The meeting began at 6:31 p.m. Tuesday September 19th, 2023.

Dr. Burt Perlmutter will be resigning from the Board at the end of September 2023, after almost
27 years of service. Dr. Heiger-Bernays spoke of Dr Perlmutter's years on the Board. She also read
letters sent to her from previous Health Directors as a tribute to him and to thank him for all that
he has done to contribute to the health of the community and the promotion of public Health in
Lexington.
The Proclamation by the Select Board honoring Dr Perlmutter and his service to the Town was
read aloud.
Board members and staff thanked Dr Perlmutter for his time on the Board.
Waiver Request– Senior Services, Senior Lunch Program - Michelle Kelleher, Senior
Services Director -Melissa Interest, Human Services Director
Ms. Michelle Kelleher, Senior Service Director, and Melissa Interest, Human Services Director,
requested the Board of Health to waive the S5O temporary permit fee associated with the Senior
Services Lunch Program. The Senior Lunch Program uses venders from outside of Lexington

approximately four times a year and that requires a temporary permit. Ms. Kelleher that waiving
the $50 permit fee would help keep the lunch costs low for the senior residents and promote more
variety in the vendor selection. On a motion by Dr. Perlmutter, the Board of Health voted to
approve the waiver request for the Senior Lunch Program, with the understanding that all permit
requirements will continue as before, including inspections if necessary and proper vetting.
Approval vote 4 to 0. Dr. Heiger-Bernays abstained.
Lab Animal Regulations first DRAFT –
Michelle Schatz – Consultant
Ms. Michelle Schatz, consultant with ABC Consulting, presented the first draft of the Lab
Animal Regulations. The Board of Health recommended edits and revisions and asked that a
second draft be presented at the next meeting for their review.
Variance Request - Body Art Practitioner,
Code of Lexington, Article XVII, Body Art Establishment and Practitioners, 155-
129 F 2 -Allie Vincent
Ms. McCartin presented the variance request on behalf of Ms. Allie Vincent, applicant, for
approval of a Body Art Practitioner License without the required number of hours outlined in the
Code of Lexington. Ms. Vincent provided her reasons as to why the Board should approve the
variance request. The Board agreed that Ms. Vincent did not provide sufficient evidence to
support the request for a variance, and asked for documentation showing the number of
completed hours performing microblading services.
On a motion by Dr. Heiger-Bernays, the Board of Health voted to continue the variance request
until Ms. Vincent can provide the requested documentation for hands-on work related to
microblading.
Dr. Geller seconded the motion.
Approval unanimously
Variance Request – Hayden Ice Rink Snack Bar, Tricorn Café, 10 Lincoln St
Food Code 4-301.12 Manual Warewashing, 2 bay sink -Victoria Tassone
Ms. McCartin gave the Board an update of the variance request for the Hayden Ice Rink snack
bar, tricorn café located at 10 Lincoln St.
Victoria Tassone attended the Board of Health meeting addressed the Board and explained the
process of how she will operate the kitchen using a 2 bay sink at the rink.
Dr. Heiger-Bernays made a motion to grant the Hayden Ice Rink Snack Bar Tricorn café at 10
Lincoln Street variance for a manual ware washing 2 bay sinks.
Dr. Perlmutter seconded the motion
Approved unanimously.

217 – 219 Massachusetts Ave - Update
Pursuant to 105 CMR 410.000 of the State Sanitary Code -Minimum Standards of
Human Habitation -John P. Garrity, P.J. Garrity
Ms. Belanger gave an overview of the housing code violation located at the residence 217 – 219
Massachusetts Ave. Owner John Garrity attended the meeting and mentioned to the Board of
Health that all requested tasks had been completed. Mr. Garrity was instructed by the Board to
follow up with the Health Department for the status of the completion of closing out the permits.
229 Bedford St, Housing Update - Linna Ma
Ms. Belanger gave an update on the ongoing housing violations that were occurring for the
residence located at 229 Bedford St.
Ms. Belanger explained to the Board that there was an ongoing plumbing issue where the owner
Ms. Ma was having a difficult time trying to contract with a plumber to correct an issue at the
location.
Ms. Belanger did assure the Board that the Town plumbing inspector has recently spoken with a
plumber who is willing to complete the requested task.
Craft Food Halls – Update on Repeated violations and recommendation for food
Consultant - 3 Maguire Rd, 10 Maguire Rd, 1050 Waltham St - Courtney Steeves
Ms. McCartin gave a brief update from last month at the Board health meeting regarding the
repeated variance violation at Craft Food Hall. Ms. McCartin stated there are 3 locations in town,
3 Maguire, 10 Maguire, and 1050 Waltham Street. At the August 15, 2023, Board of Health
meeting Craft Food Hall told the Board that they would hire a food consultant who has Hazard
Analysis Critical Control Point (HACCP) food experience to review their HACCP plan and
make any corrections necessary and to do inspections on-site unannounced at each location.
Also, Craft Food Hall will be submitting monthly progress reports to the Board of Health.
Ms. McCartin expressed to the Board that the Health Department had to reach out a few times to
the establishments to get the HACCP plan for the 3 locations.
The Health Department still doesn't have a fully completed HACCP plan or a copy of the
contract with the consultant that they using.
Ms. McCartin also stated the consultant has yet to provide the Health Department with the
inspection report from the month of August.
The Board has discussed with Tyler Walsh who was an attendee representing Craft Food Hall
their concerns about the violations of the food code and the required process when issuing the
variance may result in revoking the variance at all 3 locations until the consultant has done their
work.
Fee Schedule update – Frozen Dessert

Dr. Perlmutter made a motion to make the following changes to the fee schedule for permitting
to now have frozen desserts soft serve to be $50 and for frozen dessert manufacturers $200.
Dr. Tung seconded the motion.
Approval was unanimous.
Flu Clinic/ COVID vaccine update
Ms. Belanger provided the Board with the clinic schedule.
Ms. Belanger also announced to the Board the COVID-19 vaccine has been pre-ordered.
MS. Belanger also stated the Health Department will be at The Scottish Right Museum for the
Brookhaven Health Fair on 10/26/2023
Tobacco Control Update
Ms. Belanger has informed the Board that there is now a new tobacco control inspector named
Brenda Makumbai.

Correspondence/Information
Ms. Belanger provided the Board with the ZeroToGo Reusable Takeout Pilot Program
collaborative letter they will be sending out to more restaurants to get them to Collaborate with
them.
Ms. Belanger provided an arbovirus report and informed the Board the link to the state reports
regarding the viruses is provided on the Public Health page.
Ms. Belanger also discussed the Community Health Equity Survey that is posted on the Public
Health page. Asking the communities to participate by giving feedback.

Dr. Heiger-Bernays made a motion to adjourn at 8:40 p.m.
Dr. Perlmutter seconded the motion.
