Meeting called to order at 7:00 p.m.
1.) Minutes—minutes approved as written, motioned by S. MacKenzie, 2nd B. Perlmutter
2.) Community Health
a.) CHNA Health Community grant Update
The CHNA Grant awarded $25000.00. Meghan's (contractor) stipend was cut in half and put in another area of
the grant.
MAPC —awarded $6384.00 grant to the Lexington Health Department.
Mr. Cody explained to the BOH that a measles case at a local hospital emergency room resulted in 6 Lexington
and 6 Belmont residents potential exposed.
3.)Environmental Health
a.) Food Inspection Program
1) Baja Taco Food Truck New Permit
Mr. Brian Peugh appeared before the Board to present his plans. After answering some questions the permit
was approved by the Board
2) Sweet Tomato's Pizza Food Truck New Permit
Mr. Justin Shimamuro appeared before the Board to present his plans. After answering some questions the
permit was approved by the Board
Mr. Cody told the Board that a new Food Truck Policy is being drafted through the Selectman's Office and is
expected to be completed over the next few months. This will be a Town-Wide Policy that including various
departments including but not limited to; the Zoning Department, the Town Manager's Office, the Police
Department and the Health Department.
b.)State Sanitary Code Case Review Update
314 Bedford Street
In response to a complaint a Community Health inspection revealed several State Sanitary Code violations. The
Health Dept and Lexington Housing Authority have been in contact with the management company to correct
the violations.
57 Bedford Street
Mr. Cody explained to the Board there were two rubbish complaints at this address in one week. An Order To
Correct was written and a ticket issued by Health Department. The owner was insulted that he received a ticket
for the offense and called Mr. Cody to complain. The owner called Police and claimed it was illegal dumping.
The BOH motioned:
"The Lexington Board of Health recommends that you follow the instructions to request a non criminal hearing
at the Concord District Court as described on the ticket."
Five Forks Sunoco
• second notice was mailed regarding the Tobacco Violation cited January 19, 2014.
Unit 111 Parker Manor Condominiums
• second notice has been mailed regarding a previous violation. The original notice regarding specific Sanitary
Code violations and the necessary corrective measures was mailed on January 2, 2014.
Quality Inn and Suites
Quality Inn and Suites has returned the questionnaire regarding Transitional Housing. The purpose of the
questionnaire designed by the Health Department is to see what can be done to improve the living conditions.
Golden Living Center
A routine inspection revealed a high number of critical and non-critical violations. This facility will be
monitored closely due to the high risk population.
Aloft Hotel
A second re-inspection was conducted; several red and blue violations had not been corrected. Fines will be
issued and a re-inspection will be done within fourteen days.
c.) Medical Marijuana Update
Mr. Cody explained to the Board that the moratorium on Medical Marijuana will be lifted July 31st, 2014 He
recommended that the BOH should be prepared to review the MAHB document or the Boston/Cambridge
template regarding local regulations could be modified to fit our needs. This topic will be addressed again after
the Revised Tobacco Regulations are completed in March/April.
Tobacco Update:
Mr. Pato, Selectman attending the meeting to hear what the BOH was planning. Mr. Cody explained the draft
tobacco regulations will have to go to Town Council. A Press Release/Legal Notice will be posted in the local
newspaper 5-7 day prior to the hearing. A letter will be sent to the Tobacco Permit holders announcing the
hearing. We should "shoot for" the March meeting for the hearing and the April meeting to vote on the
changes. The goal is for the new regulations to go in to effect July 1st
4.)Emergency Preparedness
a.)Health and Medical Coordinating Coalition, (HMCC) Update
Mr. Cody told the Board that they are planning to have another Table Top Exercise Plan.
Miscellaneous
5.) Old/New Business
Cumberland Farms will appear at the next BOH meeting to present their food service plan for their new
facility at 324 Marrett Road.
Mr. Cody showed the Board the new pamphlet "Welcome to Bio Pharma in Lexington". The Board
recommended a few edits for purposes of clarification, but over-all it was very well received.
