Krieger, Leo P. McSweeney and David G. Williams. Martha C. Wood was not present for this hearing. Staff Present: Dianne Cornaro, Administrative Clerk and David George, Zoning Administrator Petition Address: 54 Tarbell Avenue, Map 7, Lot 52 This hearing was continued from December 13, 2012 A letter was submitted from Attorney John Farrington representing Charles Daly and Stephanie Buller to withdraw the petition for the following relief without prejudice: VARIANCES in accordance with the Zoning By-Law (Chapter 135 of the Code of Lexington) section 135-35A, Table 2, Schedule of Dimensional Controls for the following relief: 1) Frontage of 90 ft. instead of required 125 ft.; 2) Allow lot area of 8262 ft. instead of the required 15,500 ft. 3) Allow a side yard setback of 8 ft. 9 inches instead of the required 15 ft. On a motion from Leo P. McSweeney and seconded by Jeanne K. Krieger, the Board voted 4-0 to accept the withdrawal without prejudice. Wood Staff Present: Dianne Cornaro, Administrative Clerk and David George, Zoning Administrator Petition Address: 10 Vaille Avenue, Map 65, Lot 14 This hearing was postponed from January 10, 2013 The petitioner submitted the following information with the application: nature and justification of request; a topographic plan; a plot plan; elevations and letters of support from David Eastridge of 12 Vaille Avenue and Meredith and John Applegate of 42 Reed Street. Prior to the hearing, the petition and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Zoning Administrator, the Planning Director and the Historic Districts Commission Clerk. Comments were received from the Building Commissioner, the Conservation Administrator and the Zoning Administrator. The Chairman opened the hearing at 7:33 pm by reading the legal notice and described information received from the petitioner. Prior to the hearing, the petition and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Zoning Administrator, the Planning Director and the Historic Districts Commission Clerk. Kristin Brown, owner of the property, presented the petition explaining the need to replace the steps. There were no questions from the Board. There were no questions from the audience. Wood, the Board voted SPECIAL PERMIT 5-0 to grant a from section 135-32C to allow reconstruction after destruction of a non conforming structure. Wood Staff Present: Dianne Cornaro, Administrative Clerk and David George, Zoning Administrator Address: 2377 Massachusetts Avenue, Map 50, Lot 150A The petitioner submitted the following information with the application: nature and justification of request, an uncertified copy of a plot plan, stair plans and a letter of support from Carol Ryan of 3 Minuteman Lane. Prior to the hearing, the petition and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the Zoning Administrator, the Planning Director and the Historic Districts Commission Clerk. Comments were received the Zoning Administrator. The Chairman opened the hearing at 7:44 pm by reading the legal notice and described information received from the petitioner. Robert McNamara presented the petition for the owner of the property, Jeremiah McNamara. There were no questions from the Board. There were no questions from the audience.
