HomeMy WebLinkAbout2015-11-04-PB-min PLANNING BOARD MINUTES MEETING OF NOVEMBER 4, 2015 A meeting of the Lexington Planning Board, held in the Selectmen’s Meeting Room, was called to order 7:02 p.m. by Chair Nancy Corcoran-Ronchetti, with members, Tim Dunn, Charles Hornig, Richard Canale, and planning staff Aaron Henry, David Kucharsky, and Lori Kaufman present. Ginna Johnson was absent. *********************************STAFF REPORTS***************************** General updates: Hard copies on recent FAR comments are on the table for the Board’s review. The Board took positions on Articles 3, 5, and 8c at the last meeting. ***********************DEVELOPMENT ADMINISTRATION********************** Performance Guarantee Release: Victory Garden Way ROW Complete: The construction of the ways and installation of municipal services for the plan entitled “91-93 Hancock Street Definitive Subdivision Plan Set” dated December 21, 2009, revised through March 11, 2010, which was approved by the Lexington Planning Board, May 12, 2010, and recorded in the Middlesex South Registry of Deeds as Plan 462 of 2010, has been fully and satisfactorily completed by the applicant in accordance with the Board’s rules and regulations to serve all lots in the development. On a motion duly made and seconded, it was voted, 4-0, in consideration of the completion of the construction and installation, the Planning Board releases it interest in the performance guarantee secured by a deposit of money in the amount of $93,849.00 On a motion duly made and seconded it was voted, 4-0, to authorize the Planning Director to sign on behalf of the Planning Board the “Certificate of Completion and Release of Municipal Interest in Performance Security.” CONTINUED PUBLIC HEARING 11 Suzanne Road, Special Permit Modification: The continued public hearing was called to order at 7:14 p.m. by Chair Nancy Corcoran- Ronchetti. There were two people in the audience. The applicants Mr. and Mrs. Ben Solky were present. Page 2 Minutes for the Meeting of November 4, 2015 The applicant will need a new deed, show monuments were installed and provide as built plans to the Planning Department. After the 20 day appeal period all other administrative items will need to be dealt with. On a motion duly made and seconded, it was voted, 4-0, to close the public hearing at 7:20 p.m. On a motion duly made and seconded, it was voted, 4-0, to grant the modification to the special permit for 11 Suzanne Road with one change to the draft decision to special condition four replacing the word “supersedes” with “modifies.” ******2016 ANNUAL TOWN MEETING WARRANT ARTICLE DISCUSSION*********** Large Service Uses This amendment to the bylaw is in response to the Bank Moratorium approved at the 2015 Annual Town Meeting. This would only impact Table 1, line H for “Personal, Business or General Service Uses” in the CB District. The Board wants more data on the numbers. This should be brought to a broader audience once the Board agrees. Staff sent this to small audience to get feedback before meeting with the Center th Committee on the 12. Staff should discuss ATM uses with the Center Committee at the meeting on Thursday. Neighborhood Conservation Districts Mr. Canale will have a clearer proposal ready for the next meeting but asked the Board if they had any changes they wanted to make. Things need to be streamlined and made less complex before the public hearings and concerns were expressed whether this could be done in time. Height modifications: There was concern about deleting the line for “100 feet and above” for frontage from the Building Department Staff. Accessory Apartments: There was concern that the principle unit should be owner occupied. Scenic Road Bylaw The Board will address this proposed amendment at the 2017 Annual Town Meeting. Floor Area Ratio (FAR) The Board discussed whether or not to pursue the FAR amendment for the 2016 Annual Town Meeting. Minutes for the Meeting of November 4, 2015 Page 3 A member of the audience said the Board needs to look at the overall policy to make sure residents are not hurt by this change and should look at the town as a whole. A proposal will need to be forwarded with numbers in two weeks so the Board can make a decision. Two Family Dwellings This proposed amendment should not move forward unless there is agreement on a FAR number. Concerns were expressed on how to prevent losing a two family home to a one family home. Recommendations are due next month and a final overall report will be submitted to the Planning Board. Planned Development Districts There needs to be more clarification on the purpose of Commercial Developments (CD) and this is an attempt to simplify the process. Technical Changes This includes reformatting, headings, definitions, and tying frontage and access together. This change was put in when the bylaw was rewritten and Board Members want more information for understanding before considering this change. Government Civic Uses This article is now back on the list to be brought forward to the 2016 Annual Town Meeting? This will be the same article as last year and believe there will be more support at Town Meeting. The chair will follow up with the Board of Selectmen to confirm if they want this article to be brought forward. ************************************MINUTES********************************* On a motion duly made and seconded, it was voted, 4-0, to accept the minutes for October 7 as submitted. ************* UPCOMING MEETINGS AND ANTICIPATED SCHEDULE************** The November 18 agenda will include (RD 6) Brookhaven and 11 Stratham Road for a street determination. There will be meetings on December 9and 16 at 7:00 pm, December 16 will be the last meeting of the year and will include the vote for warrant articles for the 2016 Annual Town Meeting. Mr. Dunn will not be available December 16. Page 4 Minutes for the Meeting of November 4, 2015 There are 34 applicants for the planning position and staff is culling it down. Staff will make the first cut the second round staff would like to include a Planning Board Member. .
