Wendy Heiger-Bernays, PhD. called the meeting to order at 7:02 p.m.
1.) Minutes of September 17, 2013 were approved with 2 edits. Motion made by B. Perlmutter and seconded
by S. MacKenzie. All approved

a.) CHNA Health Community grant Update
3.) Environmental Health
a.) Food Inspection Program
1) Ruyi
Maureen Lee reported to the Board about the progress at Ruyi Restaurant. The cleaning schedule is working.
Pest Control is doing some training with staff. There is very little pest activity.
The Board moved to close the case and continue with the normal inspection schedule. B. Perlmutter motioned,
S. MacKenzie seconded- All in favor
2) You Ville Place, Joanne Scianna,COO Variance Request
Joanne Scianna and Mike Dickinson met with the Board to request a variance. They would like to install a non-
commercial grade refrigerator and stove. This equipment would be used to store and/or prepare an occasional
hot drink or snack for residents between meal times. All regular meals will continue to be made in the main
kitchen. B. Perlmutter motioned, S. MacKenzie seconded- All in favor
3) Avenue Deli, Yong Jae You, owner New Owner
Yong Jae You came before the Board to request a permit to operate a Food Establishment. Mr. You explained
that there would be no menu changes. He has set up a log for grease trap maintenance.
The Lexington Board of Health grants an Annual Permit to Operate a Food Establishment to Avenue Deli upon
successful completion of a pre-operational inspection. J. Flynn motioned, B. Perlmutter seconded - All in
favor
4)Upper Crust, Brandon Pitman,Manager Variance Request
Brandon Pitman spoke to the Board about Upper Crust. They serve Pizza by the slice. Pizza is reheated to
customer preference. The use pizza boxes to distribute the pizza. Time variance is written on the boxes. A
written plan will be sent to the Health Director and Health Inspector.
The Lexington Board of Health approves the variance request from the requirement of Food Code Chapter 3,
section 501.16, Potentially Hazardous Foods, Hot and Cold Holding" S. MacKenzie motioned, B. Perlmutter
seconded - All in favor
b.) State Sanitary Code Case Review Update
c.) Burial Plot, 144 Marrett Road, Charles Hornig Discussion
Charles Hornig spoke to the Board asking for permission to establish a small Private Burial plot on his property.
Mr. Hornig explained that the property was family owned. The area for the burial plot would not interfere with
other use of the property. There is a private drinking well and private septic on the property. Mr. Hornig will
answer a list of questions and send it to Mr. Cody.
The Lexington Board of Health approves the establishment of a private burial plot at 144 Marrett Road as
described in the documents submitted earlier this evening. Provide proof that the Burial Plot map has been filed
with the Middlesex Register of Deeds. B. Perlmutter motioned, S. MacKenzie seconded- All in favor.
d.) Medical Marijuana Discussion
Ethan Handwerker met with Board to discuss an application for a Registered Marijuana Dispensary. There was
a lengthy discussion regarding the regulations of operating a Registered Marijuana Dispensary. Mr.
Handwerker is asking the Board for a letter of support or non opposition. He will need this letter by November
21st. The Board agreed to meet again before that date to discuss 1) Cultivation site, 2)Preparation of Marijuana
Induced Preparation, 3) Retail Store.
e.) Organic Waste Processing Facility draft RFP Discussion
Ms. Heiger- Bernays reported to the Board about meeting with the Board of Selectmen regarding this RFP. Ms.
Heiger- Bernays, Mr. Flynn and Dr. Perlmutter met with the BOS to ask them to hold off posting the RFP for
the public until the concerns were addressed. The BOS declined. Version 3 of the RFP was posted on October
24th with a disclaimer; Posted for public review/comment for 30 days.
Q Electronic Cigarettes (e- cigarettes) Discussion
Mr. Cody updated the Board regarding the research of bans on e-cigarettes to correspond with regular
cigarettes. He will bring the existing regulations to the Board.

5.) Old/New Business
Flu Clinic on October 5, 2013 had approximately 614 people attend. To date approximately 900 people
have received free flu shots from the Health Dept.
314 Bedford Street is coming into compliance with recommendations.
