Cohen, Nyles Barnert and Martha C. Wood Alternate Member: James Osten Administrative Staff: Julie Krakauer, Zoning Administrator and Sharon Coffey, Administrative Clerk Address: 7 Lockwood Road The petitioner is requesting a SPECIAL PERMIT in accordance with the Zoning By-Law (Chapter 135 of the Code of Lexington) section(s) 135-9.4 and 135-8.4.2 to allow modification to non-conforming structure. The petitioner submitted the following information with the application: Nature and Justification, Plot Plan, Plans, Elevations and Gross Floor Area Calculations. Also submitted was a certificate of appropriateness and a certificate of appropriateness extension email. Prior to the meeting, the petitions and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Planning Director, the Historic District Commission Clerk, Historical Commission, Economic Development, and the Zoning Administrator. Comments were received from the Zoning Administrator, Building Commissioners and the Historic District Commission. Presenter: William Erickson Bechtel Frank Erickson on behalf of Elizabeth Crampton The Hearing was opened at 7:04 pm. Mr. Erickson presented the petition. He stated they are proposing a small mudroom and rear entry at the back corner of the house. The proposal would be keeping a simple line on the house that exists. This went before the Historic District Commission and was deemed appropriate. The house is not parallel to the property line. They are not increasing demand on town services. This is an improvement on a small house and keeps diversity in the housing stock. A Board Member, Nyles N. Barnert, questioned the floor plan (Clarified the plan). There were no questions or comments from the audience. There were no further questions from the Board. The Hearing was closed at 7:15 PM (a role call was taken: Ralph D. Clifford– Yes, Jeanne K. Krieger – Yes, Martha C. Wood – Yes, Norman P. Cohen – Yes and Nyles N. Barnert – Yes). There were no comments from the Board. Wood Alternate Member: James Osten Administrative Staff: Julie Krakauer, Zoning Administrator and Sharon Coffey, Administrative Clerk Address: 1764 Massachusetts Avenue The petitioner is requesting a SPECIAL PERMIT in accordance with the Zoning By-Law (Chapter 135 of the Code of Lexington) section(s) 135-9.4 and 135-3.4 (Table 1 Permitted Uses and Development Standards) Line J.1.02 of the Zoning Bylaw (Chapter 135 of the Code of Lexington) to allow fast food use in the CB Zoning District The petitioner submitted the following information with the application: Nature and Justification and floor plans. Also submitted was a certified plot plan waiver request. Prior to the meeting, the petitions and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Planning Director, the Historic District Commission Clerk, Historical Commission, Economic Development, and the Zoning Administrator. Comments were received from the Zoning Administrator, Building Commissioners and Economic Development. Presenter: Jeffrey Lin on behalf of Coco Fresh Tea & Juice The Hearing was opened at 7:16 pm. Mr. Lin presented the petition. He reviewed his business. He stated he did not request seating when they opened due to the pandemic. They are requesting seating of 6 seats. They want to create an engaging area for people to hang out and create a sense of community. The proposal will no affect traffic or parking. He showed the floor plan. A Board Member, Nyles N. Barnert, questioned the hours of operation (10 am to 9pm, 7 days a week). Chair, Ralph D. Clifford, questioned if they have any current Special Permits (This is their Special Permit request. Take out is allowed by-right). There were no questions or comments from the audience. There were no further questions from the Board. Mr. Lin stated they enjoy their time in Lexington and look forward to continuing to serve in Lexington. The Hearing was closed at 7:24 pm (a role call was taken: Ralph D. Clifford– Yes, Jeanne K. Krieger – Yes, Martha C. Wood – Yes, Norman P. Cohen – Yes and Nyles N. Barnert – Yes). The Board agreed on a 2-year renewal. The Board agreed to condition the hours of operation. There were no further comments from the Board. The Board of appeals voted four (4) in favor, zero (0) opposed, and zero (0) in abstention to grant a waiver for a certified plot plan (a role call was taken: Ralph D. Clifford– Yes, Jeanne K. Krieger – Yes, Martha C. Wood – Yes, Norman P. Cohen – Yes and Nyles N. Barnert – Yes). The Board of appeals voted five (5) in favor, zero (0) opposed, and zero (0) in abstention to grant a SPECIAL PERMIT in accordance with the Zoning By-Law (Chapter 135 of the Code of Lexington) section(s) 135-9.4 and 135-3.4 Table 1 (Permitted Uses and Development Standards) to allow fast-food use in the CB zoning district (a role call was taken: Ralph D. Krieger – Yes, Martha C. Wood – Yes, Norman P. Cohen – Yes and Nyles N. Barnert – Yes). The Board voted to adjourn.
