A “Performer” means a person who has filled out a Street Performer application and obtained a Street Performer permit from the Town of Lexington. 2. A permit shall be issued by the Town Manager’s office to each approved applicant therefor in exchange for a completed application and a fee of twenty-five dollars. 3. A completed application for a permit shall contain the applicant’s name, residence address, telephone number and other information, and shall be signed by the applicant. 4. A permit shall be nontransferable, and shall contain the permit number of the applicant and the year in which the permit is valid. A permit is valid from the date on which it is issued though the end of that calendar year. 5. If a performer loses his/her permit, a replacement permit may be obtained for a fee of five dollars. 6. A performer shall clearly display his/her permit while performing and shall allow inspection of the permit by any Lexington police officer. 7. Performances may take place only in the location(s) specified on the permit. A performer may apply to amend a permit to request substitute location(s) for performances. 8. Performances may take place Sunday through Saturday between the hours of 10:00 a.m. and 10:00 p.m. 9. Amplification of any performance is to be kept to a minimum in consideration of the right to peace and quiet of homeowners and business establishments. Upon a complaint by a resident or business, the performer will reduce the volume. 10. There will be no signage requesting contributions. 11. The performer shall not impede pedestrian, bicycle or vehicular traffic and not have any cords or tripping hazards in their specific location. The performer will also be responsible for any litter that is created by the performance or by audience or bystanders during the performance at the permitted location. 12. A performer in accordance with these policies shall be presumed not to constitute a disturbance of the peace or quiet. References Approved by the Board of Selectmen on September 8, 2008.
