MINUTES

Chair Joyce Miller opened the meeting at 7:30pm in the Parker Room of the Town Office
Building.
Commissioners Present: Joyce Miller, Phil Hamilton, Stew Kennedy, Duke Bitsko (arrived at
7:33pm), Dick Wolk (arrived at 7:38pm), and Jane Warren
Commissioners Absent: David Langseth
Others Present: Karen Mullins, Conservation Administrator and Michelle Tassi, Community

Excavation of lead-based paint impacted soil within the 100-foot Buffer Zone to
Bordering Vegetated Wetland

Present for the Applicant: Bill Dailey, Sloane and Walsh, James Freehling,
Symmes Lifecare, Inc. and James Borrebach, OHI Engineering
Mr. Dailey gave a brief history of the property before it was acquired by
Brookhaven and the current proposal to remove the low level of lead soil. Mr.
Borrebach explained that there will be excavation and off-site disposal of
contaminated soil with low level lead concentrations. The Notice of Intent
identifies up to 5,000 square feet of temporary Bordering Vegetated Wetland
alteration to accommodate the lead removal. A fluorescent meter will be used on
site to determine lead levels and minimize disturbance of the wetlands. Mr.
Borrebach commented that lead impacted soils from lead paint are not subject to
clean up standards. There will be removal and stockpiling of 750 cubic yards of
soil, installation of a Filtermitt silt sock, and the trees will be worked around to
limit the removal.
Comments from the Commission as follows:
Ms. Miller read Mr. Langseth’s comments regarding this proposal. Mr. Hamilton
asked the parameters for stockpiling. Mr. Borrebach replied that the soil will be
stored for 30-90 days on and covered by polyethylene sheeting. Mr. Kennedy
commented on the preferred location for stockpiling to be close to the house
demolition area. The applicant agrees and is willing to implement additional
erosion control measures to preserve existing trees. Mr. Bitsko questioned the
maximum depth of soil removal. Mr. Borrebach replied that the depth would be
no more than three feet based on clean up of an average lead concentration. Mr.
Hamilton suggested conditioning security to watch for vandalism of the soil
stockpiling.
Keith Ohmart of the Greenway Corridor Committee stated that he was in support
of the pathway proposed.
Mr. Bitsko inquired about the materials used for the pathway construction. Ms.
Warren asked where the soils get disposed. Mr. Borrebach replied that the soils
will either go to a lined or unlined landfill or a petroleum type disposal that is out
of state after the lead level testing is done.
Motion made and seconded to close the hearing, 6-0 in favor.

Motion made and seconded to continue the hearing to November 19, 2013 at 7:30
pm at the request of the applicant, 6-0 in favor.

Mrs. Johnson proposed the final Notice of Intent Plan with the location of the
shed outside the 50’ Buffer Zone.
Comments from the Commission as follows:
Ms. Miller asked for a drainage calculation clarification. Ms. Mullins stated that
no trenches are needed and the calculations were previously provided by the
applicant.
Motion made and seconded to close the hearing, 6-0 in favor.
PENDING MATTERS
8:00 pm Discussion on Proposed Balanced Housing Residential Development at 7
Mountain Road
Mr. Wolk spoke with David Williams as well as a Planning Board member to get
a clarification on a balanced housing development. Mr. Williams suggested a
100’ Buffer Zone to be left natural because Hennessey Field abuts this area. It
was also suggested that a trail connection be provided through the parcel to
Hennessey Field. Mr. Kennedy is in favor of the ideas. Mr. Hamilton feels that
the Conservation Land is already very accessible and feels a pathway would not
benefit the land.
8:13 pm Discussion and Approval of Solarize MA Challenge Program, Lexington, MA
The Commission discussed waiting until Fran Ludwig can come in and speak
with them.
8:14 pm Motion made and seconded to issue an Order of Conditions: 675 Lowell Street –
Butterfield Pond, DEP# 201-908, BL 868, 6-0 in favor.
The Commission postponed issuing a Certificate of Compliance: 10 Holton
Road, DEP# 201-827, BL 785.
The Commission postponed issuing a Certificate of Compliance: 22 Middle
Street, DEP# 201-779, BL 739.
Motion made and seconded to issue a Certificate of Compliance: 44 Lincoln
Street, DEP# 201-874, BL 832, 6-0 in favor.
8:16 pm Motion made and seconded to approve the 2014 Conservation Commission
meeting calendar, 6-0 in favor.
8:17 pm Motion made and seconded to approve the Wright Farm temporary trail opening
location, 6-0 in favor.
8:18 pm Comments to Selectmen on Hornig Home Burial Plot Request
The Commission discussed possible contaminants such as embalming fluid
migrating down the slope to the resource areas.
8:24 pm The Commission scheduled the site visits for 16 Green Lane, 4 Lake Street, 57
Albemarle Ave, 3 Page Road, and 14 Middle Street on Saturday, November 2,
2013 at 9:00 a.m.
8:26 pm Motion made and seconded to approve the minutes from the meeting on October
8, 2013, 6-0 in favor.
8:27 pm Motion made and seconded to adjourn the meeting, 6-0 in favor.
