MEETING OF APRIL 10, 1996
The meeting of the Lexington Planning Board, held in Room G-15, Town Office Building, was called to order
at 7 10 p.m. by Chairman Davison, with members Canale, Colman, Davies, Planning Director Bowyer, and
Assistant Planner Marino present. Mr Canale arrived during Item 83 Mr Merrill was absent.

83 Recent Activity
a. James Street: Mr Bowyer reported that the staff received a letter from Attorney Frederick Conroy
regarding the length of James Street that is on the list of unaccepted streets. Department records show that
Tringale's lot on James Street does not have frontage on an unaccepted street and is not a buildable lot. His
client must provide proof that the part of the street in front of the lot qualified as an unaccepted street.
h Middlesex County Hospital. The staff have been getting calls from developers about the Request for
Proposal issued by the County Commissioners for the Middlesex County Hospital site. The portion of the
hospital land that is in Lexington is in the RO, Single-Family, District. Any use other than continued use as a
public hospital or a single-family housing development would require a rezoning. So far, the process has not
involved Lexington or the City of Waltham.
c. Concord Avenue. George Issaians: Mr. Bowyer reported on new developments in the Issaians subdivision
application on Concord Street. The Revenue Officer is starting foreclosure proceedings on the property due to
non-payment of taxes.

PLANS NOT REQUIRING APPROVAL UNDER THE SUBDIVISION CONTROL LAW
84 Form A/96-6. Lincoln Street and Pheasant Lane. Berry and Robert Cataldo: The Board reviewed an
Approval Not Required Plan for land at Lincoln Street and 17 Pheasant Lane. On the motion of Mr. Canale,
seconded by Mr Colman, the Board voted unanimously
to endorse the plan entitled "Plan of Land in Lexington, MA (Middlesex County) ", dated October 26,
1996, prepared by Meridian Engineering, Inc., Peabody, MA, certified by Michael J Juliano, Registered
Land Surveyor, with Form A/96-6, submitted by Constance L. Berry Cataldo and Robert Cataldo,
applicants and owners, as it does not require approval under the Subdivision Control Law
DETERMINATION OF GRADE AND CONSTRUCTION OF UNACCEPTED STREETS
85 Oakmount Circle. Preliminary Street Improvement Plan_ Decision: The Board reviewed a draft decision,
dated April 10, 1996, on the Preliminary Street Improvement Plan for Oakmount Circle. Present were Richard
Curtin, the applicant, and some of the residents of Oakmount Circle. In a brief discussion, Mr Curtin said he
would supply copies of a report by his consultant on the geophysical effects of the proposed street construction
to anyone interested. On the motion of Mr Davies, seconded by Mr Canale, the Board voted unanimously,
5-0, to approve the draft decision, as written.
86. Summit Road. Definitive Street Improvement Plan. Decision: The Board reviewed, and revised, a draft
decision, dated April 9, 1996, on a Definitive Street Improvement Plan for 28 Summit Road, submitted by Barry
Caouette on February 15, 1996. On the motion of Mr Canale, seconded by Mr Merrill, the Board voted
unanimously to approve the decision, as amended. The plan was disapproved.

SUBDIVISION OF LAND
87 One Granger Pond Way the Windermere Groun. Certificate of Occunancv• Mr Marino explained that
the unexpected snowstorm this week prevented the developer from completing the paving of Granger Pond Way
prior to applying for a certificate of occupancy Since there is a real estate closing on one of the homes on that
street on Friday, the developer requests a waiver from the regulations. After hearing assurances from the
developer that the road would be finished as soon as the weather permits, on the motion of Mr Canale,
seconded by Mr Colman, the Board voted unanimously to grant a waiver from the provisions in section
3 7.5 4 6 that require the filing of Certificates of Completion and the finish course of the street be installed.
That waiver will allow the developers, John and Pat Austin, to complete the real estate transaction on 1 Granger
Pond Way only and the dwelling may be occupied.
The meeting was adjourned at 7:59 p.m.
