PLANNING BOARD MINUTES
MEETING OF SEPTEMBER 25, 2013
A regular meeting of the Lexington Planning Board, held in the Selectmen’s Meeting Room, was
called to order at 7:30 p.m. by Chairman Charles Hornig with members Richard Canale and
Nancy Corcoran-Ronchetti and planning staff Maryann McCall-Taylor present.
************************DEVELOPMENT ADMINISTRATION*********************
PUBLIC HEARING
137-139 Shade Street Definitive Site Sensitive Plan:
The applicant requested a
continuance of the public hearing until such time as the entire Board was available. On a
motion duly made and seconded, it was voted 3-0 to continue the public hearing to 8:00
p.m. on October 9, 2013 in the Selectmen’s Meeting Room, Town Office Building.
150 East Street Subdivision:
On a motion duly made and seconded, it was voted to
endorse the previously approved plan for the 140 East Street Subdivision, the appeal
period having passed without an appeal being filed.
************************DEVELOPMENT REGULATIONS************************
Attorney Mark Bobrowski had been scheduled to meet with the Board but the meeting
was postponed until a full board could be present. In the mean time, the staff and Mr.
Hornig will continue to work with Mr. Bobrowski on drafting the document. Board
members said they had no comments on the regulations at this time.
***************************ZONING BYLAW ADMINISTRATION******************
Medical Marijuana:
The Board was informed that Mr. Ethan Handwerker of The Foundation for
Mass Relief, Inc. had notified the Town that his organization intended to file a Phase 2
application for a Registered Marijuana Dispensary to be located in Lexington. The Board of
Health reported that the statewide meeting on medical marijuana had not been useful.
********************ZONING BOARD OF APPEALS (ZBA)************************
There were several applications for variances to allow redivision of substandard lots before the
ZBA. Mr. Hornig indicated that he would attend the October 10 hearing to explain that the
zoning had removed the grandfathering of substandard lots in common ownership and that the

town now followed state laws. Such redivision should come to the Planning Board through
subdivision. On a motion duly made and seconded, it was voted 3-0 to have Mr. Hornig appear
before the ZBA to state the Planning Board’s case.
On the most recent agenda of the ZBA, posted 48 hours before their meeting, an agenda item
relating to Lexington Toyota was added under other business. The applicant was asking that the
removal of trees that were planted as a condition of the special permit be considered a minor
change, not requiring a public hearing. The Tree Committee and others had expressed concerns
about changing the special permit conditions without broad public notification and input. On a
motion duly made and seconded, it was voted 3-0 to express to the ZBA the opinion of the
Planning Board that this was not a minor change, but a substantial one, and that the matter should
be discussed at a publicly noticed hearing.

On a motion duly made and seconded, it was voted, 3-0, to approve the minutes for August 28,
2013, as submitted.

On Park(ing) Day which was September 20, there was a celebration of the parklet, which grew
out of last year’s Park(ing) Day installation.
********************************BOARD REPORTS******************************
Mr. Canale reported that the Board of Selectmen signed onto a Memorandum of Understanding to
constitute a permanent Scenic Byways Committee and appointed him and Ms. McCall-Taylor as
representatives.

On a motion duly made and seconded, it was voted, 3-0, to adjourn at 7:45 p.m.
