CONSERVATION COMMISSION
MINUTES
Tuesday, November 19, 2013

Chair Joyce Miller opened the meeting at 7:33pm in the Parker Room of the Town Office
Building.
Commissioners Present: Joyce Miller, Phil Hamilton, Stew Kennedy, Duke Bitsko, Dick Wolk
(arrived at 7:33pm), Jane Warren, and David Langseth (arrived at 7:33pm)
Others Present: Karen Mullins, Conservation Administrator and Michelle Tassi, Community
Development Department Assistant

Installation of ground mounted solar within the 200-foot Riverfront Area and
100-foot Buffer Zone to Bordering Vegetated Wetland

Present for the Applicant: Peter MacDougall, SunBug Solar and Kim Goldinger,
Homeowner
Mr. MacDougall proposed the installation of ground mounted solar outside the
200-foot Riverfront Area.
Comments from the Commission as follows:
Ms. Miller asked the applicant to identify the criteria used to determine the
wetland line delineation. Mr. Langseth asked if the applicant would need to
excavate and what type of equipment would be used. Ms. Miller asked the size of
each panel for solar. Mr. Langseth needed clarification on the gap size between
each panel to determine the effectiveness. Mr. Bitsko asked if soil samples were
submitted to determine the Bordering Vegetated Wetland. The Commission
discussed a condition in which vehicles cannot be parked along any active routes.
Mr. Langseth commented that a limit of work line needs to be added to the plan.
Ms. Miller asked how the lawn would be restored. Mr. Kennedy voiced his
concerns regarding erosion and water flowing towards the neighbor. The
Commission discussed ceasing all activity on site, including activities within the
200-foot Riverfront Area.
Motion made and seconded to issue a negative determination with conditions, 6-1
in favor. Ms. Miller voted against the project at 7 Farm Road as proposed.
8:20 pm Cont. Hearing – NOI, 48 Valley Road

Construction of an addition and site work within the 100-foot Buffer Zone to
Bordering Vegetated Wetland
Motion made and seconded to continue the hearing to December 3, 2013 at
7:30pm at the request of the applicant, 7-0 in favor.
PENDING MATTERS
8:20 pm Order of Compliance Discussion: 33 Marrett Road, Scottish Rite, BL 395
Mike Novak from Meridian Associates and two representatives from Scottish
Rite were present for this discussion. Mr. Novak gave a brief overview of the
discrepancies on the property. He described the immediate and long-term
maintenance plan. Mr. Langseth asked about water quality management. Mr.
Novak will be on site during the immediate maintenance.
Motion made and seconded to approve the proposed field changes to increase the
impervious surface area and increase the outlet pipe size, 7-0 in favor.
Motion made and seconded to issue a certificate of compliance pending the
stamp and approval from Mike Novak, 7-0 in favor.
8:41 pm Re-organize Commission
Motion made and seconded to appoint Joyce Miller as the Chair of the
Conservation Commission, 7-0 in favor.
Motion made and seconded to appoint Phil Hamilton as the Vice Chair of the
Conservation Commission, 7-0 in favor.
8:43 pm Motion made and seconded to issue an Order of Conditions: 14 Middle Street,
DEP# 201-913, BL 873, 7-0 in favor.
Motion made and seconded to issue an Order of Conditions with the condition of
no disturbance of the Pine grove: 3 Page Road, DEP# 201-914, BL 874, 7-0 in
favor.
Motion made and seconded to issue an Order of Conditions: 57 Albemarle
Avenue, DEP# 201-915, BL 875, 7-0 in favor.
Motion made and seconded to issue a Certificate of Compliance: 252 East
Emerson Road, DEP# 201-830, BL 788, 7-0 in favor.
Motion made and seconded to issue a Certificate of Compliance: 119 Grant
Street, DEP# 201-887, BL 846, 7-0 in favor.
Motion made and seconded to issue a Certificate of Compliance: 119 Grant
Street, DEP# 201-406, BL 356, 7-0 in favor.
8:56 pm The Commission scheduled the site visits for 0 Sherburne Road, 25 Ledgelawn
Avenue, 25 Suzanne Road, and 121 East Emerson Road on Saturday, November
23, 2013 at 9:30 a.m.
8:56 pm Motion made and seconded to approve the minutes from the meeting on
November 5, 2013, 7-0 in favor.
8:58 pm Motion made and seconded to adjourn the meeting, 7-0 in favor.
