To any of the Constables of the Town of Lexington Greetings: In the name of the Commonwealth of Massachusetts,you are hereby directed to notify the inhabitants of the Town of Lexington qualified to vote in elections and in Town affairs to meet at the Clarke Middle School, 17 Stedman Rd, in said town on Monday, November 17, 2003 at 8:00 p.m., at which time and place the following articles are to be acted upon and determined exclusively by the Town Meeting Members in accordance with Chapter 215 of the Acts of 1929,as amended,and subject to the referendum provided for by Section eight of said Chapter, as amended. ARTICLE 1 REPORTS OF TOWN BOARDS, OFFICERS, COMMITTEES To receive the reports of any Board or Town Officer or of any Committee of the Town. (Inserted by the Board of Selectmen) ARTICLE 2 OPERATING AND CAPITAL BUDGET To see if the Town will make supplementary appropriations for Fiscal Year 2004 to be used in conjunction with money appropriated under Article 4 of the warrant for the 2003 Annual Town Meeting and as previously amended, or reduce, rescind, adjust or change the source of funding of, or otherwise amend any operating or capital appropriations made at the 2003 Annual Town Meeting; to determine whether the amounts needed for any such supplementary appropriations shall be provided by the tax levy, by transfer from available funds, or by any combination of these methods; or act in any other manner in relation thereto. (Inserted by the Board of Selectmen) DESCRIPTION This article permits Town Meeting to make additional appropriations for Fiscal Year 2004 (July 1, 2003-June 30, 2004)for any purpose and to amend any operating or capital appropriations made for Fiscal Year 2004 that were voted at the 2003 Town Meetings. The purpose of this article is to provide Town Meeting with maximum flexibility to reconsider the Town's Fiscal Year 2004 budget. ARTICLE 3 ZONING BY-LAW, CD-6 to CRO RANGEWAY-Lot 64 of Assessors Map 90 To see if the Town will vote to amend the Code of the Town of Lexington,Zoning By-Law sections and the Zoning Map of the Town of Lexington by changing the zoning district designation of the land described in Exhibit A from the current RO, One-Family Dwelling District Zone to RD, Planned Residential Development; said property is located on the easterly side Rangeway at its intersection with James Street, being shown on Assessors Map 90 as Lot 64, containing 62,160 square feet; to allow the construction of one two-family dwelling by the Lexington Housing Assistance Board(LexHAB);or act in any other manner in relation thereto. The preliminary site development and use plan for the RD Planned Residential District will be filed with the Planning Board and Town Clerk as required by and in accordance with the requirement of the Zoning By-Law (Inserted by the Lexington Housing Assistance Board(LexHAB)) DESCRIPTION The proposed amendment would allow for the construction of a two-family dwelling to be used for affordable housing on a rental basis by the Lexington Housing Assistance Board (LexHAB). The rezoning is required as the current zoning only allows single-family dwellings. It will include improvements to portions of Rangeway that would serve as access for the dwelling. ARTICLE 4 ZONING BY-LAW,CD-6 to CRO 12-18 Hartwell Avenue To see if the Town will vote to amend the Code of the Town of Lexington,Zoning By-Law sections and the Zoning Map of the Town of Lexington by changing the zoning district designation of the land described in Exhibit A from the current CD-6,Planned Commercial District Zone to CRO,Regional Office District Zone, said property being commonly known and numbered as 12-18 Hartwell Avenue or act in any other manner in relation thereto. The proposed amendment would rezone the 12-18 Hartwell Avenue property from the present CD-6 Planned Commercial District to CRO Regional Office District. ARTICLE 5 SAFE HAVENS To see if the Town will vote to authorize the Board of Selectmen to petition the Legislature to enact a Special Act which would provide for safe placement of newborns and infants in the Town of Lexington. (Inserted by Michael Morrisey and 100 or more registered voters) DESCRIPTION Since parents are not protected from prosecution for their abandonment of a newborn or infant,the incidents of newborns discarded into trash receptacles or abandoned in public places will continue to occur. This act would seek to protect the health and safety of any infant child seven(7)days of age or younger by allowing his or her acceptance when placed by parents or lawful agents of parents with authorized employees of designated facilities("safe havens"such as police,fire stations or hospitals). The authorized employees at such facilities shall make every effort to obtain information about the child and family(in the best interests of the child), while adhering to regulations, including confidentially,and will provide a pamphlet to the parents outlining the process of their rights. And you are directed to serve this warrant fourteen days at least before the time of said meeting as provided in the By-Laws of the Town. Hereof fail not and make due return of this warrant, with your doings thereon, to the Town Clerk, on or before the time of said meeting.
