Public Participation via calling in or using your computer was encouraged. Commissioners Present: Kevin Beuttell, Alex Dohan, Philip Hamilton, Ruth Ladd, David Langseth and Holly Samuels (not present: Duke Bitsko) Associate Members Present: Vinita Bose (not present: Jason Hnatko) Staff Present: Karen Mullins, Conservation Director and Meghan McNamara, Department Assistant 6:30 PM New Business/Pendine Matters Enforcement: Takeda, 500 Shire Way, Wetland and Buffer Zone alteration Mr. John Hart, SMMA, representing Takeda,presented to the Commission. Mr. Hart stated that as part of the recently issued Negative Determination, a condition was included to remove invasive species. The landscape contractor removed vegetation beyond the intended line. This vegetation was primarily invasive species and the site has since been surveyed and the wetland lines flagged. Mr. Dennis Lowry, AECOM, met on site with Ms. Karen Mullins to view the disturbed site. Mr. Lowry informed the Commission that erosion control has been established around the perimeter of the disturbed area, and that root zones are still intact and much of the native wetland soils are still present in places disturbed by machinery. SMMA and AECOM will stabilize the site with a seedmix and hydro mulch and will work toward establishing a replanting plan later this Fall after receiving feedback from the Commission. The property owners, Mr. Robert and Ms. Ellan Siegel, stated that they are not proposing or intending to install a fence around the equipment. A special condition will be added that, if the utility trenching and backfilling will not be completed in one day, erosion control will be installed. This proposal would create an overall reduction of pavement. The applicant is still before the Planning Board and expected to present during the October 6, 2021 meeting. Questions and Comments from the Commission: a) Where is the riverfront area measured from? It appears to be measured from the center of the stream as opposed to the bank. b) The plan shows a 20-foot wide access road around the perimeter of the proposed garage and proposed building. The Fire Department has previously approved a smaller access route for earlier filings. Is that possible here? c) What is the material of the pedestrian path? d) Why is there such a large number of cultivar plantings being proposed? Why is the applicant proposing to put herbaceous species and not woody species next to the wetland? e) What methods were used to assess groundwater elevations? Were the soils highly permeable or tight when the test pits were dug? Did you compare the elevations of the test pit to those of surrounding wetlands? f) Is there a plan to remove invasive species on the bank around the edge of the site? Was the extent of the invasives limited to the edge? Responses from the Representative: a) The riverfront area was not delineated in the field, but rather through aerial imagery. It was digitized onto the plan for safety reasons. b) Have explored all options for the access route; however certain distances need to be accommodated due to the dimensions of the building and fire code. c) Beyond the paved surface the pedestrian path is a stone dust path. It will be relatively compact but still substantially more permeable than any other manmade structure. d) The proposed cultivars are not within the restoration area and only in areas 100 feet away from wetlands. Willing to look at the use of non-cultivars closer to the building and to reference the suggested plant list. The concept was to provide herbaceous material and a selection that has the most durability for areas with invasive plants. Trying to find a balance. e) Test pits were performed a few weeks prior to submittal. The groundwater elevation was lower than what was assumed. Historically, the location is a filled wetland site. The project team has not reviewed the soil logs yet. The elevation of the wetland flag that was located is at 117. The elevation associated with the outfall is a good indicator of the location and that is at 116. f) Will put together a protocol to remove the invasive species that includes a licensed applicator. There is a marsh that surrounds the invasives along the edge. Most are growing on the slope and won't be found within the wet areas. Mr. Langseth is proposing that the Commission engage a consultant to act on behalf of the Commission. Mr. Langseth raised his concern that it is hard to justify a groundwater elevation that is lower than that of the surrounding wetlands. Ms. Ladd requested an updated plan to include the test pit data and locations. On a motion by Ms. Ladd and seconded by Mr. Beuttell, the Commission voted 6-0 by roll call vote to continue the hearing to the October 25, 2021 meeting at the applicant's request. These will be removed due to proximity to the construction site. — Yes, all debris will be removed. Including the brick in the rear area. The applicant has not received a favorable engineering report. This may be due to a misinterpretation of the peak volume for the 100-year storm event. Mr. Novak will follow up with Lexington Engineering. Questions and Comments from the Commission: — There is no contour line on the surface of the driveway. Are there any grade changes? — Connecting Wetland Flags 6 and 13 better reflects the extent of wetlands. Won't impact the project because 6 and 13 are the controlling flags. — Is the applicant proposing Feno markers along the lot line? — It is normal practice to have a restoration plan for the 25-foot buffer zone and one is needed for the conservation land that had been converted to lawn. Ms. Mullins stated that a formal request has not yet been submitted but is proposing an expense from the Nature Trust Fund for an estimated $4,000.00. This will be added to the next scheduled meeting to review a formal quote and officially vote on the expenditure. Commission to discuss feedback on Willard's Woods Ecological Land Management Plan draft The Commission agreed to continue this until a later meeting to discuss. A public hearing will also be held in November to formally discuss the feedback. Schedule site visits for 10/12/2021 meeting The site visits will take place on Thursday, October 7, 2021 at 5:00 PM Approve minutes: 8/30/2021 and 9/13/2021 This will be continued to the next meeting. Reports: Bike Advisory, Community Gardens, Community Preservation Committee, Greenway Corridor Committee, Land Acquisition, Land Management, Land Steward Directors, and Tree Committee, HIP Working Group Mr. Hamilton stated that he was approached by a resident and asked if the Conservation Commission would endorse the Mt. Independence Historic District Movement. Mr. Hamilton and Commission members agreed that the Commission should not endorse this movement as it could give the appearance of an unfair bias to future applicants. Ms. Samuels stated that she has been asked to perform cut stump herbicide treatment at Shaker Glen Conservation Area during an October Stewardship Saturday event. Ms. Samuels will be using Aqua-Neat, a wetland-approved Glyphosate product. On a motion by Mr. Langseth and seconded by Mr. Beuttell, the Commission voted 5-0 by roll call vote to authorize Ms. Holly Samuels to apply the appropriate herbicide at Shaker Glen Conservation Area in October.
