Burt M. Perlmutter, M.D. called the meeting to order at 7:08 p.m.
1.) Anaerobic Digester (AD) Regulations
Bruce Haskell, CDM Smith, presented the MassDEP Regulations for Solid Waste Management Facility
Site Assignment and Recycling, Composting and Conversion Permits. The Board had many questions
that have been asked of Mr. Haskell, Lexington Selectmen and AD subcommittee. The major question
is how public health concerns such as noise and odor will be addressed and by whom (Town or State or
no-one). There was a lengthy discussion about the type of permit needed. They also discussed how the
site would be regulated and who would be responsible, the Town or the State.
2.) Minutes of June 12, 2013
The Board reviewed the minutes of June 12, 2013. Geller motioned to approve minutes with one
correction. Flynn seconded. All approved.
3.) Community Health
• David Neylon presented the Community Health Report. This year there will be twice the amount of
flu vaccine available.
• Brookhaven will be the drop off spot for medical waste.
• Mr. Neylon reviewed the Survey Results Summary, Lexington Healthy Communities Project. Three
hundred and three community members responded to the survey. Seventy-eight percent (78%) of
those surveyed were Lexington residents, fourteen percent (14%)worked in town, and eight percent
(8%)were visitors.
4.) Environmental Health Report
a.) Food Inspection Program
The Board reviewed the Health Report/Food Inspections Report submitted by Kathy Fox.

b.) State Sanitary Code Case Review
1) Rodent Complaint NH13-22
Mr. Cody reported a letter was sent to the owner of the building. The building foundation has been
sealed and rat traps have been placed around the area.
2) Hayden Swimming Pool
Mr. Cody reviewed the response from the Mass. Department of Public Health in regard to the a variance
request which requires, in part, that all walks, decks and terraces have a minimum slope of/4 inch per
foot toward adequate drains or points at which the water will have a free unobstructed flow away from
the pool to approved points of disposal. The MDPH approved a Conditional Swimming Variance for
Hayden Recreation Center, 24 Lincoln Street.
• A proactive monthly bacteriological water testing program is established with analytical results
provided to the Lexington Health Department upon receipt from a qualified laboratory.
• Mandatory daily water sampling for residual disinfectant and pH shall be conducted and
recorded six (6)times daily, including once prior to opening and once during the peak load,
pursuant to the requirements outlined at 105 CMR 435.29(2) & (3)
• Mandatory water sampling for alkalinity and calcium hardness shall be conducted and recorded
every other day, pursuant to the requirements outlined at 105 CMR 435.29(4).
Geller motioned and Flynn seconded. In accordance with the MDPH it is required the water testing
program be in effect for one year. All Approved
c.) Animal Regulation
Mr. Cody presented an email he received regarding a variance request for the keeping of 15 chickens
on a property. The Board denied the permit. The applicant has 6 months to reduce the number of chickens to 5.
Flynn motioned, Perlmutter seconded, All Approved: The BOH grant a requirement for the applicant to come
into compliance by reducing the number of chickens to 5 by December 31, 2013.
d.) Old Res Swimming Area
Robert Lee, Intern, presented information regarding bacteria testing results at the Old Res. The BOH
recommended waiting to see the effect of the retention pond before doing a revision. Or do a temporary
revision. A 24 hour closure will require 1" or more of rain rather than '/z" to 3/4" of rain.
5.) Emergency Preparedness Update
a.) EDS tabletop
Mr. Cody reported to the Board about the EDS Table Top Exercise. He also reported Lisa Jackson is
leaving the Regional Table Top Board.

6.) Old /New Business
• Mr. Cody spoke to the Board regarding 7 Lillian Road. There is an"Approved Condition" signed 13
April 1959, stating that"Lots 9, 10, 11 shall not be built upon without prior consent of the Lexington
Board of Health". Geller motioned, Flynn seconded. All in favor to release the restriction approved on
13 April 1959 for Lots 9, 10, 11 Lillian Road. Mr. Cody will send a letter to the attorney.
• Mr. Cody reported about the Food Truck Festival conducted on May 9, 2013. Four(4) food trucks were
present. Mr. Cody went to inspect the trucks, at that time only one truck had arrived. It was a well
received event. Approximately 1500 people were coming and going. "Lobsta Love" and "Grill Cheese
Nation" were the most popular. "Chicken on the Run" was good.
• Mr. Cody reported he applied for a Wellness Grant through MAPC

Geller motioned to adjourn the meeting. Flynn seconded. All Approved
Meeting adjourned at 9:00 p.m.
