Board Members Present: Chairwoman Jeanne Krieger, Edward D. McCarthy, Leo P.
McSweeney, David G. Williams and Associate Member Ralph D. Clifford

The petitioner submitted the following information with the applications: nature and
justification of request; topographic plan; updated plot plan; elevations and floor plans.
Prior to the hearing, the petitions and supporting data were reviewed by the Building
Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the
Zoning Administrator, the Planning Director, Economic Development; the Historic
District Commission Clerk, Historical Commission and the Zoning Administrator.
Comments were received from the Building Commissioner, the Planning Director, the
Historical Commission Clerk and the Zoning Administrator.
The petitioner is requesting a VARIANCE in accordance with the Zoning By-Law
(Chapter 135 of the Code of Lexington) section 135-9.2.2 to allow a side yard setback
of 8.7 ft. instead of the 10 ft. allowed and a SPECIAL PERMIT in accordance with the
Zoning By-Law (Chapter 135 of the Code of Lexington) section 135-9.4.2 to allow
modification (extension) of a non conforming structure.
The Chairwoman opened the hearing at 7:36 pm by reading the legal notices and
described information received from the petitioner.
Contractor KT Huang presented the petition for the owner of the property, Satish
Chitnis.
The applicant seeks to remove the existing front porch and stairs and rebuild a larger
covered front porch and stairs and construct a 2.5 story 12 ft. by 38 ft. addition to the
rear of the house.
A Board members had questions regarding the setbacks and asked for clarification of
the front setback.
The Chairwoman asked when the house is complete what will the square footage be.
(Currently is approximately 1,300 sq.ft. they will be adding about 900 more sq. ft.)
A Board member asked if the front porch is going to be expanded. (Yes)
There were no questions from the audience.
No one spoke in favor or in opposition to the petition.
The Chairwoman closed the hearing.
A Board member requested the Variance and Special Permit be voted separately.

On a motion by Leo P. McSweeney and seconded by David Williams, the Board voted
5-0 to grant the special permit in accordance with the Zoning By-Law (Chapter 135 of
the Code of Lexington) section 135-9.4.2 to allow modification (extension) of a non
conforming structure.
On a motion by Leo P. McSweeney and seconded by David Williams, the Board voted
4-1, with Ralph Clifford voting in opposition, to approve the VARIANCE in accordance
with the Zoning By-Law (Chapter 135 of the Code of Lexington) section 135-9.2.2 to
allow a side yard setback of 8.7 ft. instead of the 10 ft. side yard setback allowed.

The Chairwoman read a letter from Attorney Edmund Grant requesting a
postponement of the hearing for 0 Madison Avenue and 12 Crescent Hill Avenue from
July 23, 2015 to August 27, 2015. They are requesting the postponement in order that
the applicants may hold a meeting to meet with abutters and neighbors and answer
questions that have been raised. That meeting will take place July 30, 2015 at 7:00
pm.
On a motion by Leo P. McSweeney and seconded by Ralph D. Clifford, the Board
voted 5-0 to postpone the hearing until August 27, 2015.
