HomeMy WebLinkAboutPlanning Board minutes 01-30-1995 PLANNING BOARD MINUTES MEETING OF JANUARY 30, 1995 The meeting of the Lexington Planning Board held in Room G-15, Town Office Building, was called to order at 7.40 p.m. by Chairman Davison, with members Canale, Domnitz, Grant, and Planning Director Bowyer present. Mr. Merrill was absent. Mr. Grant left the meeting during Item 31 **************************************** MINUTES ************************************** 26. Minutes of meetinu of January 23. 1995 The Board reviewed and corrected the minutes for the meeting of January 23, 1995. On the motion of Mr. Canale, seconded by Mr. Grant, it was voted unani- mously to approve the minutes, as amended. ************ ADMINISTRATION OF LAND DEVELOPMENT REGULATIONS ************* 27 Graneer Pond Way Cluster Subdivision. Defmitive Plan: The Board reviewed draft decisions, dated January 30, 1995, prepared by the staff. On the motion of Mr. Canale, seconded by Mr. Grant, the Board voted unanimously to: 1. grant a special permit with site plan review (SPS) for a planned residential development/cluster subdivision and special permit; 2. approve the decision, granting the special permit with site plan review (SPS) and special permit, dated January 30, 1995, 3. approve with conditions the definitive subdivision plan entitled "Granger Pond Way, A Planned Residential Development", by Larson Associates,Inc., and Meridian Engineering Collaborative, Inc., dated September 29, 1994, 4 approve the wording of the Certificate of Action dated January 30, 1995. 28. Dana Court Subdivision, Reauest for Final Release of Surety The Board reviewed a draft motion, prepared by the staff. Mr. Domnitz left the meeting room temporarily during this item and was not present for the vote. On the motion of Mr. Grant, seconded by Mr. Canale, the Board, on a 3-0 vote: 1. disapproves the request of Carter Scott, dated December 29, 1994, that the remaining surety being held on the Dana Court subdivision be released; 2. waives the requirement in subparagraph 9.8 of the Development Regulations, September 8, 1986 edition, and paragraph 2 of Condition#30 of the Certificate of Action dated April 12, 1994 for the Dana Court subdivision that limits the minimum amount of surety that can be held by the Town to insure the completion of the subdivision to 15% of the original total "cost to construct"; and 3. permits the amount of surety for the Dana Court subdivision to be reduced from $14,325 to $3,100. That amount is the actual cost of the trees and landscaping installed at the Dana Court subdivision plus a 10% contingency The Planning Board determines that this surety is necessary to ensure the replacement of trees and other landscaping plants in the subdivision that do not survive the winter. 4 This level of surety is determined to be sufficient through July 1, 1995 only 29 Garfield Street Extension: Mrs. Davison reported that Joyce Miller, Chairman of the Conservation Commission, has asked for a joint meeting of the Planning Board and Conservation Commission because the appeal of Ronald and Nancy Gold is scheduled for court action soon. Mrs. Miller seeks to avoid the expense of litigation to the Town. She wants to try and resolve the conflict between the Conservation Commission's Order of Conditions, specifying a 16 foot street width, and the Planning Board's preliminary plan decision, requiring a 20 foot street width. The meeting is scheduled for February 13 in executive Minutes for the Meeting of January 30, 1995 2 session. Mr. Domnitz suggested that the meeting be deferred until a new Planning Board member is elected in March. ********************************* ELANNING STUDIES *********************************** 30. Demographic Analysis of Mixed Income Rental Housing Developments: The Board reviewed the draft of the report on four mixed income rental housing developments now being prepared by the Planning Department. Mr. Domnitz thought this data reflected a general trend toward a higher occupancy rate for school aged children in various types of housing. He thought it would be interesting to know the correlation between school aged children and the value of single family homes and the occupancy characteristics of Emerson Gardens after it was converted from rental housing to condominiums. ************************* ARTICLES FOR 1995 TOWN MEETING *********************** 31. Articles A-a The Board made suggestions about points to make and presentation techniques for the various articles. ************ ADMINISTRATION OF LAND DEVELOPMENT REGULATIONS ************* ZONING ENFORCEMENT 32. 419 Marrett Road: Mrs. Davison reported that Dean Curtin had erected a sign advertising a real estate business at the historic Bridge house that is in a One-Family zoning district and appears to be using the building as a real estate office. The three members present agreed to notify the Building Commissioner and request him to take appropriate action and for him to determine if parking spaces for the adjoining businesses in the CN, Neighborhood Business, zoning district have been constructed on the Bridge house property that is in a One-Family zoning district.
