Cody, Health Director Brenda Tabak, Clerk Wendy Heiger-Bernays called the meeting to order at 7:00 p.m. 1. Minutes of March 13, 2013 (to be approved at date tbd) 2. Community Health Reports/Update (A) Document: Community Health Report April 2013, by David Neylon, RN • Communicable Diseases Reported: Norovirus(l), Hepatitis B(l), LTBI (1), Influenza(3) • Community Health: The Health Division hosted Medical Waste Day which took place Saturday, April 6th from 9:00am to 12:00 pm, where 104 residents dropped off expired/unwanted medication, sharps, syringes, and lancets. Residents dropping off sharps were offered new sharp containers. Seven large boxes of medications and 6 large boxes of sharps were collected. Members of the Lexington Lions Club also volunteered at the event. The next Medical Waste Drop off day will be Wednesday, June 5th from 5pm to 7pm behind the Town Office Building • Massachusetts Immunization Registry: Massachusetts will the 491h state in the country to have a centralized immunization registry, referred to as Massachusetts Immunization Information System (MIIS). Soon all vaccinations administered in the state will be required to be entered into the registry • "Lexington Healthy Communities" Update: The Massachusetts Department of Public Health will supply the Health Division with an MPH candidate summer intern to help with data analysis for the Lexington Healthy Communities project. (B) MSPP INTERFACE Documents: Lexington Healthy Communities Project Implemention Phase Suggestion; Interface Activity Report 6/l/12-1/31/13; Lexington Healthy Community Program • Goal is to strengthen community health through improving Community Connectivity among neighbors, agencies & services, residents and improving communication. Budget and Time for Phase II is $25,000 over fifteen (15) months October 2013 through December 2014. • Mental Health Top Priorities. In MSPP Interface, there are 12 communities involved in metro Boston area participating. 1 • Comment from Wendy Heiger-Bernays: Find out assessment of towns that have participated and see how well they worked? How well effective does it work for people with mental health issues? 3. Environmental Health Report (A) Food Inspection Program Documents: Environmental Health Report April BOH Meeting 2013 by Kathy Fox, Health Agent ; March 2013 Inspections List (Food/Septic/Pool) March 2013 Food Inspections Narrative Report include: • Rancatores • Nex Dine • Vine Brook Tavern • Waxy O'Connors • Mobile Food Trucks: Office Building located at 113 Hartwell Ave will have a different food truck each work day. Over the next month, there are expected to be at least five new mobile food permits issued at this address. The mobile food trucks are only planning to operate at this address. However, if they choose to operate at other locations, they will need to meet local Hawkers & Peddlers and zoning requirements. • Ice Cream Truck Vendor Regulation: If ice cream is listed on the menu of any mobile food truck, then compliance must be achieved with the Department of Safety requirements ofM.G.L. c270 &25 and 520 CMR 15.00Ice Cream Vending. In addition to the Mobile Food Health Permit, ice cream vendor must obtain an Ice Cream Vending Permit from a Public Safety Office, requiring Cori/Sori and fingerprint.(See complete regulation) • Life Jacket Requirement Document: Title XVI Public Health Chapter 111, Section 127A.5 Requirement of personal flotation devices for municipal and recreational programs and camps for minor children; determination of swimming ability. State Sanitary Code for Swimming beaches/camps, requires that life jackets are provided to campers that are classified as "non-swimmers". This does not impact semi public swimming pools, only swimming beaches. It is unclear at this time if recreation/Old Res will be in compliance with this new regulation. APPLICATION: (1) MS. SARA LANE, Operations Manager for `Sara Ran Away with the Spoon', located at former home address 36 Webster Road, Lexington, MA, requests permit to operate a residential kitchen. Document: Residential Kitchen Food Permit Application (completed form by Sara Lane) REQUEST SUMMARY: Applicant appeared before BOH and answered questions pertaining to kitchen sanitary operations/procedures (i.e. separate hand washing station, dishwasher placement). She has completed a preoperational inspection and completed a Residential Kitchen Food Permit Application with the Health Division. MOTION made by John Jay Flynn and seconded. The Lexington Board of Health grants an Annual Permit to Operate a Residential Kitchen to Sara Ran Away with the Spoon at 36 Webster Road. Votes 4:0 Approve 2 (B) State Sanitary Code Case Review Regulation 105 CMR 435.13 (1) Walkways & Decks states in part that "All walk, decks and terraces shall have a minimum slope of 1/4 inch per foot toward adequate drains or points at which the water will have a free unobstructed flow away from the pool to approved points of disposal. " APPLICATION: (1) MR. DONALD MAHONEY, Exec Dir/VP, JW Hayden Recreation Center located at 24 Lincoln St, requests relief in form of pool variance. Documents: letter from Attorney, Edmund C. Grant, representing Hayden Recreation; HAYDEN RECREATION Membership Comparison 2010-2011 & 2011-2012 REQUEST SUMMARY: Speakers Attendees, Don Mahoney, Hayden Recreation Executive Director and Vice President; Ken Cicciarella, Pool Consultant for Pure Aqua Pool, Waltham MA, says the current deck has some sloping but not including the entire perimeter deck of the pool. The existing perimeter drains is quite functional and has been operational in the disposal of deck water for years. No problem has been reported with standing water. Hayden plans to retile with non-skid surface the deck located around its five-lane, 50 ft X 35 ft indoor swimming pool. Ken Ciccciarella informs the additional sloping of perimeter deck would require closure of the pool for an additional several weeks. MOTION made by Burt Perlmutter and seconded. The Lexington Board of Health grant the variance request from the requirement of Walkways & Decks as listed under 105 CMR 534.13(1)to the Hayden Recreation Center at 24 Lincoln St. Specifically, the variance is intended to provide relief from the requirement to maintain a minimum slope of/4 inch per foot toward adequate drains or points of disposal . This variance will expire upon notification of an unsafe operating condition at the Hayden Recreation Center, 24 Lincoln Street. Votes 4:0 approve. C. Animal Regulation 1. Variance Request, 155 East Emerson Road BACKGROUND INFORMATION SUMMARY: Neighbors of 155 East Emerson Road have contacted the Lexington Building Department, with complaints and concerns about the 20 plus chickens and chicken coop building. Rooster was reported to have been sighted on the property. Concern that the coop attracts coyote. Documents: Two (2) Complaint Reports; Letter from Town of Lexington Conservation Division; Town of Lexington Electrical Inspector; Town of Lexington Environmental Health/Community Health Inspection Form; Massachusetts Dept of Agricultural Resources (MDAR) Safe Egg Handling for Backyard Egg Producers Applicant, TEOMAN USTUN, located at 155 East Emerson Road, requests variance from the requirement of the two acre minimum to obtain an animal permit for the keeping of more than 5 (five) chickens. (Note: Applicant, Teoman Ustun,not present at BOH meeting April 10, 2013) 3 REQUEST SUMMARY: Mr. Teoman Ustun of 155 East Emerson Road, requests a variance as noted above, so that they may keep 23 chickens. Various officials have visited property and spoken with Owner. Owner explains he gives the eggs away. They are in process of property plans to submit to Conservation and ZBA. An animal permit application, variance request letter and an animal management plan have been submitted. MOTION made by Wendy Heiger-Bernays and seconded. Plan review required for a variance greater that five (5) chickens; a plan review is required for Animal Permit for more than 5 animals. BOH member, Jay, needs to ask applicant questions to grant variance. Applicant has yet to reply to questions from Gerry Cody, Board of Health Director. Votes 4:0 Approve 4. Emergency Preparedness Update Document: Emergency Preparedness Report April 2013 • Massachusetts Influenza Recap for 2012-2013 Season (shown with graph) • Human Infections with Novel Influenza A(H7N9) Viruses A. EDS Table Top Exercise The Lexington Health Division will hot an Emergency Preparedness Table Top Exercise (TTX) on Friday, May 3rd at the Department of Public Works Building at Bedford St. Carpathia Group Inc will facilitate the exercise which will be focused on setting up an Emergency Dispensing Site (EDS)in response to a biological event. 5.
