MEETING OF JANUARY 11, 1996
The meeting of the Lexington Planning Board held in Room G-3, Town Office Building, was called to
order at 12:30 p.m. by Chairman Davison, with members Davies, Grant, Planning Director Bowyer,
Assistant Planner Marino and Secretary Tap present. Mr. Canale and Mr. Merrill were absent.

SUBDIVISION OF LAND
7 Schoolhouse Lane. John Esserian, Revised Planting/Landscape Plan, Release of Lots: The Board
reviewed a second revised landscape plan for the Schoolhouse Lane Subdivision, dated January 4, 1996.
A previous plan submitted by Mr. Larson for Mr. Esserian was rejected by the Board as inadequate to
compensate for vegetation removed from the site of the Schoolhouse Lane subdivision by the original
developer. Though none of the members was completely happy with this plan, they believe this process
will serve as a message to builders and landscape architects that they must follow approved plans.
After further discussion about procedures to follow in the future, on the motion of Mrs. Davison,
seconded by Mr. Davies, the Planning Board voted unanimously, 3-0, to:
1. revise Sheet #7 of the definitive subdivision plan approved on June 22, 1994, as shown on the
plan entitled"revised planting plan no. 2"for the Schoolhouse Lane Subdivision, dated January
4, 1996, prepared by Larson Associates, Arlington, MA, and,
2. to release lot #1 and lot #3; and
I 3. to grant the waiver requested by Attorney Albert Sreter on December 21, 1995, from the
provisions in section 3.7.5 4.6 that requires the filing of Certificates of Completion so that the
developer, John Esserian, may complete real estate transactions on lot number 1 and 3 and the
dwellings may be occupied.

8. FormA/95-14,Flintlock Road/Burlington Street William Hamilton:The Board reviewed an Approval
Not Required Plan for land at Flintlock Road and Burlington Street. On the motion of Mr. Davies,
seconded by Mr. Grant, the Board voted unanimously to endorse the plan entitled "Plan of Land in
Lexington, MA (Middlesex County).", dated December 18, 1995, prepared by Meridian Engineering
Collaborative,Inc.,Peabody,MA.,certified by Michael J.Juliano,Professional Land Surveyor,with Form
A/95-14, submitted by William H. Hamilton for Lincoln Park Realty Trust, applicant, as it does not
require approval under the Subdivision Control Law
9 Form A/96-1, 60 Middle Street, Ronna Casper and Isaac Greenberg: The Board reviewed an
Approval Not Required Plan for land at 60 Middle Street. On the motion of Mr. Davies, seconded by
Mr. Grant, the Board voted unanimously to endorse the plan entitled "Plan of Land in Lexington, MA
(Middlesex County).", dated December 7, 1995,prepared by John R. Snelling,Associates, Lincoln, MA.,
certified by John R. Snelling, Professional Land Surveyor, with Form A/96-1, submitted by Isaac
Greenberg and Ronna Casper, applicants, as it does not require approval under the Subdivision Control
Law
10. Form A/96-2. 2564 Mass. Avenue and School Street. Stephen and Dawn McKenna: The Board
reviewed an Approval Not Required Plan for land at 2564 Massachusetts Avenue and School Street. On
the motion of Mr. Davies, seconded by Mr. Grant, the Board voted unanimously to endorse the plan
entitled"Subdivision Plan of Land in Lexington, MA(Middlesex County), Being a Resubdivision of Lots
80 and 81", dated October 26, 1995, revised on January 5, 1996, by Noonan & McDowell, Inc., Billerica,

Mass., certified by Malcolm P McDowell,Professional Land Surveyor,with Form A/95-12, submitted by
Stephen and Dawn McKenna applicants and owners, as it does not require approval under the
Subdivision Control Law
11. Dana Court, Carter Scott. Final Release of Surety Release of Covenant: Mr. Marino reported that
the staff has received a request from Carter Scott, developer of Dana Court Subdivision, to release the
remaining surety held by the Town and to release the covenant for the subdivision. After reviewing a
draft motion, prepared by the staff, on the motion of Mr. Davies, seconded by Mr. Grant, the Board
voted unanimously, 3-0:
WHEREAS, a definitive subdivision plan entitled Dana Court,was approved by the Lexington Planning
Board on April 12, 1994 and a covenant was executed by William D Martin and Gabrielle A. Martin,
"Owners", on May 9, 1994, and such plan and covenant were recorded in the Middlesex County Registry
of Deeds on May 23, 1994 as Plan No. 468 and as Instrument No. 768; and
WHEREAS, on December 1, 1994, the Engineering Department of the Town of Lexington received a
complete set of"as built" plans which it retains in its records, and the Town Engineer on December 12,
1994, informed the Planning Board that all required work on such subdivision has been fully and
satisfactorily completed; and
WHEREAS,on December 26, 1995, Brian Gilbert, the Superintendent of Parks and Trees,verified that
the trees and landscaping in the subdivision survived the 1994-1995 winter season and are in an
acceptable condition;
NOW THEREFORE,the undersigned,being a majority of the Planning Board of the Town of Lexington,
Massachusetts, hereby certify that in the opinion of the Planning Board the construction of ways and
installation of municipal services have been fully and satisfactorily completed by the applicant in
accordance with the definitive subdivision plan and with the Planning Board's Development Regulations
to serve all lots in the subdivision.
Pursuant to Section 81-U of Chapter 41, M.G.L. and in consideration of completion of said construction
and installation,the Lexington Planning Board hereby releases Robert Carter Scott,"Developer",as agent
for William D. Martin and Gabrielle A. Martin, "Owners", from the provisions of the covenant and
releases its interest in the performance surety
