HAWKERS AND PEDDLERS

For the purpose of promoting and preserving the public health, safety and convenience
and acting under the authority of General Laws Chapter 101 Sections 22, 23 and 24, and
all acts in amendment thereof and in addition thereto, the Board of Selectmen of the
Town of Lexington hereby make and adopt the following rules and regulations for
hawkers and peddlers.
1. No person shall act at any time or place in the Town of Lexington as a hawker or
peddler without first having obtained a license under the laws of the
Commonwealth of Massachusetts.
2. No person shall act at any time or place in the Town of Lexington as a hawker or
peddler unless he shall, upon receiving a license from the Director of Standards
in the Executive Office of Consumer Affairs and Business Regulations, report in
person to the Chief of Police of the Town of Lexington and furnish evidence of
such license and other information as shall be required by said Chief of Police.
3. No hawker or peddler shall permit or cause a vehicle of any kind to stand nor
shall he attempt to sell, solicit sales or make any sales within a distance of 50
yards of any church, school or other public facility in the Town of Lexington
without a special permit issued by the Board of Selectmen or Town Manager.
4. No hawker or peddler shall permit or cause a vehicle of any kind to stand nor
shall he attempt to sell, solicit sales, or make any sales within a distance of 1000
feet of any cemetery, public park, playground, recreation facility or any land or
building structure set aside in said Town of Lexington for historical purposes
without a special permit issued by the Board of Selectmen or Town Manager.
5. No hawker or peddler shall attempt to sell, solicit sales or make any sales within
a distance of 200 yards of the Jack Eddison Bikeway without a special permit
issued by the Board of Selectmen or Town Manager.
6. No hawker or peddler shall permit or cause a vehicle of any kind to stand nor
shall he attempt to sell, solicit sales or make any sales on Massachusetts Avenue
from the Arlington line to the Lincoln line nor within a distance of 200 feet of
said Massachusetts Avenue without a special permit issued by the Board of
Selectmen or Town Manager.
7. No hawker or peddler shall: 1) permit or cause a vehicle of any kind to stand; or
2) attempt to sell, solicit sales or make any sales within the Town of Lexington
before 11:00 a.m. or after 7:00 p.m. or ½ hour after sunset, whichever is earlier,
without a special permit issued by the Board of Selectmen or Town Manager;
provided, however, that this paragraph shall not apply to Patriot’s Day.
8. Hawkers and peddlers may make reasonable announcement of the merchandise
which they have for sale, but loud outcries, the ringing of bells or cymbals or the
making of any mechanical noise will not be permitted at any time or place.
9. Hawkers and peddlers must apply to the Police Department for a permit to
canvass the Town; permit fee of $25.00 to be charged by the Police Department.
