Parker Room, Town Hall Building 1625 Massachusetts Avenue, Lexington, MA Board of Health Members in Attendance: Wendy Heiger- Bernays, PhD, Chair, Burt Perlmutter, MD, John J. Flynn, J.D., Sharon MacKenzie R.N., CCM, David S. Geller, M.D Health Division Attendees: Gerard F. Cody, Health Director Linda Rainville, Clerk 1.) Hearing: Tobacco and Youth Access Regulations Mr. Cody read the hearing procedures to the attendees. He introduced the Members of the panel. He explained the rules of the hearing. All Attendees signed in. Several people spoke regarding the Proposed Tobacco Regulation changes. DJ Wilson, Mass. Municipal Assoc. spoke regarding the statistics of towns in Mass that have changed the purchase age of tobacco products. Jeanine Flaherty, Tobacco Control/Public Health Consultant, supports proposed changes. Ken Camille, Cumberland Farms, Lexington, spoke against the changes. He felt the changes would hurt local businesses, forcing customers to go to surrounding towns to purchase tobacco products. Matt Reynolds, student Lexington High School, spoke in support of the proposed changes. He stated 2.12% of tobacco sales are to customers between 18 and 21 years of age. If the purchase age is raised to 21, most students would not be able to travel to other towns to purchase tobacco products on a regular basis. Mr. Cody explained that he has received emails regarding the proposal to raise the purchase age of tobacco products. Food Inspection Program Residential Kitchen Permit 1)New Permit Ralinda Young, 27 Oakland Postponed to the April meeting Artistry on the Green 2) New Permit Inn at Hastings Park, 2027 Mass Ave. Mr. Matt Molloy, Executive Chef Postponed to the April meeting b.)State Sanitary Code Case Review Update 1) 26 Volunteer Way Mr. Cody told the Board that there is another complaint regarding this address. The complaint is about parking Commercial vehicles on private property and smoke from the wood stove. The Zoning Administrator has sent a letter regarding the zoning violation. 2.) Brook Haven Swimming Pool Variance request c.) Medical Marijuana Update Charles Hornig, Lexington Planning Board, addressed the BOH asking if the BOH had drafted a plan to regulate a Medical Marijuana facility if it is approved. The Planning Board feels that the town should be prepared if a Medical Marijuana facility is approved for Lexington. He shared a map of proposed locations the Planning Board is presenting to the Town. Mr. Hornig explained that the map showed a 500 foot “buffer zone” from areas where children congregate. Mr. Cody explained that a draft regulation is still under consideration. Mr. Cody explained that they were using the regulations from the City of Boston, the City of Framingham and the town of Littleton as examples. Mr. Hornig asked if someone from the BOH would be available to communicate the information at the Town Meeting. A representative from the BOH will attend the Town Meeting to answer any concerns. Ethan Handwerker stated he had concerns with the Boston Regulations. He will continue to look at the Boston Regulations. 5.) Old / New Business Mr. Cody informed the BOH the residents at 11/12 Brandon Way are feeding wild animals. At #11 they are feeding birds, #12 has a raccoon ramp set up. When an inspection was performed of the area, Brian had a 5 gallon pail and was spreading bird seed everywhere. Approximately 100 ducks show up around 5:00 pm each evening. 7) Next Meeting Wednesday, April 19, 2014
