ARTICLE 43 MOTION
1.Delete the current Section 3.1.6 and replace with the following:
3.1.6 Banks and Credit Unions and Real Estate Sales or Rentals in CB District Storefronts.
1. Purpose. Lexington Center is a place in which shops, work places, schools, historic
attractions, housing, open space, and civic facilities intimately co-exist to create an
active retail and cultural destination with an identifiable sense of place. It is in the
public interest that the Town protect and enhance the vibrancy of the Central
Business District by creating a supportive environment for a diverse group of uses
throughout the Center, and regulating the use of the limited first floor storefront area
and frontage of the Central Business District is necessary to achieve this goal.
2. Special Permit Review Criteria. In addition to the criteria detailed in § 135-9.4.2, as a
precondition to allowing the establishment, relocation, or expansion of a banking or
credit union or real estate service use (Lines H.1.05 and Line H.1.04 respectively in
the Table of Uses) in the Central Business District, the SPGA must also find that the
applicant has satisfied the specific criteria listed below:
a)The granting of the special permit will advance the goals expressed in § 3.1.6.1
above;
b)The proposed use in the proposed location is in the public interest;
c)The proposed use will not create an undue concentration of these uses in the
immediate area;
d)The proposed use will maintain hours and days of operation and an active
storefront consistent with other retail uses in the Central Business District;
e)The proposed length of the storefront will not exceed the average length of other
storefronts in the Central Business District;
f)The proposed first floor square footage will not exceed the average size of other
storefronts in the Central Business District; and
g)As part of providing a visually engaging storefront, the area adjacent to the
storefront must be a space dedicated for patrons and shall not be used for office,
cubicle, conference, or storage areas.
3. The SPGA may waive strict compliance with criteria 2(e) and 2(f) above, where such
action is in the public interest and consistent with the intent and purpose of this
bylaw.

CENTER STREETSCAPE DESIGN REVIEW AD HOC
COMMITTEE
Members: 9 Members (6 liaisons, 1 Chair as non-voting facilitator)
Appointed by: Board of Selectmen
Length of Term: Upon completion of all recommendations to the Board of Selectmen
in accordance with the established deliverables schedule as outlined
below.
Meeting Times: As determined by the Committee.
Provide for a minimum of two evening meetings to solicit public comment
Description: To evaluate and make a recommendation on the various design elements
(excluding engineering items related to traffic) for the Center Streetscape
Project.
Vision: The Center Streetscape Project is envisioned as a capital improvement
effort that, when completed, will enable Lexington Center to achieve its
many objectives of providing an inclusive, vibrant, welcoming
environment. The project will do this by enhancing and preserving the
Center’s historic resources, addressing much needed maintenance, and
augmenting streetscape amenities to support and expand commerce,
tourism, and leisure activities. The project vision recognizes that all its
users - visitors, residents, and employees - must be able to safely and
comfortably access the center through all modes of transportation.
Mission: To ensure that Lexington Center continues to be Lexington’s outdoor
living room where all can come together in the celebration of Community.
The work of the Ad Hoc Center Streetscape Design Review Committee will include making
recommendations to the Board of Selectmen on the following design elements as presented by
the Town of Lexington Engineering Division in consultation/conjunction with the Center
Streetscape Project Consultant in the order listed:
• Sidewalks (material & width)
• Street Lighting (style)
• Buffers (stone walls, thin planters etc.)
• Seating (benches, tables, chairs)
• Bicycle amenities (racks, loops)
• Informational Signage
• Trash/Recycle Receptacles
• Planters (type, location)

• Landscaping (trees, shrubs, soil used)
• Educational and Interpretive Elements (wayfinding, historical interpretive
signage, markers, bollards, fencing etc.)
• Maintenance and upkeep
The Center Streetscape Project design phase has a defined scope of improving the safety and
accessibility for all modes of transportation (vehicular, pedestrian, bicycle, busses) on the
roadway and sidewalks within the defined Center Streetscape project area of Massachusetts
Avenue at Woburn Street westerly to Meriam Street (exclusive of the Battle Green Master Plan
area).
The Committee is reminded of the affirmative vote of the Spring 2015 Annual Town Meeting on
Article 42-Commission on Disability Request (149-10) and Article 45-Townwide Process for
Safety (160-0). The former vote called on the Town to utilize materials in sidewalk construction
that would minimize vibration and the latter vote directed the Town to focus efforts on
improving bicycle and pedestrian safety. The Committee is also reminded of the Town’s recent
Complete Streets policy adoption, a copy of which policy is attached.
Deliverables:
• Tier 1 by September 15th, 2016
o The sidewalk materials and widths of the various materials as well as the
decision on the south side newer sidewalk area.
o Lighting style (as this theme tends to carry through to other streetscape design
elements and the design, number of posts, heights, and costs can be
significantly impacted by style)
• Tier 2 by November 15, 2016
o Edging
o Roadway features
o Stone walls
o Granite posts, bollards and interpretive markers in pavement
o Structural soil
o Infiltration basin
• Tier 3 by December 31, 2016
o Amenities (tables and chairs)
o Thin planters
o Interpretive elements
o Trees
Criteria for Membership: The members shall consist of members of other committees.
Appointments will be made by the Board of Selectmen, who will also designate a Chairman who
will serve to facilitate the meetings but will not have a vote. One representative from each of the
following nine boards/committees will constitute this committee:
• Bicycle Advisory Committee
• Center Committee

• Design Advisory Committee
• Historic Districts Commission
• Historical Commission
• Planning Board
• Tourism Committee
• Tree Committee
Staff Support: The Town Engineering Division will provide staff support to the committee.

continue to serve on the Committee the member must acknowledge annually receipt of
the Summary of the Conflict of Interest Statute. Said summary will be provided by and
acknowledged to the Town Clerk.
2. Provide evidence to the Town Clerk that the appointee has completed the on-line training
requirement required by the Conflict of Interest statute. Further, to continue to serve on
the Committee, the member must acknowledge every two years completion of the on-line
training requirement.

Dear Mr. Griffiths:
As provided under Section 2, Term and Termination, of the License Agreement
between the Town of Lexington and the Munroe Center for the Arts (MCA), the
Town is extending this Agreement through June 30, 2018.
Notwithstanding section 5(b) of the License Agreement, the parties agree that
should the Town and the MCA agree to replace and/or repair the roof of the MCA
and its related appurtenances, the MCA will reimburse the Town of Lexington for
all or a portion of the debt service related to this work, on terms agreed to by the
parties, but with this reimbursement not to exceed the term of the debt issued by the
Town.

I'm about to go into a med procedure that will have me unavailable for the rest of the day.
I'm certain we can provide the insurance once you specify the amount, and will contact the Police Chief to
determine requirements. We also understand that vehicles will not be allowed.
The AFB is within 5 miles and so I will need to contact the tower which is very normal and par for the course.
I have included both the President and Director of Sales in this email so that we can get you an answer about the
date ASAP.

conditions. First question is whether this could be put off until a date in May when our Patriots’ Day
events have concluded; there is concern about it raining a lot prior to the Reenactment on April 18.. If

- Insurance for the day of the event – amount to be determined

information and stand ready to answer any further questions. Should special modifications be

Date and Time of the Event:
A single day, between April 6 and April 11, between 10AM and 2PM
Nature of Event:
POF is a firearms manufacturer located in Phoenix Arizona. Since its inception, the values of the
company is to promote Duty to Country, Patriotism, and the knowledge of the Birth of Our
Country. Earlier this year the President and Founder, Frank L. DeSomma, announced the
coming release of a new rifle named the Revolution. All of the company’s products project the
stated company values and include other models such as the Olde School, Puritan, Renegade,
and others.
POF, and Frank, are well known and respected within the Firearms industry as innovators and
Patriots. As such, it would be very meaningful and fitting for POF to film a commercial on the
Battle Green, where the opening shots of the Battles of Lexington and Concord were fired on
April 19, 1775, starting the American Revolutionary War.
Expected Number of Participants, Spectators and Vehicle:
A total of 6 people would be on location. Up to 2 participants in the video, 3 ground and aerial
video operators, and a Project Manager. No more than 2 vehicles will be used.
Duration of Event:
Four (4) hours
Statement of Equipment and Facilities to be Used:
• 2 ground video cameras on standard tripods.
• 3 lights on tripods
• Up to 8 rifles displayed with no more than 2 out of their cases at any time. All rifles will
be non-operational with their firing pins removed and modeled with empty magazines.
We understand the need for safety and precaution and would welcome the presence of
of your LE personnel to monitor the entire project as well as inspect the rifles. Should
you require that we contract with off-duty policemen as stand ins for the video, we
would welcome the opportunity to audition them over an internet video application.
• DJI Phantom 3 Professional Unmanned Aerial Vehicle (UAV). This UAV weighs less than
3 pounds and contains a built in camera. This particular model has been proven safe and
airworthy in multiple applications across the globe, with on-board GPS and Vision
Positioning. We have over 200 hours of flight/video time with this particular UAV and
have produced over 55 videos. We adhere to FAA methodologies and practices as well
as the AMA’s (Academy of Model Aeronautics). We would like to maintain a height of no
more than 50 feet for 90% of the video and would like 200 feet for not more than 5
minutes. We will maintain a speed of less than 10mph at all times unless emergency
procedures require a deviation.
• We will bring our own battery power so as to not use noisy generators.

• Statue of Captain John Parker
• Lexington Minutemen Relief
• Revolutionary War Monument
• The Belfry
• Portions of the actual Green for slow motion running of not more than 30 feet

Good evening.
Certainly the policy of filming a commercial on the Battle Green rests with the BOS. I few concerns I would have are:
* April is a challenging month for us providing security around the Battle Green. April 6th in particular is a bad
day. Could this be pushed back to May?
* I would not want Lexington Officers in the commercial.
* I would not want to examine rifles around the Battle Green to assess whether they were safe and empty. The golden
rule is ALWAYS assume the weapon is loaded. We have armorers who could determine that the firearms are made safe
and/or do not have firing pins.
* Aerial photography I assume means drone. We would need to discuss the safety measures over the Battle Green.
* Will there be a need to have a detail officer or two given the likelihood of drawing a crowd or controlling parking in the
area.
We are available if needed for further discussion.

Greetings:
I spoke with Lynne late last week and she advised me to email my request to your
board/commission.
I represent Patriot Ordnance Factory, a rifle manufacturer in Phoenix AZ. They manufacture
several types of rifle and will be releasing a model called the Revolution. Their general line of
products commemorates the colonial period and having a video from ‘where it all started’ would
be great. We use both ground and aerial in our videos. Our Aerial shots are usually lower than
40 feet with a possible 2 minute flight of 150 - 200 for a general perspective shot.
Please let me know how to proceed in obtaining the permits for this project.

schools;
Whereas: libraries level the playing field for all who seek information and access to technologies;
Whereas: libraries continuously grow and evolve in how they provide for the needs of every member
of their communities;
Whereas: libraries and librarians open up a world of possibilities through innovative programing,
access to technology and the power of reading;
Whereas: librarians are trained, tech-savvy professionals, providing technology training and access to
downloadable content like e-books;
Whereas: libraries support democracy and effect social change through their commitment to provide
equitable access to information for all library users regardless of race, ethnicity, creed,
ability, sexual orientation, gender identity or socio-economic status;
Whereas: libraries, librarians, library workers and supporters across America are celebrating National
Library Week;
Whereas: Tuesday, April 12, 2016, has been designated as National Library Workers day in
appreciation of their work;
Whereas: Cary Memorial Library in Lexington, Massachusetts is located in the heart of the Town
center and the library and library workers provide an invaluable service to the citizens of
Lexington with compassion, understanding and professionalism.
NOW, THEREFORE, WE, THE BOARD OF SELECTMEN of the Town of Lexington, Massachusetts do
hereby proclaim the week of April 10 to 16, 2016 as:

PROCLAMATION
Whereas: In 1872, J. Sterling Morton proposed to the Nebraska Board of Agriculture that a
special day be set aside for the planting of trees; and
Whereas: This holiday, called Arbor Day, was first observed with the planting of more than a
million trees in Nebraska; and
Whereas: Arbor Day is now observed throughout the nation and the world; and
Whereas: Trees can reduce the erosion of our precious topsoil by wind and water, cut heating
and cooling costs, moderate the temperature, clean the air, produce oxygen and
provide habitat for wildlife; and
Whereas: Trees are a renewable resource giving us paper, wood for our homes, fuel for our
fires and countless other wood products;
Whereas: Trees in our town increase property values, enhance the economic vitality of
business areas, and beautify our community; and
Whereas: This year the Town of Lexington has once again been recognized as a Tree City
USA, the 27th year for this designation.
NOW, THEREFORE, WE, THE BOARD OF SELECTMEN of the Town of Lexington,
Massachusetts, do hereby proclaim April 29, 2016 as
ARBOR DAY
in the Town of Lexington and we urge all citizens to support efforts to protect our trees and
woodlands and to support our town’s urban forestry program;
And Further: We urge all citizens to plant and protect trees to promote the well being of present
and future generations.
