Meeting:Zero Waste Resolution.

Meeting:Appropriate for Worthen Road Recreation and Education District Land Use Concept Plan.

ARTICLE ZERO WASTE RESOLUTION
WHEREAS, Town Meeting has voted on multiple policies and resolutions that
recognize and take action on threats posed by climate change, including:
2005: Lexington adopted our Sustainable Design Policy, committing to designing
and building our municipal buildings with an adherence to sustainability through
elect�-ification and improved building efficiency.
2010: the Sustainable Lexington Committee was created to examine and
guide Lexington's sustainability goals and priorities for implementation.
2013 : Lexington Town Meeting adopted a Climate Change Resolution to consider
climate change in a11 appropriate decisions.
2016: Lexington Town Meeting approved the Community Choice Aggregation
program to move the Town's electricity to 100%renewable energy.
20l 6: Lexington Public Schools contract for compost pickup in all nine schools.
20l 8: The Board of Selectmen adopted the Sustainable Action Plan and Getting to Net
Zero
Emissions Plan.
2019: Board Of Selectmen & School Committee jointly approved an Integrated
Building Design & Construction Policy for schools and all other town buildings.
This policy expanded on and replaced the Sustainable Design Policy.
2020: Lexington Town Meeting approved a resolution endorsing the declaration of
a climate emergency and called for regional collaboration to reverse global
warming and to move towards a more sustainable economy; and
WHEREAS, these resolutions and policies taken together reflect the values of our
community with respect to environmental justice and sustainability; and
WHEREAS, solid waste contributes duectly to climate change through the generation of
greenhouse gases during product manufacture and disposal, with locations most often
near financially disadvantaged communities; and
WHEREAS, the Guiding Principles of Zero Waste ("Zero Waste") are:
• preserving natural resources by means of responsible production and consumption;
• conserving natural resources through waste prevention;
• promoting reusable products and the use of materials (glass, metal, etc.)that
are durable, reusable and made from non-toxic materials;

• reducing the use of single-use,non-recyclable products and materials;
� treating waste as a resource;
• regenerating natural resources through composting and recycling;
• turning discarded resources into jobs and new products instead of trash; and
• managing waste without burning and with no discharges to land,water, or air that
threaten the environment and humanhealth.
WHEREAS, Zero Waste minimizes resource consumption and eliininates �vaste
whenever possible in order to conserve energy, initigate climate change, reduce water
usage,prevent the creation of toxins, and stop ecosystein destruction; and
WHEREAS, Zero Waste redesigns our systems of resource use from a linear model of
take, make, use and dispose to a circular model of reuse; and
WHEREAS, Zero Waste captures our discards and uses them, instead of new
resources, to make new products, creating far less pollution; and
WHEREAS, the Town of Lexington generates over 9000 tons of trash annually, which is
incinerated at the Wheelabrator Incinerator in North Andover with residual ash disposed
of at the Ash Landfill in Shrewsbury, at an approximate cost of $1.7M for hauling and
disposal combined, or $189 per ton; and
WHEREAS, MassDEP projects that in-state landfill capacity for solid waste will
decline to nearly zero by 2028, making source reduction and diversion efforts even
more important; and
WHEREAS, organic compostable waste makes up at least 25%, and thus the
biggest component, of residential waste; and
WHEREAS, Lexington collects over 3600 tons of discarded materials and products
annually to be sorted for recycling, at an approximate cost of $1.6M for hauling and
disposal combined, or $322 per ton; and
WHEREAS, voluntary recycling of plastic does not achieve high levels of resource
recovery and waste reduction; and
WHEREAS, current waste incineration and landfilling of our trash can cause damage to
human health and the enviromnent, waste natural resources, generate greenhouse gases,
and wrongly transfer health and environmental harms to environmental justice
communities and our future generations; and
WHEREAS, the reuse and recycling of discarded products and materials can stimulate and
drive local economic development and job creation; and

WHEREAS, as Americans we represent 5% of the population and generate 50% of the
world's waste; and
WHEREAS, the state's 2030 Solid Waste Master Plan has set a goal to reduce the state's
total solid waste fiom a 2018 baseline by 30% by 2030 and 90% by 2050.
NOW, THEREFORE, BE IT RESOLVED:
The TOWN OF LEXINGTON hereby adopts and agrees to model the Guiding
Principles of Zero Waste as overarching goals for the community and all municipal and
school operations, and commits to the following specific goals:
1. Meet or exceed the state's 2030 Solid Waste Master Plan waste reduction goals by
committing to reducing Lexington's waste disposal froin a 2018 baseline by 90°/o
by 2050 with an interim milestone of 25% by 2025 and 35% by 2030, including
providing town-wide compost services to divert the biggest component in solid
waste;
2. Develop a Zero Waste Plan through existing town committees by 2023. This plan
would:
a. assess the TOWN OF LEXINGTON'S current levels of resource use and
waste generation;
b. identify objectives for waste reduction;
c. recommend short-, medium-, and long-term actions to reach these
objectives including: infrastructure,policies, local and regional programs,
and education and community engagement.
Through a public process, the Zero Waste Plan would seek to effectively,
efficiently, and quickly address the issues identi�ied.
3. Prioritize solid waste reduction programs that minimize the impact on environinental
justice communities.

MOTION:
That the Town appropriate $175,000 for the purpose of implementing the "Land Use Concept
Plan," and incidental costs related thereto, to be spent under the direction of the Director of Public
Facilities in conjunction with the Permanent Building Committee and in consultation with the
Town Manager's January llth Center Recreation High School Committee; and that to meet this
appropriation, $175,000 be appropriated from the General Fund unreserved fund balance.

ARTICLE 33 AUTHORIZE AND RATIFY REMOTE TOWN MEETINGS
To see if the town will vote to authorize the Select Board to petition the Massachusetts General Court
for legislation providing that notwithstanding the provisions of any general or special law or by-law to
the contrary, all acts and proceedings taken by the town at an annual or special town meeting held in
2022 by remote participation by electronic means in accordance with Chapter 92 of the Acts of 2020, as
amended by Chapter 20 of the Acts of 2021, and all actions taken pursuant thereto, are ratified,
validated and confirmed to the same extent as if the said Annual or Special Town Meeting had been held
in full compliance with any applicable general or special law or by-law; and further to authorize the
Select Board to approve amendments to said act before its enactment by the General Court that are
within the scope of the general objectives of the petition; or act in any other manner in relation thereto.

DESCRIPTION: In June 2020,the Legislature temporarily provided express authorization for
representative Town Meetings to be held by remote means due to the COVID-19 pandemic. That
authorization expired in December 16, 2021. Shortly thereafter, but before the Warrant issued, the
discovery of the Omicron COVID-19 variant suggested a potential need for a remote Town Meeting
option. This article would authorize the Select Board to petition the General Court for special legislation
that would confirm the validity of any actions taken at a Town Meeting being held remotely instead of in
person if health and safety conditions continue to warrant a remote meeting. While the Town has
worked with its legislative delegation to renew tMe legislative authorization,the Town is not sure
whether that legislation will be adopted at the tirne of our Town Meeting and this article would provide
an additional opportunity to ensure the validity of actions taken at the 2022 Lexington Annual Town
Meeting and any Special Town Meetings.

DESCRIPTION: This article requests funds for the FY2023 (July 1, 2022 - June 30, 2023) operating budget. The
operating budget includes the school and municipal budgets. The operating budget includes requests for funds to
provide prospective salary increases for employees, including salaries to be negotiated through collective bargaining
negotiations. The budget also includes certain shared expenses.

Programs Enterprise Fund
DESCRIPTION: Under Massachusetts General Laws Chapter 44, Section 53F'/Z, towns may establish Enterprise
Funds for a utility, health care, recreation or transportation operation, with the operation to receive related revenue
and receipts and pay expenses of such operation. This article provides far the appropriation to and expenditure from
three enterprise funds previously established by the Town. The Recreation and Community Programs Fund
includes the operations and programs for the Community Center.
ARTICLE 6 APPROPRIATE FOR SENIOR SERVICES PROGRAM
To see if the Town will vote to appropriate a sum of money for the purpose of conducting a Senior Services
Program, to be spent under the direction of the Town Manager, to authorize the Select Board to establish and amend
rules and regulations for the conduct of the program, and detennine whether the money shall be provided by the tax

DESCRIPTION: In FY2007, the Town established a Senior Services Program that provides more flexibility than the
State program in assisting low-income seniors and disabled residents in reducing their property tax bills. This article
requests funds to continue the program.

Sustainable Action Plan with the Climate Action plan; to determine whether the money shall be provided by the tax

update and implement our community's goals for reaching sustainable objectives including reduction of emissions

extensive, inclusive, and creative outreach.

DESCRIPTION: The purpose of this article is to reduce the marketplace for puppy mill animals by making it
unlawful in the Town of Lexington for a brick-and-mortar pet shop to offer for sale a dog, cat, or rabbit. A person
who only sells animals bred on their residential premises is not to be considered a"pet shop", and would not be
impacted by this bylaw. This bylaw would allow a pet shop to provide space for a state registered, non-profit,
shelter or rescue organization to display the above animals for adoption, as long as the shop receives no fees
associated with sale or display.

To see if the Town will vote to add a new Chapter to the Town's Code of Bylaws requiring the reporting and
disclosure of large building energy use, requiring assessments based on energy use, to set forth the terms and scope
of such reporting requirements, including exemptions or waivers to the same, and further to raise and appropriate a
sum of money to administer the reporting and disclosure of the large building energy use, and determine whether

disclosure of large building energy use and authorize funding to administer the program. The systematic energy

ARTICLE 32 SELECT BOARD TO ACCEPT EASEMENTS
To see if the Town will vote to authorize the Select Board to acquire by purchase, gift, eminent domain or otherwise
accept, easement interests for trails, drainage, sewer,utility or other public purposes, on such terms and conditions
and in a final location or locations as the Select Board may deterinine, or act in any other manner in action relation

To see if the town will vote to authorize the Select Board to petition the Ma�sachusetts General Court for legislation

proceedings taken by the town at an annual or special town meeting held �in 2022 by reinote participation by

DESCRIPTION: In June 2020, the Legislati�re temporarily,provided express authorization for representative Town
Meetings to be held by remote means c�ue'to the C�VID-19 pandemic. That authorization expired in December 16,
2021. Shortly thereafter, but before the Warrant issued;the discovery of the Omicron COVID-19 variant suggested
a potential need for a remote Town Meetin� a,�tion. This article would authorize the Select Board to petition the
General Court for special legi�lation tha� would �onfirm the validity of any actions taken at a Town Meeting being
held remotely instead of in pe,rson if health�and safety conditions continue to warrant a remote meeting. While the
Town has warked with its legi!slative delega�ion to renew the legislative authorization, the Town is not sure whether
that legislation will be adopted� at the time of our Town Meeting and this article would provide an additional
opportunity to ensure the validity af a�tions taken at the 2022 Lexington Annual Town Meeting and any Special
Town Meetings.
ARTICLE 34 ALLOW FOR SELECT BOARD TO CALL REMOTE TOWN MEETING
To see if the town will vote to authorize the Select Board to petition the Massachusetts General Court for legislation

DESCRIPTION: This article would update the Zoning Bylaw to permit open space residential developments, as
defined under the state Housing Choice law, G.L. c. 40A, § lA. Open space residential developments would be
subject to limits on gross floor area and require the preservation of open land in its natural state and the provision of
affordable dwelling units. This amendment to the Zoning Bylaw would also provide incentives to preserve historic
buildings and require site plan review by the Planning Board.
