CONSERVATION COMMISSION
MINUTES
Monday, August 18, 2014
6:30 P.M.

Chair Joyce Miller opened the meeting at 6:35 pm in the Parker Room of the Town Offices
Building.
Commissioners Present: Joyce Miller, Duke Bitsko, Phil Hamilton and Dick Wolk
Commissioners Absent: David Langseth
Others Present: Karen Mullins, Conservation Administrator and Michelle Morelli, Community
Development Department Assistant
PENDING MATTERS
6:37 pm Plan change approval: 17 Bryant Road, DEP# 201-937, BL 896
Ms. Mullins explained the plan change to re-locate the wall for aesthetic
purposes. The wall will be over 50’ away from the wetlands at its closest point.
Monuments will be installed along the 50-foot buffer to demarcate the do not
disturb boundary as well as native plantings within the 50-foot buffer.
Motion made and seconded to approve the plan change as described, 5-0 in favor.
6:39 pm Plan change approval: 2 Brookside Ave (formerly 520 Waltham St), DEP# 201-
924, BL 884
Ms. Mullins described the proposed plan change to construct a paver patio
instead of a previously approved deck within the 200-foot Riverfront Area. All
details were submitted by the applicant.
Motion made and seconded to approve the plan change as described, 5-0 in favor.
6:40 pm Discussion of plan change for 36 Sanderson Road, DEP# 201-898, BL 857
Mr. Walter Beebe-Center was present for this discussion. Ms. Miller read the
engineering report which stated, “The project has been modified in a minor way
that does not affect our previous comments.” The proposed plan change includes
reducing the footprint of the previously approved addition and it has been
relocated outside of the 50-foot buffer zone.
Motion made and seconded to approve the plan change as described, 5-0 in favor
6:42 pm Compliance discussion and plan change approval: 2 Diamond Road (19 Grove
Street), DEP# 201-900, BL 859
Rich Kirby, LEC Environmental Consultants and Mike Novak, Meridian
Associates were both present for this discussion. The discussion included
changes that were made to the plan that were implemented without prior
authorization. Mr. Kirby updated the Commission on the plantings in the
wetland restoration area. Mr. Novak gave an explanation of the deviations from
the original approved plan and as-built.
Mr. Hamilton asked if the changes came in front of the Commission for approval.
Mr. Wolk asked how the applicant capped the pipes that are in-letting to the
wetland drain. The applicant used a cap/sleeve. The Commission questioned the
mowing of the area in which the restoration took place. Gregory Matteosian,
homeowner, commented on the addition of 20 trees and 64 plants. Mr.
Matteosian stated the outlet pipe from the wetland drain crosses under the
driveway and reconnects into the catch basin. Mr. Wolk suggested collecting
factual data via a snake. Mr. Novak will submit documentation for mitigation.
Motion made and seconded for the request of an Amendment to the Order of
Conditions, 5-0 in favor.
7:19 pm Cont. Hearing – Lot 186E & Oakmount Circle, NOI
DEP# 201-939, BL 898
Applicant: Merek Franklin, Copley Design
Construction of a single-family dwelling with underground utilities and paving of
a portion of Oakmount Circle within the 100-foot Buffer Zone to Bordering
Vegetated Wetland of Granny Pond at Lot 186E and a portion of the right-of-way
of Oakmount Circle
Present for the Applicant: Dan Orwig, Orwig Associates and Merek Franklin,
Applicant
Mr. Orwig presented the revised plan including one tree to be removed, buffer
plantings, and revised drainage calculations. The retaining walls will be
designed by a structural engineer.
Comments from the Commission as follows:
Ms. Miller read the engineering report which stated, “The latest revision provides
infiltration structures to handle the runoff from the new proposed paved roadway.
The calculations appear to be correct. No revisions suggested by Engineering.
Final recommended condition is that a professional engineer be retained to
prepare as-built drawings as the site work progresses. Changes noted as the work
progresses must be brought to the attention of the commission or designee.
Contractor must provide runoff control during construction.”
Jeff Kwass of 4 Oakmount Circle asked if the road would widen due to the
Planning Board decision. The road will be widened by one foot, causing removal
of one tree.

7:27 pm Cont. Hearing – 24 Lincoln Street, NOI
DEP# 201-948, BL 906
Applicant: Josiah Willard Hayden Recreation Centre, Inc.
Reconstruction and improvement of an existing parking lot, access driveway and
stormwater management system within the 100-foot Buffer Zone to Bordering
Vegetated Wetland
Present for the Applicant: Rich Kirby, LEC Environmental Consultants, Mike
Novak, Meridian Associates, and Gary Larson, Landscape Architect
Mr. Kirby explained the revised plan and modification to the operations and
maintenance plan.
Comments from the Commission as follows:
Mr. Bitsko asked for ½ size plan sets for submittal and commented on the
thoroughness of the operations and maintenance plan.
Motion made and seconded to close the hearing to, 5-0 in favor.
Motion made and seconded to issue an Order of Conditions for 24 Lincoln Street,
DEP# 201-948, BL 906, 5-0 in favor.
7:34 pm Cont. Hearing – 40 Ingleside Road, NOI
DEP# 201-947, BL 905
Applicant: Joseph Simon
Construction of a garage addition and expansion of an existing driveway within
the 200-foot Riverfront Area
Present for the Applicant: Rich Kirby, LEC Environmental Consultants
Mr. Kirby explained the revised plan and updated operations and maintenance
plan.
Comments from the Commission as follows:
Mr. Bitsko suggested use of the wording for sediment removal from the
operations and maintenance plan submitted for 24 Lincoln Street.
Motion made and seconded to close the hearing, 5-0 in favor.
7:43 pm Cont. Hearing – 66 Munroe Road, NOI
DEP# 201-946, BL 904
Applicant: Ying Chen
Raze and rebuild a single-family dwelling and paved driveway within the 100-
foot Buffer Zone to Bordering Vegetated Wetland
Present for the Applicant: Rich Kirby, LEC Environmental Consultants and Ying
Chen, Homeowner
Mr. Kirby presented the revised plan and explained the proposed work versus the
existing conditions. The shed will be removed from the 25-foot buffer zone.
Comments from the Commission as follows:
Ms. Miller read the additional information needed from the previous hearing.
Mr. Wolk asked the basement floor elevation and estimated seasonal high
groundwater level. Mr. Kirby replied that the basement floor is 2 feet above the
seasonal high groundwater level. Ms. Miller read the engineering report which
states, “This plan was modified to move the proposed construction away from the
sewer easement. It appears that the modification is sufficient to protect the
easement and the pipe. A small amount of grading takes place on the easement
and can be permitted. The revisions do not affect the drainage calculations. Ms.
Miller asked if off-site mitigation was investigated. Mr. Kirby replied that an
extensive restoration is being done in the area.

8:01 pm Cont. Hearing – 207 East Street, NOI

Applicant: Baoxing Zhu
Construction of two sunrooms, a deck and stairs within the 100-foot Buffer Zone
Present for the Applicant: Mary Trudeau, Wetland Scientist
Ms. Trudeau explained the revised plan and soil test pit data. The bounds
markers are proposed for installation, the shed will be relocated outside of the 25-
foot buffer zone, and an operations and maintenance plan submitted.
Comments from the Commission as follows:
Ms. Mullins commented a compost filter mitt is typically used for an erosion
control. Mr. Bitsko stated that straw wattles are okay for the scope of work
proposed.
Motion made and seconded to close the hearing, 5-0 in favor.
8:14 pm Motion made and seconded to issue a Certificate of Compliance for 361 North
Emerson Road, DEP# 201-905, BL 865, 5-0 in favor.
Motion made and seconded to issue a Certificate of Compliance for 123 Maple
Street, DEP# 201-889, BL 848, 5-0 in favor.
The Commission postponed issuing a Certificate of Compliance for 9 Brigham
Road, DEP# 201-815, BL 773.
8:21 pm Reports: Bike Advisory, Community Preservation Committee, Land Steward
Directors, Housing Partnership, Tree Committee, Land Management, Land
Acquisition, etc.
Ms. Mullins suggested that the Commissioners start thinking about potential
budget items for the fall budget session.
The Commission postponed approving the minutes from July 31, 2014.
