CONSERVATION COMMISSION
MINUTES
Tuesday, July 1, 2014
6:30 P.M.
Parker Room, Town Office Building

Chair Joyce Miller opened the meeting at 6:40 pm in the Parker Room of the Town Office
Building.
Commissioners Present: Joyce Miller (arrived at 6:39 pm), David Langseth, Dick Wolk (arrived
at 6:39 pm), Jane Warren and Duke Bitsko
Commissioners Absent: Stew Kennedy and Phil Hamilton
Others Present: Michelle Morelli, Community Development Department Assistant
PENDING MATTERS
6:40 pm Plan change: 149 Adams Street, DEP# 201-922, BL 882, underground propane
tank installation
Steve Cavallo, Lexington Development was present for this discussion. He gave
a description of digging 5’ into the 100’ wetland buffer zone in order to install an
underground propane tank. Mr. Cavallo explained two options for locations of
the propane tank. Option #1 would require the least amount of trenching and a
fill port will be 6” above grade for a truck hose hook up. Mr. Langseth asked if
erosion controls were proposed. Mr. Cavallo replied there are existing erosion
controls on site. Mr. Langseth commented the stockpiling be covered or erosion
control placed in the area of work.
Motion made and seconded to approve the plan change as described on the plan
with option #1, 5-0 in favor.
6:46 pm Update on non-compliance and extension of Order of Conditions: 9 Tufts Road,
DEP# 201-835, BL 793
Mr. Langseth commented the infiltrator unit should either be re-constructed to its
original capacity or re-located to the front yard. Mr. Langseth stated that
performance standards would not be met if the system is left in its existing
location and the non-conforming portions of the project previously required
mitigation. Mr. Langseth suggested submittal of a detailed analysis for the
system in order to support it functioning properly. The Commission discussed
the need for an independent observer. The applicant commented on the design
change due to conditions in the field. Mr. Wolk asked for a clarification on the
runoff being infiltrated. Mr. Langseth stated there was additional capacity that
was reflected in the original design. The applicant will come back in front of the
Commission at a later date with a proposal for additional chambers.
7:18 pm Motion made and seconded to issue a Certificate of Compliance for 10 Vaille
Avenue, DEP# 201-864, BL 822, pending a site visit by the administrator, 5-0 in
favor.
7:19 pm Motion made and seconded to approve the minutes from June 10, 2014, 5-0 in
favor.
Motion made and seconded to approve the minutes from June 17, 2014 with
minor edits, 5-0 in favor.
7:20 pm Meeting – 456 Concord Avenue, RDA

Applicant: Gunish Chugani
Installation of a garage wall and landscaping within the 100-foot Buffer Zone
Present for the Applicant: Gunish Chugani, Applicant
Mr. Chugani proposed construction of two walls on the front and back of the
carport and native plantings which are listed on the plan. There are no trees
proposed for removal, only trimming will occur.
Comments from the Commission as follows:
Ms. Miller asked if a foundation would be dug. Mr. Chugani explained the
construction of the walls are remaining within the footprint of the existing
carport. A trench will be dug within the 50’ buffer zone. Ms. Warren stated that
western
bamboo is invasive and suggested a different native plant for the
arborvitae as well
. The Commission discussed the wetland line. Mr. Langseth
asked if an erosion control was proposed for stockpiling of soil. Mr. Bitsko
asked if the trench drain was taking roof runoff. The Commission discussed the
trench drain day-lighting to wetland, but it is not shown on the plan where the
runoff comes from. The pipe is also not shown on the plan. Mr. Langseth
commented that some erosion control should be placed at end of pipe. Mr. Wolk
stated changing the plantings as suggested and erosion control measures during
construction of the trench.
Motion made and seconded to continue the meeting to July 15, 2014 at 7:00 pm
at the request of the applicant, 5-0 in favor.
7:35 pm Hearing – 425 & 509 Woburn Street, NOI
DEP# 201-944, BL 902
Applicant: Brian P. Kelley
Construction of an access driveway and parking within the 100-foot Buffer Zone
to Bordering Vegetated Wetland
Present for the Applicant: Rich Kirby, LEC Environmental Consultants, Mike
Novak and Rick Waitt, Meridian Associates and Brian P. Kelley, Applicant
Mr. Kirby gave a description of the site and proposed the teardown and
construction of a condominium. The site borders an intermittent stream and part
of the access and parking is within the 100’ buffer zone. Area drains are directed
to Cultec chambers. The roof runoff goes directly to infiltration systems. An
addendum plan was submitted before the meeting for construction of a sidewalk,
which extends to the south side of Woburn Street and near Peachtree Road.
Comments from the Commission as follows:
Mr. Langseth asked where the stream crossing is shown on the plan. The
wetland boundary intercepts a concrete headwall, which contains two culverts
that extend beneath it. Culvert inverts need to be shown on the plan or addition
of a note of two culverts on the plan. Mr. Langseth asked about incorporating
stormwater management for existing roadway into the system. Mr. Bitsko stated
the snow storage area needs to be designated on plan. Mr. Bitsko commented
that the operations and maintenance plan needs to utilize the words, “shall not” in
reference to the use of salt and chemicals.
Motion made and seconded to continue the hearing to July 15, 2014 at 7:00 pm at
the request of the applicant, 5-0 in favor.

DEP# 201-939, BL 898
Applicant: Merek Franklin, Copley Design
Construction of a single-family dwelling with underground utilities and paving of
a portion of Oakmount Circle within the 100-foot Buffer Zone to Bordering
Vegetated Wetland
Motion made and seconded to continue the hearing to July 15, 2014 at 7:00 pm at
the request of the applicant, 5-0 in favor.
