To either of the Constables of the Town of Lexington, in said County, Greeting: In the name of the Commonwealth of Massachusetts, you are directed to notify the inhabitants of the Town of Lexington qualified to vote in elections and in Town affairs to meet in Cary Memorial Hall, in said Town, on Monday, the third day of June, 1968, at 8: 00 P.M. , then and there to act on the following articles: ARTICLE 1. To receive the reports of any board of Town Officers or of any committee of the Town. ARTICLE 2. To see if the Town will appropriate an additional sum of money for Engineering - Personal Services for the balance of the year 1968, and determine whether the money shall be provided by the current tax levy, or by transfer from available funds, including any unexpended balances in current appropriations, or by any combination of these methods; or act in any other manner in relation thereto. ARTICLE 3. To see if the Town will vote to instruct the Selectmen to petition the General Court for the enactment of legislation authorizing the establishment of a Selectmen-Town Manager form of government in the Town of Lexington, such legislation to be substantially in accordance with the proposed legislation prepared and submitted by the Structure of Town Government Committee, or as the same may be amended by vote of the Town Meeting, a copy of such proposed legislation being on file in the office of the Town Clerk; or act in any other manner in relation thereto. ARTICLE 4. To see if the Town will vote to continue or to revive the committee called the Structure of Town Government Committee established under Article 49 of the Warrant for the 1966 Annual Town Meeting, and determine the time and purposes for which said Committee shall be continued or revived; or act in any other manner in relation thereto. 2. ARTICLE 5. To see if the Town will appropriate a sum of money for highway construction under the suthority of Chapter 90 of the General Laws, and determine whether the money shall be provided by the current tax levy, or by transfer from available funds, including any unexpended balances in current appropriations, or by any combination of these methods; or act in any other manner in relation thereto. ARTICLE 6. To see if the Town will vote to instruct the Selectmen to petition the General Court for the enactment of legislation to provide for placing on the official ballot used in the Town at each biennial state election a question whether licenses shall be granted in the Town for the sale therein of all alcoholic beverages by certain clubs and war veterans' organizations; or act in any other manner in relation thereto. ARTICLE 7. To see if the Town will vote to instruct the Selectmen to petition the General Court for the enactment of legislation to provide for placing on the official ballot used in the Town at each biennial state election a question whether licenses shall be granted in the Town for the sale therein of all alcobolia beverages byrestaurantshating a ht ung a dining room capacity of not less than ninety-nine persons; or act in any other manner in relation thereto. ARTICLE 8. To see if the Town will appropriate money to be used in conjunction with money previously appropriated for the construction of a sewer main or mains, and the acquisition of land or interests therein necessary therefor, in such accepted or unaccepted streets or other land as the Selectmen may determine, subject to the assessment of betterments or otherwise , in accordance with Chapter 504 of the Acts of 1897, as amended, or otherwise, and determine whether the money shall be provided by the current tax levy, by transfer from available funds, including any special sewer funds, or by borrowing, or by any combination of these methods; or act in any other manner in relation thereto. r- 3. ARTICLE 9. To see if the Town will authorize the Selectmen to purchase, take by eminent domain or otherwise acquire, for street, play- ground and recreation purposes, all or any part of land described as follows: Lot 61 on Map 47 consisting of 20.9 acres, more or less, said map being a Property Map of the Town of Lexington prepared by James W. Sewall Company of Old Town, Maine, dated 1962, as modified and updated by the Town from year to year; and appropriate money therefor and determine whether the money shall be provided by the current tax levy, by transfer from available funds, including any unexpended balances in current appropriations, or by borrowing, or by any combination of these methods; or act in anyother manner in relation thereto. here o. ARTICLE 10. To see if the Town will vote to amend the Zoning By-Law by striking out Sections 1 through 20, inclusive, thereof, m amended, together with all zoning maps referred to therein, and by substituting therefor Sections 10 through 40, inclusive, as set forth in the Zoning By-Law attached hereto and incorporated in this Article by reference, and the Zoning Map referred to therein on file in the office of the Town Clerk; or act in any other manner in relation thereto. C 4. ARTICLE 11. To see if the Town will vote to cover such elected or appointed officers of the Town under the Workmen' s Compensation Act as the Selectmen may, from time to time, designate, under the authority of Section 69 of Chapter 152 of the General Laws, as amended by Chapter 401 of the Acts of 1966; or act in any other manner in relation thereto. ARTICLE 12. To see if the Town will vote to authorize the Selectmen to retain professional services for design of a suitable veterans' memorial to be located at Emery Park or other suitable place in the Town and appropriate a sum of money for such services, and determine whether the money shall be provided by the current tax levy, or by transfer from available funds, including any unexpended balances in current appropriations, or by any combination of these methods; or act in any other manner in relation thereto. ARTICLE 13. To see if the Town will authorize the construction and installation of additions to the Civil Defense warning system and the relocation of three existing warning devices ; appropriate money therefor, and determine whether the money shall be provided by the current tax levy, or by transfer from available funds, including any unexpended balances in current appropriations, or by any combination of these methods; or act in any other manner in relation thereto. ARTICLE ll}. To see if the Town will vote to appropriate a sum of money for development of a parking area on land abutting on Worthen Road and adjacent to the south side of the Senior High School Field House, and determine whether the money shall be provided by the current tax levy, by transfer from available funds, including any unexpended balances in current appropriations, or by borrowing, or by any combination of these methods; or act in any other manner in relation thereto. ARTICLE 15. To see if the Town will appropriate an additional sum of money for Cemetery Department - Expenses for the balance of the year 1968, and determine whether the money shall be provided by the current tax levy, or by transfer from available funds, including any unexpended balances in current appropriations, or by any combination of these methods; or act in any other manner in relation thereto. 5. ARTICLE 16. To see if the Town will authorize the Conservation Commission to purchase or otherwise acquire, and will authorize the Selectmen to take by eminent domain upon the written request of the Conservation Commission, for conservation purposes as provided by Section 8C of Chapter 40 of the General Laws, all or any part of land described as follows: Lots 99, 128 and 129 on Map 83, consisting of 9.25 Acres, more or less, 100,960 square feet, more or less, and 2.7 Acres, more or less, respectively, said maps being Property Maps of the Town of Lexington prepared by James W. Sewall Company of Old Town, Maine, dated 1962, as modified and updated by the Town from year to year; and appropriate money therefor and determine whether the money shall be provided by the current tax levy, by transfer from available funds, including any unexpended balances in current appropriations, or by borrowing, or by any combination of these methods; or act in any other manner in relation thereto. li ARTICLE 17. To see if the Town will authorize the Selectmen to release lots 102 to 104, inclusive, on Taft Avenue from the restrictions imposed in a certain deed from the Town to Jennie C. Coye and Edward E. Coye conveying lot 99 on Taft Avenue, which deed is dated October 27, 1958 and reccrded in Middlesex South District Registry of Deeds, Book 9259, Page 263, and will set the minimum amount to be paid for such release; or act in any other manner in relation thereto. ARTICLE 18. To see if the Town will appropriate an additional sum of money to be used in conjunction with money appropriated under Article 26 of the Warrant for the 1968 Annual Town Meeting for the purchase by or with the approval of the Selectmen of equipment for the Department of Public Works, and determine whether the money shall be provided by the current tax levy, or by transfer from available funds, including any balance in the Fire Loss Recovery - Public Works account, or by any combination of these methods; or act in any other manner in relation thereto. 6. ARTICLE 19. To see if the Town will authorize the Selectmen to retain professional services for the preparation of plans and specifications for the development of the so-called Old Reservoir area off Marrett Road for recreational use, including swimming, and to develop all or a portion of said area; and appropriate money therefor, and determine whether the money shall be provided by the current tax levy, or by transfer from available funds, or by any combination of these methods; or act in any other manner in relation thereto. (Inserted at the request of one hundred or more registered voters. ) ARTICLE 20. A. To see if the Town will vote to amend the General ByLaws by striking out Section 2 of Article XXVII in its entirety and inserting in place thereof a new Section 2 to read as follows: Section 2. No dog owned or kept in this Town shall be allowed to be off the premises of its owner or keeper except in the immediate restraint and control of some person by means of a leash. The owner or keeper of any such dog that is not so restrained or controlled off the premises of its owner or keeper shall be punishable by a fine of ten dollars for each offense. B. To see if the Town will appropriate a sum of money for personal services and expenses for such enforcement of this By-Law and determine whether the money shall be provided by the current tax levy or by transfer from available funds or by a combination of these methods or act in any other manner in relation thereto. (Inserted at the request of one hundred or more registered voters, ) And you are directed to serve this warrant seven days at least before the time of said meeting as provided in the By-Laws of the Town. Hereof fail not, and make due return on this warrant, with your doings thereon, to the Town Clerk, on or before the time of said meeting.
