CONSERVATION COMMISSION
MINUTES
Tuesday, May 6, 2014
6:30 P.M.

Chair Joyce Miller opened the meeting at 6:33 pm in the Parker Room of the Town Office
Building.
Commissioners Present: Joyce Miller, Phil Hamilton, Stew Kennedy (arrived at 6:33 pm), Dick
Wolk, and Duke Bitsko
Commissioners Absent: David Langseth and Jane Warren
Others Present: Karen Mullins, Conservation Administrator and Michelle Morelli, Community
Development Department Assistant
PENDING MATTERS
6:33 pm Plan changes: 9 Vine Brook Road, DEP# 201-890, BL 849
Ian Rubin, Markey and Rubin, Inc. presented the plan changes at 9 Vine Brook
Road. Mr. Rubin described the eco-stone paver patio with a fire pit and retaining
wall. Mr. Rubin also discussed native shrub and tree plantings in the area.
Mr. Hamilton asked Mr. Rubin to point out the location of the 25-foot Buffer
Zone and Mr. Rubin stated that all work will occur within the 50-foot Buffer
Zone. Ms. Miller asked for submittal of runoff calculations and paver details.
Mr. Wolk asked for a plan showing the original approved project and the plan
changes. Mr. Hamilton commented that the plan changes need to be submitted to
the Commission as an Amendment to the Order of Conditions. Mr. Kennedy
agrees with Mr. Hamilton. Mr. Bitsko asked for more information regarding the
drainage calculations with the inclusion of a summary table for the original
calculations and addition of the plan changes.
6:44 pm Compliance order: 20 Banks Avenue, DEP# 201-858, BL 816
Steve Lawrenson, Contractor and Ian Rubin, Markey and Rubin, Inc. were
present for this discussion. Mr. Kennedy asked if the pumping of water on
neighboring properties had ceased.
Motion made and seconded to approve the plan change to add 7.5 inches of
concrete to the basement floor elevation, 5-0 in favor.
6:55 pm Wetlands restoration plan: 442 Marrett Road
Ms. Mullins gave a brief update stating the property owner engaged Rich Kirby
to develop a restoration plan to be implemented. The Commission postponed the
restoration plan proposal until May 20, 2014.
6:56 pm Motion made and seconded to issue an Order of Conditions 200 Hanscom Road,
DEP# 201-936, 4-0 in favor.
6:57 pm Motion made and seconded to issue an Order of Conditions 8 Holton Road,
DEP# 201-935, BL 895, 4-0 in favor.
Motion made and seconded to issue a Certificate of Compliance for L.G.
Hanscom Field, DEP# 201-751, 5-0 in favor.
6:58 pm Reports: Bike Advisory, Community Preservation Committee, Land Steward
Directors, Housing Partnership, Tree Committee, Land Management, Land
Acquisition, etc.
Ms. Mullins gave a reported to the Commission that the Dunback Meadow
community garden site needs a policy developed for fill being brought in as well
as compost to the plots. The Commission will set up a site visit.

Ms. Mullins reported that on June 10 there will be a joint Conservation
Commission and stewards meeting.
7:02 pm Motion made and seconded to approve the minutes from April 22, 2014 with a
minor edit, 5-0 in favor.
7: 05 pm Meeting – Route 2A, Marrett Road, RDA
DET# 14-04
Applicant: MassDOT – Highway Division
Roadway maintenance resurfacing work within the 100-foot Buffer Zone
Present for the Applicant: Renata Welch, MassDOT - Highway Division,
District 4
Ms. Welch proposed roadway work within the right-of-way from Spring Street to
Wilson Road. Sidewalks and handicap ramps will be improved in select
locations.
Comments from the Commission as follows:
Mr. Kennedy asked if the Town Engineer had reviewed the project. Ms. Mullins
replied that John Livsey, Town Engineer, reviewed the proposed project with
MassDOT before filing. Mr. Bitsko asked if the mulch tube will be
biodegradable. Ms. Welch stated that it will be removed after the work is
completed and silt sacks will be installed for sediment control.
Motion made and seconded to issue a negative determination of applicability
with conditions as stated, 5-0 in favor.
7:13 pm Meeting – 11 Bellflower Street, RDA
DET# 14-03
Applicant: Eric & Tulin Fuselier
Site grading and removal of trees within the 100-foot Buffer Zone
Present for the Applicant: Eric and Tulin Fuselier
Mr. Fuselier proposed the expansion of the back yard, construction of a tiered
retaining wall and removal of three trees.
Comments from the Commission as follows:
Mr. Kennedy asked if all of the work was to occur outside the 50-foot Buffer
Zone. Mr. Bitsko asked if the Commission was approving the wetland line.
Connie Dugan of 12 Bellflower Street commented that there are water issues in
the area. Ms. Dugan asked if a pipe would be necessary to direct the water to the
culvert.
Diane Bigelow of 15 Bellflower Street raised concerns of water in the area.
Motion made and seconded to issue a negative determination of applicability
with conditions as stated, 5-0 in favor.
7:27 pm Meeting – 3 Crescent Road, RDA
DET# 14-02
Applicant: Heather Yu
Installation of a fence and removal of a tree within the 100-foot Buffer Zone
Present for the Applicant: Heather Yu, Homeowner
Ms. Yu proposed the removal of a tree and installation of a fence at 3 Crescent
Road.
Comments from the Commission as follows:
Mr. Bitsko asked if there was vegetation in the area of the pond. Ms. Yu stated
that lawn accounts for the area to the pond. Mr. Bitsko explained how the
Commission views land area and vegetation according to the regulations. Mr.
Hamilton asked the Commission if the fence would lessen the intrusions to the
wetland. The Commission discussed the close proximity of the proposed fence
to the pond.
Motion made and seconded to continue the meeting to May 20, 2014 at 7:00 pm
at the request of the applicant, 5-0 in favor.
7:53 pm Cont. Hearing - 85 Reed Street, NOI
DEP# 201-925, BL 885
Applicant: Brian Powderly
Raze and rebuild a single-family dwelling
Motion made and seconded to continue the hearing to May 20, 2014 at 7:00 pm
at the request of the applicant, 5-0 in favor.
7:54 pm Cont. Hearing - 79 Maple Street, NOI
DEP# 201-921, BL 881
Applicant: Ronald Smith
Raze a single-family dwelling and driveway and construct a new single-family
dwelling, deck, driveway, rooftop infiltration, associated grading and utilities
within the 100-foot Buffer Zone and 200-foot Riverfront Area
Motion made and seconded to continue the hearing to May 20, 2014 at 7:00 pm
at the request of the applicant, 5-0 in favor.
