Owing to a meeting in Estabrook Hall of the
Precinct Members of Precinct two to determine a
tie vote , the Town Meet i n . was not cal led together
until 8 : 15 P . M . by Moderator Robert H . Holt .
Art . 1 . Under this article on motion of Mr . Albert
H . Burnham it was
" Voted : That a Committee of three ( 3 ) of whom
the Modntor shall be a member , be appointed to act
on behalf of the Town in connection with the lectures
provided for :ender the wills of Eliza Cary Farnham
and Suzzanne E . Cary , said Committ ^ e to continue

offered the following votes :
" Voted : That the Board of Selectmen be authorized
to cons tbuc t a sewer in Fottler Avenue ' s. distance of
approximately 1250 feet .
Voted : That the Board of Selectmen be authorized
to construct a sewe „ in Bow Street , a distance of
approximately 560 feet .
Voted : That the Board of Selectmen be authorized
to construct a sewer in Theresa Avenue , a distance of
approximately 220 feet .
Voted : That the Board of Selectmen be authorized
to construct a sewer in Cliffe Avenue , a distance of
approximately 520 feet .
Further Voted : That for the purpose- of constructing
securers in said streets , the sum of 20, 000 be approp -
riated , saidsum to include 135000 to be appropriated
and assessed in the levy of the current year and that
the Treasurer with the approval of the Selectmen be
and hereby is authorized to sell bonds or notes of
the Town in t;be sum of $15 , 000 issued and payable in

Mr . Theodore A . Custance then offered the following
vote :
" Voted : That the Board of Selectmen be authorized
to co --_s true t a sewer in Winthrop Road Extension a
distance of approximately 250 ' . 1?
Under this article , Dr . James J . Walsh
stated that he felt it should not be necessary to
install a sewer in a road wh i ch at the present time
is not a public street and has not any houses built upon
it , and discoura; ed any action under this vote .
Dr . James J . Walsh then offered a motion to
indefinitely postpone t. is part of the article .
Tle Moderator declared the motion to indefinitely
pos tpone lost .
Fifteen people havinn doubted the vote , a
rising vote was taken with the result of 81 votes
in favor of pos tpon _ _ 1 :T and 49 a. ains t . The Moderator
declared the motion to install a rsewer in Winthrop
Road inde .finitel , postponed .
Mr . Theodore A . Custance then offered the
following motion :
" Voted : That for the purpose of constricting
sewers in said streets , the sum of $20 , 000 be
appropriated , said sum to iiclude ; 5 , 000 to be
appropriated and assessed in the levy of the current
year and that the Treasurer with the approval of
the Selectmen be and hereby is authorized to sell
bonds or notes of the Town in the sum of $15 , 000
issued and payable in accordance with law . " $5000 . 00

Mr. Custance explained that the cost of
the extension in Winthrop Road wo 'zld be only $ 750 ,
and that is why he did not ,educe the annronri_atioe
of $20 , 000 , as that would give the Selectmen an
opportunity to complete the work and be sure that
the estimates will be met .
The above vote requ' red two - thirds vote ;
the vote of the meetin - wa :, taken with the result
of 130 in favor and one i the negative . The motion
was therefore declared carried .
Arts . ' 1 Fc g2 . Under these articles on motion of
Mr . Lheodore A . Custance the following votes were
passed unanimously :
" Voted : That the Board of Selectmen be authorized
to install water mains , not less than six inches
in size in the followin:�; unaccepted streets , subject
to tie usual guarantee : Valley Road, Freemont Streit
and Winthrop Road Extension , and
Voted : That the Board of Selectmen be authorized
to install water mains , not less than six inches in size
in the following accented streets : Walnut Street and
Allen Street , and
Further Voted : That for the nureos e of installing
water mains in the streets mentioned in Articles 21
and 22 the sum of ` 30 , 000 be appropriated for Water
Construction Account and that for thepIrpo .�se n ti,,

tee money , the Town Treasurer be and hereby is
authorized to sell uncle - the direction of and with
the approval of the Selectmen, bonds or notes of the
Town , issued and payable as provided by law . "
Art . 24 . Under this article , Mr . Theodore A . Custance
offered the following; motion :
Voted : That the Town accept the layout as a town
wad, of an extens i _ n of Clarke Street as laid out by 1
the Board of Selectmen under the Betterment Act , and
shown on plan on file in the Town Clerk ' s Office , and
for the purpose of constructing said street the sum
of. S3 , 500 . be appropriated and assessed . "
Under this article Mr . Edward Wood stated that
he felt according to the description of his deed that
some of his land was to be taken for hi •hwaypurposes .
Mr . Hollis '.t;ebster also asked for someinformationon the ques tion as to whet ler the land wan properly
measured . -
Mr . Willard C . Hill stated that ; . e felt no
injustice should be done to Mr . Wood in takinir

The Town Engineer reoorted that he did notbe-1 leve •
the Town was takinrr any of Mr . Wood ' s land ; that they
were going up to the boundary of his property .
Mr . James Stuart Smith then offered a motion that
the Mod e Bator appoint a Committee of five citizens to
re000rt on this matter at a subsequent meetin T , and the
meeting so voted .
Committee Appointed : Willard C . Hill , James Stuart Smith ,
Hazen W. Hamlin, Eugene G . Kraetzer, and J . Henry Duffy .
Art . 25 . Under this article on motion of Mr . Theodore
A . Custance , the foil owing vote was passed :
" Voted : That the Town accept the layout as a town
way of a portion of Fottler Avenue , all as laid out by
the Selectmen under the Betterment Act and as shown on
plan on file in the Town Clerk ' s Office dated Aucyis t 22 , l929
Under this article Mr. Custince stated that if the
meeting would waive the reading of the layout of the
str et , he would have it included in the record of the
meeting .
The Town Counsel agreed that it was not necessary
to road tine description of the various street takings ,
and it was therefore decided to waive the reads _ { of the
descriptions .

that said paragraph shall read as follows:
" At the junction of Marrett Road , formerly School Street ,
Lincoln and School Streets , commonly known as "The Five Forks " ,
a business district on1 both sides of Marrett Road extending
southerly for a distance of 200 feet from the :raos t southerly
line of Lincoln Street and of a depth of 100 feet frit m the
adjacent street line in each instance . "
( By statute 1929 , Chapter 39 this must be adopted by a two -
thirds vote . )
Mr . Frederick L . Emery , Chairman of the Plannin r Board
then read the following report of the Planning Board to
the Board of Selectmen dated. February 13 , 1930 .
The Selectmen ,

Gentlemen :
On or about May 15th , 1929 , the Planning Board

received from you petition of George W. Sarano
and others , asking that certain areas at the inter-
sections of Marrett Road , Lincoln Street and School
Street , commonly known as "The Five Forks" , be
chan ed from C . 1 or Business Districts , as they are
now zoned , to R . l or Residential Districts .
Following receipt of this petition , the Planning
Board held a hearing in the Selectmen ' s room on
the evening of October 7th , 1929 , notice of which was
duly published under our Zoning Law in the Lexington
Times and notices of which were also sent b ;
registered mail to all individual property owners owning
property in that locality . The hearing was well
attended .
The owners of the major part of the territory , the
status of which the petition asked to have chan - 4,
appeared to favor the proposed change ; the only
opposition came from two out - of- town attorneys , one
of whom represented the owners of the triangular piece
o property between School Street and Marrett Road,
and the other of w om held a small mortgage on that property .
A very small area only near the tip of the triangle
would be affected by the proposed change , andthis small
Portion that would he so affected is behind and virtually
controlled by the tip portion itself, which is owned
by one of the petitioners who advocated the change .
The petition in effect asked thai:, the business
areas provided unr' er our present Zoning Law on both
sides of Marrett Road and School Street north of
Lirmin Street , and on both sides of Lincoln Street ,
save the depth fronta : es of the existing bus ' ness
section on Marrett Road at the south of Lincoln Street ,
he restored to R . 1 or Residential areas .
After a full he .'ring, and a very full subsequent •
consideration of the petition following the hearing ,
. the Planning Board unanimously recommends that the Zoning
Law be amended in accordance with the article relating
thereto in the warrant for the Town Meeting .
When the original Zoning Law was adopted in the town ,
it was considered good practice to provide business
districts beyo4d intinediate needs andsuch as would
reasonably provide for future development of the town .
Since then , it has , come to be considered the better practice
not to provide busAness districts to accommodate develop -
ment s many years in advance of present requirements ,
and , since there is no immediate regi.irement for a
business area or district in the vicinity of. " The Five
Forks " in excess of what is provided for on both sides
of MarrE tt Roadsouth of L ' noln Street , and since the
owners of the major part of the property , the `status
of which it is desired to change , favor the proposed
change , the Planning Board feels that the restoration
of such areas to residential districts had best be
made , to preserve the status of residential districts
as long as possible .
Our experienine in Lexington , as well as the
experience of other towns , shows that where the business
districts are mor extensive than really requi 'ed,
the tendency is for scattered building of stores at
different points in the entire area , instead of compact • •
building within a smaller area . Scattered location of

stores does not make for property valuation thereof
as b' isiness properties , and at the same time causes
substantial depreciation of the residential
properties between , with the result that neither
the owners of the business properties , nor theowners
of the residential properties , are as well off as
if the business ar: as were more restricted , and the
business building more compact .
While it probably would not he wise to undertake
any wholesale readjustment of business areas as at
present l ' tid down by the Zon tig Law, whenever the
owners of properties now zoned for business petition for
restoration of such properties to res irk ent ial districts ,
such petitions shoa.ld , jn the opinion of the Planning
Board , be given serious consideration .
It should be said in behalf of the signers of the
present petitionthat they c? esa. red this proposed change
to be considered at the time the recent extensive
amendments to the Zoning Law were made , but at the request
of the Planning Board they generously consented to defer
filing their petition until Step the major amendments had
been considered by the Town , in order to avoid complications
that might otherwise have developed .

Mr . Th ery then went on to explain that a hearing
had been held on the petition signed by residents of
the vicinity of Five Forks , asking for a change in the
Zoning Law . The hearing had been well attended , and
there was no objection except from an out of. Town attorney
and from a man who held a mortgage on the property of
Innis & McLe ihon.
Mr . Emery felt that it was the intention of the
owners of that property to apply for a filling station
to be located on the corner of their property , and
the Planning Boav^ri were of the opinion that ] t was not
a proper location inasmuch as the tip end of the land
was controlled by one of the petitioners for a change
in the Zoning Law .
Mr . Francis Burke stated that he felt it was unfair
to Innis & Mctennon, owners of the property known as
Marrett Gardens , in which development they havee sixty -
•• fvacant lots , to impose a restriction upon their
property b:r removing the business zone , inasmuch as when
they purchased this p'operty , they 'urchased it in good
faith and. " did not know of any petition having been filed
with the Planning Board for a change in the Zoning Law .
They felt that any piece of property developed for house
lots needed a business location reserved for stores ,
and realizing how hard it w _Zs to secure a o ece of property
placed in the business district , he felt that this
property should not be changed.
Remarks were made by Dr . James J . Walsh , Robert J .
Fawcett , Edgar F . Scheibe , Arthur F . Hutchinson and Patrick
Flynn against the proposition of changing the Zoning Law .
• Remarks were made by Mr . and Mrs . George W . Sarano and
Edgar F . Scheibe in ravor of the petition . Remarks wen () also
made by Eugene T . Buckley and Lawrence G . Mitchell .
A two-thirds vote being necessary, a rising vote w 'is
taken with the r 4sult of fifty- eight in favor of amending
the Zoning Law, and eighty against , and the motion was
declared lost .

Mr . Theodore n . Custance offered a motion to indefinitely
postpone all articles not acted upon , inasmuch as it was
explained to the meeting that no action on construction work
could be started until five days after the final adjournment
of the Town Meeting . T'fle meeting therefor voted to indefinitdly
postpone all articles , the Town Counsel having presented an
opinion that he saw no reason why this could not be done .
The meeting dissolved at 10 : 03 P . Y .
