CONSERVATION COMMISSION
MINUTES
Tuesday, April 8, 2014
6:30 P.M.

Chair Joyce Miller opened the meeting at 6:32 pm in the Parker Room of the Town Office
Building.
Commissioners Present: Joyce Miller, Phil Hamilton, Stew Kennedy, David Langseth (arrived at
6:33 pm), Duke Bitsko and Jane Warren
Commissioners Absent: Dick Wolk
Others Present: Karen Mullins, Conservation Administrator and Michelle Tassi, Community
Development Department Assistant
PENDING MATTERS
6:32 pm Conservation Restriction: Shire
Peter Corbett, Attorney for Shire, Carmine Tedesco and Michael Holland, Shire
were present for this discussion. Mr. Corbett explained the status and
outstanding issues regarding future installation of utilities.
Motion made and seconded to approve reserved rights to maintain the right to
install utilities within the gravel access road, 6-0 in favor.
6:42 pm Plan change: 62 Grassland Street, DEP# 201-901, BL 860
Rich Kirby, LEC Environmental, Janice Brown, Homeowner/applicant, and Al
Gala, Gala Simon Associates, Inc. were present. Mr. Kirby explained the
proposed plan change to shift the walkway 1.5 feet away from the house and
increase the width of the walkway by 2.5-3 feet.
Mr. Bitsko asked if permeable paver details were submitted. Mr. Kirby replied
that they were previously submitted with the original filing.
Motion made and seconded to approve the plan change at 62 Grassland Street,
6-0 in favor.
6:50 pm Plan change: Whipple Hill pond outlet bridge, DEP# 201-899, BL 858
Don Grant, Conservation steward, presented the plan change for the revised
boardwalk crossing. Mr. Grant described the changes and dimensions for the
boardwalk crossing.
Mr. Langseth commented that the bridge and boardwalk at the pond outlet is
needed in the area and more sensible than stepping stones.
Motion made and seconded to approve the plan changes as described at Whipple
Hill pond outlet bridge, 6-0 in favor.
6:55 pm Motion made and seconded to approve a permit extension for Five Fields Pond,
DEP# 201-708, for three years, 6-0 in favor.
6:57 pm Motion made and seconded to issue an Order of Conditions for 40 Fern Street,
DEP# 201-934, BL 894, 6-0 in favor.
The Commission postponed issuance of a Certificate of Compliance for 39
Middleby Road, DEP# 201-875, BL 833.
6:58 pm Reports: Bike Advisory, Community Preservation Committee, Land Steward
Directors, Housing Partnership, Tree Committee, Land Management, Land
Acquisition, etc.
Mr. Kennedy reported on maintenance at Juniper Hill. The Commission
discussed annual mowing of the meadow and trail. Ms. Mullins will set up a
meeting with the three trustees, staff, and a neutral contractor to discuss.
Ms. Mullins reported that Boston Dynamics would like to extend their robot
testing permit at Hayden Woods.
Motion made and seconded to approve extension of the permit for field testing of
th
the LS3 robot for Boston Dynamics at Hayden Woods on either April 9 or April
10th, 6-0 in favor.
Ms. Warren reported that the spring walks will be coming up soon.
Motion made and seconded to approve the minutes from the meeting on March
25, 2014, 6-0 in favor.
7:05 pm Cont. Hearing – 21 Valley Road, NOI
DEP# 201-933, BL 893
Applicant: DEBCO Properties
Expand a portion of the driveway and install utility connections within the outer
portion of the 200-foot Riverfront Area associated with North Lexington Brook
Present for the Applicant: Rich Kirby, LEC Environmental Consultants, Inc.,
Andrew and David Burns, Contractors
Mr. Kirby presented the plan and drainage revisions for raze and rebuild of a
single-family dwelling.
Comments from the Commission as follows:
Ms. Miller read the engineering review. Mr. Langseth asked if the trench drain
was pushed as close to the street as possible to capture driveway runoff.
Motion made and seconded to close the hearing, 6-0 in favor.
7:11 pm Cont. Hearing – 12 Dunham Street, NOI
DEP# 201-932, BL 892
Applicant: Ping Chen
Construction of an addition, deck, infiltration system, associated grading and
utilities within the 100-foot Buffer Zone and/or any resource areas
Present for the Applicant: Architect for the project
The architect provided the revised plan to address all outstanding issues except
the roof downspout overflow.
Comments from the Commission as follows:
Mr. Kennedy entered the affidavit into the record stating that he watched the
video from the previous hearing with testimony for the project at 12 Dunham
Street.
Motion made and seconded to close the hearing, 6-0 in favor.
Motion made and seconded to issue an Order of Conditions for 12 Dunham
Street, DEP# 201-932, BL 892, 6-0 in favor.
7:15 pm Cont. Hearing – 79 Maple Street, NOI
DEP# 201-921, BL 881
Applicant: Ronald Smith
Raze a single-family dwelling and driveway and construct a new single-family
dwelling, deck, driveway, rooftop infiltration, associated grading and utilities
within the 100-foot Buffer Zone and 200-foot Riverfront Area
Motion made and seconded to continue the hearing to April 22, 2014 at 7:00 pm
at the request of the applicant, 6-0 in favor.
7:18 pm Cont. Hearing – 85 Reed Street, NOI
DEP# 201-925, BL 885
Applicant: Brian Powderly
Raze and rebuild a single-family dwelling within the 100-foot Buffer Zone
Present for the Applicant: Brian Powderly, Contractor and Karon Skinner
Catrone, Wetland Scientist
Ms. Skinner Catrone submitted soil samples and revised plans for this project.
Comments from the Commission as follows:
The Commission discussed the need for the Administrator to review the wetland
line due to the close proximity of the house. Mr. Langseth asked for a
clarification on the pre-existing drainage calculations and if the calculations
accounted for sections of impervious area that drain to the street. Mr. Bitsko
commented that the grading plan needs to be revised to reflect accurate grades to
comply with the drainage system needs. Mr. Bitsko pointed out that the deck
needs to be shown on the most recent plan as well as the roof line including
overhang. Mr. Langseth asked for a summary of the pre and post drainage
calculations for the 2, 10, and 100 year storms, and 1 year volume. Mr. Langseth
asked the applicant to investigate converting the stone trench drain to a trench
drain system. The Commission discussed the need for a stamped plan by the
professional land surveyor.
Motion made and seconded to continue the hearing to April 22, 2014 at the
request of the applicant, 6-0 in favor.
