MINUTES for:
BOARD OF HEALTH MEETING
Wednesday, May 21, 7:00 P.M.
Legion Room, Cary Hall Building

Board of Health Members in Attendance:
Burt Perlmutter, MD, John J. Flynn, J.D., Sharon MacKenzie R.N., CCM, David S. Geller, M.D
Health Division Attendees:

Meeting called to order at 7:00p.m.
1.) Minutes of April 16, 2014 .
with one correction
2.) Community Health
a.) Healthy Community CHNA grant update Mr. Cody told the Board that the first half of the funds for
the $25,000 has been awarded.
Mr. Cody also reviewed the Communicable Disease information supplied by David Neylon. Mr. Cody
mentioned that David Neylon was complimented by Mass. Dept. of Public Health regarding his handling
of a TB case.
b.) Second Hand Smoke in Multi Unit Housing MAPC, grant: Mr. Cody and Jeanine Flaherty will have
a public meeting to promote Smoke Free Living in Apartments in Lexington.
3.) Environmental Health
a.) Food Inspection Program
1) Residential Kitchen Permit - Morsels
Ralinda Lurie Young, 27 Oakland met with the Board. She explained her plan to open a
residential kitchen. The Board asked a few questions. The kitchen was approved – all in favor.
The Lexington Board of Health grants an Annual Permit to Operate a Residential Kitchen to
Morsels at 27 Oakland Street. (D. Geller motioned, S. Mackenzie seconded)
2) Royal India Bistro – No one appeared. Mr. Cody and Ms. Fox will meet with the owner of
the next few days regarding violations.
3) Lexington Community Farm, Janet Kern, new retail food permit. Ms. Kern came before the
Board to request a Permit to Operate and a variance request. Ms. Kern explained she would like
the permit to operate a Community Farm. They have completed a food plan review. The reason
for the variance request is because of there is no mop sink available on site. Because there is no
food prep being done on the premises, washing the cement floor with a hose is acceptable.

“The Lexington Board of Health approves the variance request according to the requirements
Lexington Community Farm Variance request application” (D. Geller motioned, S. MacKenzie
seconded) All in Favor
b.) State Sanitary Code Case Review
The following complaints were addressed:
1) 4 Forbes Road – An open well on the property and a pipe draining water onto another property. A
letter will be mailed to the owner.
2) 15 John Poulter Road – Pool in disrepair, fence fall down. Mr. Cody sent a letter to the owners
regarding the swimming pool and fence.
3) 337 Bedford Street – Old tarp over a car, never sees garbage or trash (water and sewer bill paid).
David George, Zoning Administrator sent a letter to the owner to clean up the property.
4) Avalon at Lexington Hills – A letter was mailed by Mr. Cody regarding violations to the Chapter
II of the State Sanitary Code 105 CMR 410.000 and Article XIV, Nuisance that are in need of
correction.
5) 192 Spring Street – Septic – A letter was mailed to the resident regarding adding a bedroom to the
home and the need to do have a Title 5 inspection.
c.) Smoking and Youth Access Regulation Update – After some discussion, the Board has decided to be
prepared to go forward with a new regulation pending repeal or amendment of By-Law. The Board
plans on having two versions.
d.) Old Res 2014 Rain Closure Policy – Mr. Cody explained that ¼” or more of rain to fall before
closing the Beach. The BOH will approve the change from ½ to ¼” of rain to fall before closing the
beach. Based on the data presented.
e.) Swimming Pool Variance Requests - The following Seasonal Pool Facilities have requested a
variance from 105 CMR 435.23 (1) Lifeguards:
Drummer Boy Green Condominiums, Moon Hill Community Pool, Adams Pool, Quality Inn & Suites
Pool, Aloft Pool @ Paramount Hotel, Pleasant Brook Pool Assoc., Five Fields Pool
“The Lexington Board of Health grants the variance request from the requirement of lifeguards for the
safe operation of pools as listed under 105 CMR 435.23 (2) shall be met including all signage which
includes: “Warning No Lifeguard on Duty” in easy to read, legible letters which are at least four inches
high “Children under the age of 16 should not use swimming pool without and adult in attendance” and
another sign that states, “Adults should not swim alone”. This variance applies only to the following
seasonal pool facilities, which have made the request in writing. All in favor.
f.) Animal Permit Variance Request, 40 Fern Street – Mr. Shrodel has requested a variance from the
required 2 acre minimum to obtain an animal permit for the keeping of more than 5 chickens and
Alpacas. The Conservation Dept. and the Animal Control Officer has approved the plan.

5.) Old / New Business
1025 Mass Ave., Mr. Cody received a complaint regarding the home being filled with trash, 2 cars being
parked in driveway. When Mr. Cody went to the residence to inspect he observed the trash and boxes
piled up in window, 2 mini vans stuffed with trash. A letter will be sent to the owner asking them to
contact the Health Department.
