year volume
analysis was added to our regulations.
The commission questioned why the design failed initially. Mr. Hart explained that if he had
known there was a problem he would have included the bypass in his initial design.
Motion to approve the plan change made by Mr. Beuttell and seconded by Mr. Langseth. Vote:
5-0 in favor.

Mr. Sterianos explained that his client wishes to put a second story addition on top of their
garage. There would be no increase in impervious surface; the entire addition would be in the
footprint of the existing structure.
Motion to issue a negative determination with conditions made by Mr. Langseth and seconded
by Mr. Beuttell. Vote: 5-0 in favor.

Project: Direct connection of stormwater runoff associated with new parking lot into existing
town drainage system

David Mackwell- Kelly Engineering Group and Mike DiMinico- King Street Properties
Mr. Mackwell explained that this project has been through the commission three times. During
recent construction of new parking lots, they discovered a great deal of ledge that they would not
be able to blast through. They have decided to create a new parking area in the front of the
building which is across the street from the wetlands. Mr. Mackwell stated that they will be
adding a drainage connection in this portion of the project in order to achieve full mitigation for
the area.
Questions and comments from the commission:
The commission asked why this did not come before the commission before work started. Mr.
DiMinico stated that there was a lack of communication and that work was stopped immediately
upon the realization of their mistake.
The commission stated that they felt this site needed an updated snow removal plan. They
decided to not release the Certificate of Occupancy until an updated snow removal plan was
approved. The applicant agreed to this condition.

by Mrs. Dohan. Vote: 5-0 in favor.

Project: Amend Order of Conditions to incorporate utility interconnection with grid and access
road grades within Riverfront Area and 100-foot Buffer Zone

Mr. Wiehe explained that the electrical engineers did another study of the site and were able to
determine that the transformer pad could be moved outside of the 100 ft. riverfront buffer.
Motion to close the hearing made by Mr. Langseth and seconded by Mr. Buettell. Vote: 5-0 in
favor.
Motion to issue an Amended Order of Conditions made by Mr. Beuttell and seconded by Mr.
Langseth. Vote: 5-0 in favor.

Mr. Pauling explained that some dwelling footprint modifications have been addressed by the
applicant. These changes keep the house outside of the 100 ft. inner riparian area.
Mr. Hamilton entered a letter from the Friends of the Arlington Great Meadow into the record.

The commission applauded the applicant for making architectural changes to keep the house
outside of the inner riparian zone.
Questions and comments from the audience:
Mike Tabaczynski, representing the Friends of the Arlington Meadow, explained that they would
like to see a native seed mix used in t the restoration area. The applicant agreed to this. There
was some discussion about extending the restoration area to include more of the meadow. The
applicant agreed to extend the seed mix to the property line.

favor.

Ms. Mullins reported that she attend a prescreening conference at the DEP for the 10-12
Rangeway hearing. She stated that schedule for the rest of the appeal has been set.
