Chair Joyce Miller opened the meeting at 7:41pm in the Legion Room of Cary Hall.
Commissioners Present: Joyce Miller, Jane Warren, Stew Kennedy, Phil Hamilton, Dick

Construction of a second story addition to a single-family dwelling within
the 100-foot Buffer Zone

Present for the Applicant: Rich Kirby, LEC Environmental and Ed Cain,
Candlewick Properties
Mr. Kirby proposed construction of a second story addition to a single-
family dwelling with no land alterations. An orange construction fence
will be used for erosion control along the 25’ Buffer Zone.
Comments from the Commission as follows:
Mr. Hamilton stated that the Commission cannot approve the proposed
wetland line because they were not able to see it. Mr. Langseth asked if
any plans included with the application show the topography. Mr. Bitsko
agreed with the use of an orange construction fence and asked if any work
was proposed for the driveway or the front walkway. Mr. Cain and Mr.
Kirby explained that the only work proposed is a second story addition.
Mr. Langseth commented on the enhancement of the hedgerow and the
applicant should allow the wetland to be left undisturbed. Mr. Kirby stated
that there could be additional plantings to create a tighter hedgerow. Mr.
Kennedy agreed with the additional plantings and allowing the wetland to
go fallow.
Andrew McKee of 54 Bridge Street gave a brief description of the land at
51 Bridge Street and told the Commission that behind the hedges there
used to be lawn and a vegetable garden.
Motion made and seconded to issue a negative determination with
conditions, 6-0 in favor.

Comments from the Commission as follows:
Ms. Miller gave a summary of information that was needed from the last
hearing. Ms. Miller read the engineering report. Mr. Langseth commented
on the design for the calculations for the roof drip edge. The trench allows
a 6” over-lip.
Motion made and seconded to close the hearing, 6-0 in favor.

Site Redevelopment within the 100-foot Buffer Zone

Present for the Applicant: Bernard Hamill, H-Star Engineering and Indira
Bhupatiraju, Homeowner
Mr. Hamill proposed the Cultec system for this property. The driveway
will be resurfaced and re-graded. Mr. Hamill stated that the garage and
driveway runoff will be directed to the new drainage system. The siltation
fence was moved up slope by 3’ and it is 28’ away from the wetlands. Mr.
Hamill addressed the pre-development conditions for the pool area and
added new stairs to access the backyard. The retaining wall was extended
more than 5’ away from the property line to meet zoning setbacks. Mr.
Hamill explained that limited fill would be used in the sewer easement
area which should have no impact on the sewer pipe. He described the
updated drainage summary and calculations that were provided.
Comments from the Commission as follows:
Ms. Miller read the Engineering report which questioned the equipment
that would be used in the sewer easement and slope vegetation. The
Commission recommended a condition stating that grading on the
northerly property line shall be implemented by creating a swale to direct
flows to the easterly part of the lot. Mr. Langseth commented on the
overflow design. The normal practice is to overflow at the downspout
connections unless there is a convincing reason for the proposed design.
Mr. Hamill explained that it is better to direct the overflow away from the
area. Mr. Langseth showed his understanding of not wanting the flows to
go into the garage, but he cannot evaluate the elevations on the plan. Mr.
Langseth asked for clarification on the garage elevation. The Commission
stated that they wanted clear evidence that the homeowner will know the
system is failing and a pipe out of site is not visible to them. Mr. Langseth
commented that a condition be made for elevations of the trench drain,
Cultecs, and basement to verify if it is necessary to have overflow from
the Cultec chamber to the rear of the garage beyond the retaining wall. Mr.
Bitsko raised concern with the Cultec chamber design only having 6” of
cover. Ms. Miller read an additional Engineering report. Mr. Kennedy
questioned the test pit for the location of the infiltration area. Mr. Wolk
asked what was prohibiting the Cultec system from being placed deeper
into the ground for more top cover. Mr. Bitsko commented that the
manufacturer’s specs should be referred to for assurance. The Commission
stated that a condition be made to submit the manufacturer’s specifications
to verify the proposed Cultec system.

Ratify Emergency Certificate: I-95 South Bound to Rt. 2 East Bound off ramp,
Drainage Repairs
The Commission discussed the issuance of an Enforcement Order by the
Conservation Administrator for the I-95 South Bound to Rt. 2 East Bound
off ramp drainage repairs.
Motion made and seconded to ratify the Emergency Certificate for the I-
95 South Bound to Rt. 2 East Bound off ramp drainage repairs, 7-0 in
favor.

Approve Compliance for Mal’s Enforcement Order 2006, Rear of 7 Mass Ave,
Map 13, Lot 422
Motion made and seconded to approve compliance for the Mal’s Enforcement
Order 2006 pending a site visit, 7-0 in favor.

Vote to Purchase Valleyfield Street Property, Map 24, Parcel 40
Motion made and seconded to approve the Commission’s purchase of the
Premises for the amount of Fifteen Thousand Dollars ($15,000) and on terms and
conditions acceptable to the Conservation Administrator, including that the
Premises be used for conservation purposes, as the land abuts the Hayden Woods
Conservation land and the purchase will preserve the character of the Hayden
Woods Conservation land by expanding the contiguous conservation area, 7-0 in
favor.
Motion made and seconded to authorize the Conservation Administrator to take
all actions on behalf of the Commission that are reasonably necessary or
advisable, in the judgment of the Conservation Administrator, to purchase the
Premises, including without limitation executing a Purchase and Sale Agreement,
signing closing forms, documents and settlement statements, 7-0 in favor.
Vote to Expend the Funds for Valleyfield Street Purchase from the Hayden
Woods Conservation Trust Fund
Motion made and seconded to authorize the Commission to use funds for
the purchase of the Premises from the Hayden Woods Conservation Trust,
7-0 in favor.

Pierce Road, DEP# 201-888, BL 847, 6-0 in favor.
Motion made and seconded to issue an Order of Conditions: 123 Maple
Street, DEP# 201-889, BL 848, 6-0 in favor.
The Commission did not sign the Amended Order of Conditions for 38
Adams Street, DEP# 201-819, BL 777 due to the need for additional
information for the record from the applicant on the use of certain curve
numbers for the project.
Motion made and seconded to issue a Certificate of Compliance: 8
Rangeway, DEP# 201-528, BL 489, 7-0 in favor.
Motion made and seconded to issue a Certificate of Compliance: 101
Hartwell Avenue, DEP# 201-797, BL 755, 7-0 in favor.
Appoint New Sub-Committee for Land Management Planning Purposes
Motion made and seconded to appoint a new sub-committee for land
management planning purposes. This sub-committee is charged with
developing land management plans and associated budget needs to
implement these plans and meet management and maintenance
responsibilities. The members of this sub-committee are Philip Hamilton,
Duke Bitsko, Stewart Kennedy, and Richard Wolk, 7-0 in favor.
Reports
Mr. Wolk made a report that the Conservation Administrator should reach
out to the nephew for Wright Farm management this year.
Site Visits for meeting on 3/26/13: The Commission scheduled site visits
for Mal’s, 9 Vine Brook Road, Winthrop Road at Vine Brook Crossing,
and 19 Bellflower Street on March 23, 2013.
Motion made and seconded to approve the minutes from February 12,
2013, 7-0 in favor.
Motion made and seconded to approve the minutes from February 26,
2013, 7-0 in favor.
Motion made and seconded to approve the minutes from March 5, 2013
with minor changes, 7-0 in favor.
