Application for Reappointment to the Commission on Disability
I would like to continue to serve on the Commission on Disability. As
the only Deaf inember on the Commission, I will continue to advocate
for accessibility for those of us with hearing loss. Prior to the pandemic,
I worked with the library to revise signage denoting the looped room and
was able to get patrons listening devices to borrow. Since the pandemic,
I have advocated for closed captions for Zoom events or CART
(computer-assisted realtime translation) at in-person events. I am active
in the Boston chapter of the Association of Late-Deafened Adults and
the Hearing Loss Association of America as well as the National
Alliance on Mental Illness, and more attention is now being paid to the
intersectionality of Mental Illness and Hearing Loss. I would also like
to continue to serve as a member of the COD/HRC work group.

House Bear Brewing, LLC has supplied all the necessary paperwork to request a Special License to sell Cider
and Mead at the Lexington Farmers' Market for the November 23, 2021 FEASTival Market at the Lexington
Farmers' Market grounds (located at the Practice Field on Worthen Road, between the Lexington High School
field house and the baseball diamond). Ms. Lenihan confu-med the School Comtnittee has no objections and
Ms. Battite confirmed the the Recreation Committee has no objections.

Market Rules & Regulations
The LFM Market Manager is responsible for all activities at the market.
All vendors must comply with the rules as stated.
Market Products
I. Producer Only: The Lexington Farmers' Market only allows farmers and vendors who
grow or produce what they sell.
A. For farmers, this means grown or raised on their own farm.
1. It is expected that all farmers clearly state the location of all properties
where they farm, including leased land. In the case of leased properties,
farmers will also be required to provide contact information for the
property owners. The market may also require copies of lease
agreements for those properties. Leased properties are subject to
inspections or visits, as is any property owned by the farmer (see section
III).
2. Produce must be picked by the grower, a person living in the household,
or employed by the farmer. Special permission may be given to include
items grown or produced by immediate family members (spouse, siblings,
children, parents) if operations are interconnected or cooperative
agreements have been formed. Reselling from supply farms, wholesale
markets, or other sources is not allowed (see exception stated in part C).
B. For food vendors, this means selling something that has been created or
produced by the vendor from other ingredients. Preference is given to vendors
who make physical changes to raw ingredients through cooking, baking, pickling,
etc. and make every reasonable effort to use local fruits, vegetables, grains,
dairy, and other agricultural commodities produced on local farms whenever
possible.
C. Producer-Only Exception: With prior approval of the Market Manager, farmers
are permitted to bring and sell three (3) items that they do not grow or raise
themselves, but are grown/produced on a neighboring local farm. Approved items
must be labeled with additional farm's name and location on market days.
1. Each type of a product is a different item, but multiple flavors/varieties can
be brought for each type. For example, Chevre Goat Cheese in Garlic
and Herbs and Gingered Honey would be one item, but Feta Goat
Cheese would be considered a second item.Additionally, the percentage
of products sold from neighboring, local farms can not exceed 33% of
overall products available at the market.
D. Final product approval will be made by LFM Market Management to ensure
market integrity and producer-only sales practices.

II. Product Approval: You may only bring products listed in your market application which
are approved by the Market Manager and the Lexington Board of Health. If you wish to
bring additional products, you must gain prior approval in advance from the Market
Manager and the Lexington Board of Health.
III. Site Visits: The LFM does site visits to farms and kitchens to get to know our farmers
and vendors; these visits are done to ensure the integrity of products sold at the LFM
and maintain the integrity of the LFM's rules and regulations.All farmers and vendors
are subject to farm/facility inspections or visits. The Market will determine the schedule
of inspections and visits, which may or may not be pre-arranged with the farmer/vendor.
IV. Product Quality: All products should be of top or grade A quality; any seconds may be
offered but must be labeled as such.
V. Vendor Responsibilities: All vendors are responsible for complying with all
requirements and licenses determined by the Town of Lexington, Commonwealth of
Massachusetts, and the Federal Government (i.e. the local Board of Health [BOH],
Mass. Dept of Public Health, USDA, FDA, and potentially others).
VI. Removal of Products: The Market Manager has the right to require that any
farmer/vendor remove a product from the selling display. Cause for removal includes but
is not limited to: improper handling per BOH regulations, failure to include the product in
the farmer/vendor's MarketApplication, failure to obtain appropriate permitting or
licensing, and improper labeling or inadequate signage.
Market Organization
I. Space Allocation: Vendor will be placed in available space at the Market Manager's
discretion.
II. Absences: If a vendor is no longer able to attend the market, he or she must call the
Market Manager as far in advance as possible. There will be no reimbursements for
missed market/cancellations; the only exception is if a farmer/vendor staff member tests
positive for COVID-19 and a replacement can not be found.
III. Vendor Fees: Payment will be due upon acceptance to the market, and fees must be
paid in full by November 16. Failure to meet payment deadlines may result in suspension
or termination from the market.

IV. Opening and Closing: The Market Manager will be onsite starting at 10:00 am.
Farmers/vendors are to be set up and ready for sales with vehicles off the premises by
11:30 am. Farmers/vendors arriving after 11:30 are not allowed to bring vehicles onto the
grass area to unload. No sales are allowed until the opening bell at 12:00 pm when
customers are allowed on premises with no exceptions. All farmers/vendors are
expected to remain open and operational until the end of the market. Farmers/vendors
may not break down their booth before the closing bell.
V. Setup: Farmers/vendors shall provide their own tents, tables, chairs, stakes, and other
equipment. All four corners of tents must ALWAYS be properly anchored to the ground
with stakes to prevent the tents from "rolling" in the wind. Methods of securing a tent
must not create an additional hazard itself: Be aware of tripping hazards, stakes sticking
out of the ground, sharp edges, weights should not be above people's heads, etc.
Farmers/vendors must ensure their physical set-up is safe and hazard-free for all market
participants.
VI. Electricity: The LFM space does not have access to water or electricity for vendor use.
VII. Signage: All farmers/vendors must post prices and display a sign with the name of farm
or business. All signage must be legible and in plain view. Proof of organic certification
must be displayed if labeling produce as "Organic". If the farm is certified organic but
some items sold are not, these items must be labeled clearly.
VIII. Weights and Measures: Farmers/vendors planning to use a scale must have it sealed
and inspected by an official City Dealer of Weights and Measures.Appropriate seals
from other cities will be accepted.
IX. SNAP Coupons: The Supplemental Nutrition Assistance Program (SNAP) is a monthly
benefit that allows recipients to buy nutritious foods. The Lexington Farmers' Market
accepts SNAP, with coupons provided by the LFM. All vendors are required to accept
SNAP coupons for the purchase of SNAP-eligible foods. Reimbursements by the market
will be mailed to you within 7 days after the market completion.
X. WIC/Senior Coupons: The Market Manager does not reimburse WIC, Senior Coupons,
or Mass Farmers' Market Coupons. Please familiarize your staff with the guidelines of
which coupons you can accept.
XI. Food Samples: Vendors sampling foods must have prior permission from the LFM
Market Manager. All food samples must be covered and served according to Board of
Health regulations.

XII. Smoking: Per town regulations, smoking or vaping is not allowed at the market, nor
within 15 feet of the market site.
XIII. Drugs &Alcohol: Farmers and vendors are prohibited from consuming or being under
the influence of drugs or alcohol while at the market. If policy is violated, market
management will take appropriate action which may include notifying business owners,
issuing warnings, or immediately ceasing market sales.
XIV. USDA Recall: In the rare case of a USDA recall, farmers and vendors are required to
cooperate with LFM policy to provide up-to-date information to customers and the
Lexington Board of Health.
XV. Community Supported Agriculture (CSA): CSA pick-ups are allowed at the Lexington
Farmers' Market with prior approval from the Market Manager.
A. CSA market pickups can only contain items pre-approved by the Market Manager
and the Lexington Board of Health as per the farm's market application
B. CSA-only produce must be clearly labeled and stored separately; it may not be
displayed on the table as though available for sale. Separate tables/areas for
CSA customers to select produce are not allowed.
C. CSA producers should have sufficient product quantities for regular farmers
market sales to take place in addition to their CSA program.
D. Per opening bell rules, CSA pick-ups may not take place until the market officially
opens at 2:00 PM. CSA pick-up times must be advertised within market hours.
XVI. Parking: Only farmers/vendors who receive permission from the Market Manager may
park vehicles on the market site. Farmers/vendors are responsible for parking their
vehicles in the designated parking spaces during market hours and maximizing the
limited space available. The Market Manager and volunteers can advise on parking
availability, but it is ultimately the responsibility of the vendors to find parking.
XVII. Trash & Cleanup: Farmers/vendors are responsible for cleaning their tent area and
removing and/or taking home all trash and food refuse at the end of the market.
XVIII. No Hawking:At no time may representatives walk through the market handing out
information or conducting business outside of their designated tent space.
XIX. Challenge Form: The LFM takes any violations of clearly-stated rules and regulations
seriously. If you believe there has been a violation of LFM rules, please request a

Challenge Form from the Market Manager. All challenges will be kept confidential and
will be addressed within 72 hours.
XX. Loss of Vendor Privileges: The LFM retains the right to reassign vendor space at any
time, and to suspend or terminate vendors from market participation for failure to comply
with market rules.
XXI. No Dogs Allowed: No dogs will be allowed inside market space (exception for certified
service dogs that are leashed and kept under control at all times)

LFM WEATHER & PUBLIC SAFETY POLICIES
Inclement Weather:
• Lightning. If there is visible lightning, the Market Manager will make a public
announcement through a loudspeaker to inform market shoppers, farmers and
vendors. Farmers and vendors can choose to leave if they feel unsafe due to the
presence of lightning. However, because of safety reasons, no cars or trucks will be
allowed on the site, as the market will remain open. If available, Lexington Farmers'
Market volunteers will help the farmer/vendor to break down their space and get to
their car or truck off-site.
• Other Weather Conditions. In the event of high winds, heavy rain or other
inclement weather, the Market Manager may make a public announcement through a
loudspeaker to inform market shoppers, farmers and vendors of the impending
weather conditions. LFM staff will also make a best effort to quickly go around the
market and inform farmers and vendors of incoming sudden storms.
• Tents and Shelter. In the event of a severe storm, including wind, rain, and
lightning, farmers and vendors are strongly advised to lower their tents. If they
cannot go to their cars, they should go to the green storage shed at the corner of the
market, which will be open for safe shelter. In rare and extreme weather conditions,
the Market Manager can make the decision to allow farmers and vendors to leave if
they feel unsafe.
• All farmers and vendors are required to use metal stakes in addition to weights to
secure their tents to the ground.
Public Safety Policy (required by the Town of Lexington):
• Public Safety Emergency. The Lexington Police Department, Fire Department or a
designee from the Town Manager's Office may direct shoppers, farmers and vendors
to evacuate the market in the event of weather or a public safety emergency. A
public safety emergency includes, but is not limited to: a tornado warning, a fire in
close proximity to the market, or a large civil disturbance. In the event of an
emergency vendors should shelter in their personal vehicles. When ordered, the
evacuation is mandatory.
• If the public safety emergency requires the closure of the market for the rest of the
day, a Town official will notify the Market Manager as soon as possible who will share
that information with farmers and vendors as soon as possible.

LFM CODE OF CONDUCT
All market participants including farmers, vendors, and customers are expected to work
cooperatively with the Market Manager, LFM volunteers, and farmers/vendors. By agreeing to
participate in the market, all farmers/vendors agree to comply with the following Code of
Conduct:
• Verbal and physical abuse is prohibited.
• Actions that intentionally interfere with another participant's set up, sales, or activities
and any other action that the Market Manager's determines are uncooperative in nature
are prohibited.
Insurance and Accidents: The LFM carries liability insurance that protects the market and
LFM staff. However, it does not protect individual vendors.All vendors must carry their own
Commercial General Liability Coverage Policy with a minimum of$1 million per occurrence and
a $2 million aggregate limit. Additionally, the policy needs to list the Lexington Local Food
Collaborative, Inc. dba Lexington Farmers' Market as an additional insured. Upon acceptance,
your Certificate of Insurance must be mailed to the market manager.
Any accident or injury at the market must be reported immediately to the Market Manager. A
first-aid kit will be available at the Market Manager table for minor issues.
Market Integrity: Farmers/Vendors are expected to uphold the LFM's high standards and
integrity in all aspects of food production, sale, and conduct with customers and market
management. The LFM reserves the right to conduct farm or site visits at any point during the
market season, and farmers/vendors may be required to submit back-up documentation to reply
to management queries regarding products and production.
Violations: The Market Manager and the LFM Board are authorized to issue warnings,
suspensions and/or immediate revocation of market participation to farmers, vendors and other
market participants for failure to comply with any aspect of LFM policies; this may include
suspension by the Lexington Board of Health. A major violation such as committing an unlawful
or violent act, or physical or verbal abuse will result in immediate termination of market
participation. No refunds will be issued for either suspensions for any reason or revocation of
market privileges.

be encouraging the recognition of July 8th as Massachusetts Emancipation Day, also lcnown as Quock Walker
Day. Lexington's Senator Cindy Friedman and Representative Michelle Ciccolo are sponsors of the bill and
ABCL President, Sean Osborne, will be testifying in support. The hearing will be held on Wednesday,
November 10, 2021 and letters of support are due by Friday, November 19, 2021.

Commonwealth's Declaration of Rights rendered slavery unconstitutional. Quock Walker,who was barn to enslaved Black
parents in Massachusetts,was the driving farce behind this ruling. At 28 years old, after being promised his freedom on
multiple occasions,Walker self-emancipated. When his former enslaver found him,Walker sued for his freedom. Following a
jury trial,Walker was found a free man. William Cushing,the chief justice of the Massachusetts Supreme Court,wrote
regarding the Quock Walker case, "...there can be no such thing as perpetual servitude of a rational creature."
This critical decision served as the precedent that ended slavery in the Commonwealth on constitutional grounds and led to
Massachusetts becoming the first state in the nation to abolish slavery. Similar to Patriots Day, Quock Walker Day marks a
seminal moment in the march towards freedom in America. The Lexington Select Board believes this is an important
recognition which demonstrates the Commonwealth's commitment to a11 residents.
In light of Quock Walker's significant place in our history,it is altogether fitting that we should officially mark this
monumental step toward justice each year. Massachusetts Emancipation Day, a.k.a. Quock Wallcer Day will celebrate the
Massachusetts Supreme Court decision of July 8, 1783, effectively ending slavery in Massachusetts.

I move to amend the main motion for Article 12, (Amend Zoning Bylaw Structures in Yards) to
retain the 6-foot height limitation for fences near the front lot line and removing the
consideration of a retaining wall and adjacent fence as a single structure by:
1) Removing the proposed new§135-4.3.1.2.c and the proposed substantive changes to
§135-4.3.1.2.b and adding clarifying language that one fence and/or one retaining wall
is allowed closer to a lot line than six feet each no more than six feet high so that
§135-4.3.1.2.b now reads:
b. One fence and / or one retaining wall not greater than six feet each in height
may be located on or closer to a lot line than six feet; and
and
2) Removing proposed change §135-4.3.1.4
So that the motion now reads:
MOTION:
That the Zoning Bylaw, Chapter 135 of the Code of the Town of Lexington, be amended as
follows, where s�te����is to be removed and underlined text is to be added, except
where otherwise stated below, and further that non-substantive changes to the numbering of this
bylaw be permitted in order that it be in compliance with the numbering format of the Code of
the Town of Lexington:
1. Amend § 135-4.3.1 as follows:
4.3.1 Structures Other than Buildings.
1. The maximum height, in feet, far structures other than buildings may not
exceed the maximum height for buildings as set forth in Table 2.
2. Structures other than buildings may be located in a minimum required front,
rear or side yard provided that the height of the structure is not greater than its
horizontal distance from the lot line, except that:
a. Structures of any height which are required to enable access for disabled
persons mav be located anywhere on a lot;
b. �4 One fence and/or one retainin�wall not greater than six feet each in
height
,
may be located on or closer to a lot line than six feet; and
c. Supporting posts for a fence may extend six inches higher than the top
of a fence.
3. Structures shall not interfere with safe sto�ing sight distance on a street.
4. A sign, pei-�nitted under § 5.2, may be located in a front yard.

swimming pools, but not including paved surfaces such as a driveway, a walk or a patio.

MOTION:
That Chapter 80 of the Code of the Town of Lexington, Noise Control, be amended as follows,
and further that non-substantive changes to the numbering of this bylaw be permitted in order that
it be in compliance with the numbering format of the Code of the Town of Lexington:
1. Add the following definitions to § 80-3:
COMMERCIAL LANDSCAPER
A person or entity that receives compensation to utilize landscape maintenance
equipment on another's property.
LANDSCAPE MAINTENANCE EQUIPMENT
Gas- or electric-powered lawn mowers, hedge triininers, weed whackers, leaf
blowers, and other equipment used in landscaping or lawn care.
2. Replace § 80-4.H with the following:
1. The outdoor use of Landscape Maintenance Equipment by commercial
landscapers shall be limited to the following days and hours:
i. Monday—Friday: 7:00 AM to 6:00 PM
ii. Saturdays: 9:00 AM to 5:00 PM
2. The outdoor use of Landscape Maintenance Equipment by persons other than
commercial landscapers shall be limited to the following hours:
i. Monday—Friday: 7:00 AM to 8:00 PM
ii. Saturdays, Sundays, and Legal Holidays: 9:00 AM to 5:00 PM
3. Landscape construction work shall be governed by §80-4.A, rather than this §
80-4.H.
4. Effective May 22, 2022, the following additional rules shall apply to the use of
all gas-powered leaf blowers in the Town of Lexington:

ii. September 15 —December 30: 7:00 AM to 5:00 PM
5. Effective March 15, 2025, the use of all gas-powered leaf blowers by
commercial landscapers in the Town of Lexington shall be prohibited.
6. Effective March 15, 2026, the use of all gas-powered leaf blowers by residents
on their own property in the Town of Lexington shall be prohibited.
3. Amend § 80-7.B to read as follows where��r-e�-�rtext is to be removed and

Any person who violates any provision of this by-law, or who is the owner of propertv on
which such violation occurs, shall be fined an amount not to exceed$50 per first violation,
$100 far the second violation, and $200 for the third and each subsequent violation.

Fines issued hereunder shall be issued in accordance with Chapter 1, § 1-6 of the General
By-Laws. The imposition of a penalty for any violation shall not excuse the violation or
permit it to continue. Each day that such violation continues shall be considered a separate
offense.
