MINUTES for:
BOARD OF HEALTH MEETING
Wednesday, October 15, 2014, 7:00 P.M.

Board of Health Members in Attendance:

1.) Minutes of September 17, 2014 accepted with corrections
2.) Community Health
a.) CHNA grant update – not addressed due to time constraints
b.) MAPC tobacco grant update – not addressed due to time constraints
c.) Flu Clinic Schedule 2014 – Next Flu Clinic will be held October 25, 2014 at the Clark Middle School
d.) Community Health and Infectious Disease Report – presented but not addressed due to time
constraints
3.) Environmental Health
a.) Food Inspection program
1.) Royal India Bistro – Jatinda Singh and Lisa Berger reported the results for the recent
inspection. There were a few minor violations; food items not covered, pan on top of shelf not covered, trash
barrel in bathroom not covered. Lisa reported that training has continued. Jatinda will continue with training
schedules and cleaning schedules. Because there has been such success with this program, S. MacKenzie
motioned and D. Geller seconded that they could skip coming to the BOH meeting next month (November) and
return in December.
2.) Let’s Tart – Residential Kitchen Permit - Emmanuelle De’Pollier, Owner met with the BOH to get
approval for a Residential Kitchen Permit. She answered questions from the BOH regarding cleaning and
sanitizing. She explained that her customers would come to pick up the product(s) and in rare cases she may
deliver.
b.) State Sanitary Code Case Review
1.) 267 Waltham Street – Mr. Cody told the BOH about the procedure used during the
“emergency condemnation of this house. The resident is now in a “Safe House”. The Town hired 24 Trauma to
clean up the home (a lien has been put on the property for the fee for this cleaning). The next step will be to
find out what it will take to get water and heat back on. And then to get the resident back home if he is stable
enough to move back.
c.) Medical Marijuana update - Ethan Handwerker spoke with the BOH regarding a delivery system
even if there is no facility in town. Would there be a permit required for the person making those deliveries?
How is that done without compromising the HIPPA laws? Questions arose regarding a Dispensary Agent
Permit – would that be a State Permit or a Town Permit? Should it be handled like pharmacies that deliver
drugs?
d.) Tobacco Regulation update – Carl Valente has asked Mr. Cody to attend a Board of Selectmen
meeting to speak with them regarding terminating the town bylaws regarding Tobacco Regulations.
e) Vector Control
1.) Rodent Survey PIR (Program Improvement Request). Mr. Cody is asking for funds to
conduct a study on how to handle the rodent issues in Lexington.
f) rDNA
1.) Annual Inspection Report – Due to time constraints this item is postponed to the next
meeting.
4.) Emergency Preparedness – There has been activity regarding Ebola. CDC is not keeping up-to-date with
what is going on. There are concerns with confusion about flu and Ebola symptoms. There is also confusion
about Enterovirus and Ebola symptoms.
