Meeting Called to Order:
The Board of Health meeting of April 18, 2023, was called to order by Dr. Perlmutter at 6:30
pm.
Minutes Approval
After discussion, Ms. Wolf- Fordham made a motion that the Board of Health approves March
21, 2023, Special Board of Health meeting minutes as edited and amended. Dr.Tung then
seconded the motion. The motion passed unanimously.

LexZeroWaste- Update on Pilot Program for Reusable Take-out Containers-ZeroTogo:
Janet Kern and Mark Manasas of LexZeroWaste attended the meeting and presented an update
on their pilot program to the Board. They presented plans to expand the pilot during phases 2 and
3 as long as the restaurant can handle the increase and the Board approves. The Board of Health
has questions and comments regarding the program's reusable containers; the questions and
comments were answered and addressed by Ms. Kern and Mr. Manasas.
National Public Health Week – April 3-9,2023 – Review Events:
Ms. Belanger gave an overview of national Public Health Week informing the Board that the
Town of Lexington held many events that were well-attended and received by the community.
The Health Office and Conservation Commission now have a monthly scheduled guided Nature
walk once a month as a result of this collaboration.
Upper Crust Pizzeria – Update
Ms. McCartin gave a brief overview informing the Board that Upper Crust had conducted
training with their Food Safety consultant Walter Solorzano and the staff members. The
consultant will continue doing routine inspections for the next several months and provide
updated inspection reports to the Health Office. The staff will perform an inspection before the
next Board of Health meeting and report on progress.
Semi-Public Pool Variance Request:
Ms. Wolf- Fordham made a motion to grant the variances of the following Pool facilities’ that
requested to have No Lifeguard present Article XVI Bathing Places 155-116.
Aloft Pool
Element Pool
Brookhaven Pool
Waterstone Pools
Dr. Tung seconded the motion. The motion passed unanimously.
Dr. Tung made a motion stating “The Lexington Board of Health grants the variance request
from the requirement of lifeguards for the safe operation of pools as listed under Article XVI,
Bathing Places § 155-116. In addition, all requirements of 105 CMR 435.23 (2) shall be met
including all signage which includes: “Warning No Lifeguard on Duty” in easy to read, legible
letters which are at least four inches high “Children under age 16 should not use swimming pool
without an adult in attendance” and another sign that states, “Adults should not swim alone.”
This variance applies only to the following seasonal pool facilities, which have made the request
in writing. Listed as follows:
Adams Pool
Five Fields Pool
Peacock Farm Pool
Moon Hill Pool
Pleasant Brook Pool
This Variance will expire at the end of the Seasonal Pool season, pool expiration date, or upon
notification of an unsafe operating condition at a specific facility.” The Motion was seconded by
Ms. Wolf-Fordham. The motion passed unanimously.
Dr. Tung made a motion stating “The Lexington Board of Health grants the variance request
from Swimming Pool Code 105 CMR 435.23 (1), to allow two lifeguards to work at the Pleasant
Brook pool who are not 16 years old or older. The two lifeguards will work as lifeguards at the
following Pool:
Pleasant Brook Pool,
With the stipulation of submitting a confirmation of Red Cross certification, and notes that this
request grant is only for these two individuals and this variance will expire at the end of the pool
season.” The Motion was seconded by Ms. Wolf-Fordham. The motion passed unanimously.
Tobacco Control Update:
No new update on tobacco control.
COVID-19 Update:
The Lexington Covid-19 data from the Health Office dashboard was provided to the Board.
Reports will continue to be provided until May 11, 2023. After May 11, 2023 State COVID data
will be available online at Mass.gov.
Health Staff Reports:
Staff provided their monthly reports, and there were no questions from the Board.
Directors report:
Ms. Belanger provided an update on the new commissioner for Public Health, Dr. Robbie
Goldstein.
Ms. Belanger and Ms. Coleman attended a Narcan training.
The Press release from Gov Healey announcing the end of COVID- 19 Public Health Emergency
in Massachusetts on May 11, 2023, was discussed.
Ms. Belanger had been asked by the Town Manager’s Office how the Board intended to proceed
with meetings as the ability to hold virtual meetings was extended by the legislature until March
2025. Ms. Belanger discusses the options available to the Board, which are to remain remote,
hybrid, or in-person. Ms.Belanger’s initial response to the Town Manager’s Office was to remain
remote. The consensus of the Board members present is to remain remote, however, a final
decision needs to wait for a full Board decision.
Rabies Vaccine Waivers: MGLChapter140, Section 145b, (d)(i)
Ms. Belanger related to the Board that the rabies waiver letter had been sent for 3 dogs.
2 Welch Rd:
The outside of the property was cleaned by 24 Trauma to make it safe and so that no one gets
injured.
ServSafe Class: The class was held on March 20, 2023, and had 20 attendees. The Health Office
is planning to schedule more classes in the future as this class filled up quickly and there is a
waiting list.
