Mitchell, Vice Chairman, Gen. Gov't. , Donald B. White , Vice Chairman, Schools, Elizabeth M. Flynn, Secretary, J. H. Blaisdell, Martin Gilman, Richard M. Perry, Comptroller I . COMMUNICATIONS a. Received formal resignation from Mr. Neil Chapman. b. Nominations for replacement: 1. Harry Hall-Kyonize Paint Co. 2. Earl Sukeforth-Hood Milk Co. 3. Donald Comstock-President-bellofram Corp. c. Reserve Fund Transfers from Selectmen. II . RESERVE FUND TRANSFER a. Request for $2,000 to be transferred into Legal Fees. This is to be used for special Counsel for legal services for St. Brigid's . Mrs. Flynn stated that this could be a long case and could involve a lot more than $2,000. A letter from Donald E. Nickerson, Chairman of the board of Appeals was circulated to the Committee for their review. (Attached) Chairman Furash stated that one of two things had to be done : Yes-No; refer it back to the Board of Selectmen. Town Manager O'Connell joined the meeting and expressed the feeling of the Board in saying they think the Town is obligated to support the need for outside legal services . Mr. White stated that he felt the Selectmen wanted the Appropriation Committee to make the decision for them. I feel we should ask the Boari to take the 4)2,000 out of their existing budget, Mr. White said . Chairman Furash stated that if a tie vote came up he would vote Yes and I feel that a vote of no will be taken the wrong way by the Board. b.Motion: Lay the matter on the table and refer it back to the Board of Selectmen that they find the funds in the existing budget. Upon motions duly made and seconded, the above motion was VOTED 5 against and 3 for. Meeting adjourned at 9: 20 P.P . Next meeting is scheduled for Monday, October 15, 1974 at 7 :30 P.M. Furash, Chairman Appropriation Committee 15 John Poulter Road Lexington, MA 02173 Dear Sir: Last night the Board of Selectmen voted in open meeting to allow the Planning Board to appeal to your committee for funds so that they can take legal issue against our decision to take to the Superior Court our request to set aside the decision of the Housing Appeals Committee of the Department of Community Affairs to nullify our denial of the Planning Office for Urban Affairs to build sixteen apartments on part of the St. Brigid's Church land. I would like to request that you notify us when the Planning Board appears before your Board with this request and if they do not appear but notify you by letter, that we be allowed to discuss the matter with your committee.
