Burt Perlmutter called the meeting to order at 7:08 p.m.
1.) Minutes of October 15, 2013 approved with two corrections
2.) Community Health
a.) CHNA Health Community grant Update
Mr. Cody reported that the Grant Application was finalized. The survey showed areas the residents would like
to see addressed: Connectivity, for residents; Alternate Transportation; Mental Health; Nutrition. The group
has decided to continue to meet with or without the funding. The goal will be to promote existing programs.
3.) Environmental Health
a.) Food Inspection Program
1) Ms. Emily Patel, came before the BOH to request a permit to operate a Residential Kitchen at 11
Hancock Ave. After answering the questions from the BOH, the permit was approved. "The Lexington
Board of Health grants an Annual Permit to Operate a Residential Kitchen to Emily Patel at 11 Hancock
Avenue." Dr. Geller motioned and S. MacKenzie seconded. All in Favor.
2) Mr. Zito De Olivera, Manager, Prime Roast Beef& Seafood- Did not appear.
b.)State Sanitary Code Case Review Update
c.) Raising the purchase age for tobacco, unregulated nicotine delivery devices to 21.
Jonathan P Winickoff, M.D. and Matthew Reynolds, Student at LHS presented information to the BOH
regarding the statistics regarding people under the legal age to buy cigarettes still being able to purchase
cigarettes, cigars and other smoking material. At this time the legal age to purchase tobacco is 18 which opens
the market up to teens in high school. The tobacco industry is targeting younger customers by selling items like
flavored tobacco products, single packages, colorful packaging, etc.
Dr. Winickoff reported the effects of tobacco on younger smokers.
1.) Electronic Cigarettes (e- cigarettes) Elizabeth Kloss reported on the research she has done regarding
Electronic cigarettes.
The BOH will revisit this topic at the December meeting.
d.) Medical Marijuana, Ethan Handwerker came before BOH to follow up on his request for a Letter of
Support, Letter of Non Opposition regarding his Registered Marijuana Dispensary. After some discussion, J.
Flynn motioned and D. Geller seconded to take no action at this time because there is a lot to learn about the
BOH's responsibility. The BOH agreed to send a letter of"No Action".

5.) Old/New Business
1) Primary Burial Agent Designate the position of Town Clerk, and Donna M. Hooper as current
Town Clerk, as Primary Burial Agent of the Town of Election
2) Secondary Burial Agent
a. Designate the staff o the Town Clerk's Office as Secondary Burial Agents Dianne E. Snell,
Lisa M. Maguire, Carmelina M. Fiore, Kelley A. Cutone
b. Designate staff of the Office of Community Development, to be identified by the Health
Director, as Secondary Burial Agents
3) Notification to the Department of Public Health/Registry of Vital Records and Statistics Issue
written notification to the Registry of Vital Records and Statistics confirming the vote taken by the
Board of Health designating Donna M. Hooper, Town Clerk as Primary Burial Agent and the names
of all other individuals designated as Secondary Burial Agents effective danuary 1, 2014.
B. Perlmutter motioned to approve. SMacKenzie seconded. All Approved
314 Bedford Street, Unit 103 The issues are still being worked out, should be resolved by the deadline.
194 Grant Street, Compost pile. Robert Beaudoin helped the residents.
4L Countryside, was in deporable condition, Health and Human Services helping with this situation.
PATCH in now listing Health Inspections. It has been well received.
MAPC Grant to promote tobacco free housing is being considered.
