MINUTES for:
BOARD OF HEALTH MEETING
Wednesday, April 16, 7:00 P.M.
Parker Room, Town Hall Building

Board of Health Members in Attendance:

Meeting called to order at 7:01 p.m.
1.) Minutes of March 19, 2014 .

2.) Review of revised Smoking and Youth Access Regulation for adoption
Mr. Cody spoke to the Board regarding several Bylaws in Chapter 97 that are related to
smoking and the tobacco purchase age which is set at 18 years of age. There is a Special Town
Meeting scheduled for June. Mr. Cody revealed that the Town Legal Council recommended that
the BOH not adopt the updated changes to the BOH regulation until the Bylaws in Chapter 97
are updated or completely dismissed at Town Meeting. There may be a special Town Meeting in
June and Mr. Cody was planning to request that this matter be placed on the agenda. Mr. Flynn
mentioned his concern regarding including the ban of Blunt Wraps. There was a discussion
about obtaining more information about the ban of Blunt Wraps. A motion was made to
postpone the vote on the Tobacco Regulation Change. A motion was approved which stated in
part that a full Board should be present to show unison when it comes time to vote on the
updated BOH regulation.
3.) Community Health
a.) Healthy Community CHNA grant update
b.) Tick Disease awareness, Lexington resident, Elisa Abel spoke to the Board regarding
the Tick Task Force. She explained that several towns are involved with the Task Force,
including Acton, Bedford, Carlisle, Concord and Weston. Ms Abel told the Board that
flyers and brochures are available in several places in Lexington.
c.) Second Hand Smoke in Multi Unit Housing MAPC, grant: Mr. Cody informed the
Board that several meetings with the contractor, Jeanine Flaherty have taken place and
that posters / pamphlets have been developed to promote the program.
4.) Environmental Health
a.) Food Inspection Program
1) Residential Kitchen Permit

2) Artistry on the Green
Inn at Hastings Park, 2027 Mass Ave.
Mr. Matt Molloy, Executive Chef . Mr. Molloy answered questions from the
Board.
The Lexington Board of Health grants an Annual Permit to Operate a Food
Establishment to Artistry on the Green.

3) Cary Hall Renovation, Plumbing Variance Request
Don Mills, Mills Whitaker Architects
Nancy Shepard, Chair of Ad hoc Cary Memorial Building Renovation
Design Committee. Mr. Mills told the Board the reason for the variance
request was to accommodate the renovation of a “Catering Kitchen”. The
kitchen will have a dishwasher and 2 sinks. There will be food prep there but
no actual cooking.
The Lexington Board of Health approves the variance request from the
requirement of Food Code Chapter 4, section 301.12, Manual Ware washing
Sink Compartments

4)IlCasale new owners Dante & Fillippo deMagistris
New food establishment. Mr. Dante deMagistris and Mr. Fillippo deMagistris,
answered questions from the Board.
The Lexington Board of Health grants an Annual Permit to Operate a Food
Establishment to Il Casale upon successful completion of a pre-operational
inspection.

5) Beijing Restaurant Paul Pai,Manager
New food establishment Mr. Pai answered questions from the Board.

Establishment to Beijing upon successful completion of a pre-operational
inspection.

b.) State Sanitary Code Case Review
1) 26 Volunteer Way
Mr. Cody told the Board he met with the owner of the property. They are burning 10
to 12 cords of wood each season. They have one month to clean up the property. The will move
one big truck and one pick-up truck. The property owner agreed to not burning wood from May
stth
1 through September 30.
2) Brandon Street
A landscaper was hired. The yard is being cleaned up and they are hanging several
bird feeders.
3) 194 Grant Street
There has been a complaint about feeding wild animals. Cookies have been found in
the surrounding yards. This is an on-going dispute. A letter was sent detailing the concerns.
c.) Medical Marijuana
Dr. Perlmutter and Mr. Flynn attended the Town Meeting. The focus was on Medical
Marijuana. The Planning Board recommended restricting the Dispensary to the Hartwell Avenue
area. It will go before the Zoning Board. BOH will focus on regulations.

Lemon Grass has asked for a variance on the two bay sink
Animal Regulation regarding Rabies has changed. When a pet owner requests to not
have their pet vaccinated against rabies, they bring a letter from their Vet explaining why. Mr
Cody then approves or denies the request and sends a letter to the owner.
