a Certificate of, Appropriateness to. the Town of Lexington with respect, to

HISTORIC DISTRICTS COMMISSION
CERTIFICATE OF APPROPRIATENESS
This certificate is issued pursuant to Chapter 447, Acts of Massachusetts, 1956, as amended, to
Tgwp qf, Lexington
with respect to exterior architectural changes to the Meriam Street Parking Lot,
which is within the Battle Green District.
The building as erected on the lot shall remain as constructed and sub-
stantially as shown on the drawings submitted at the hearing of November 14th,
except that the signs mounted on the building are not approved and shall be
redesigned and presented for consideration at a subsequent hearing.
The Meriam Street gates and stanchions are approved as constructed.
The operating company's logo on the white barrels is not approved, and
the barrels shall be plain white.
The yellow paint on the berms leading into the parking lot and on certain
parking lot stripes is not approved, and all such areas shall be painted white.
This repainting, however, need not be done until:dimmediately after April 19,
1985.
It is a further condition of this certificate that the building and all
the structures in the parking lot shall be maintained in good condition.

Dear Mr. Hutchinson:
At'the meeting of the Lexington Historic Districts Commission
on September.19, 1984, there was discussion of the fact that
the Town had failed to apply for or receive a Certificate of
Appropriateness for the structures erected at the Center
parking lot in the process of converting it to an attended
facility. There is nothing in the Historic Districts statute
that exempts the Town from the requirement to receive a
Certificate. for the erection of, a "....building or
structure....within the historic districts.... ".
The attendant's shelter, the gate, the barricades, and the
yellow paint lines all fall within the definition of "building
or structure" as it has been applied to taxpayers. and citizens
of the Town. The Commission feels that the Town itself should
be a leader in abiding by its own statutes, and that by
avoiding due process it sets a poor example for its citizens.
We ask, therefore, that you file a written request for a
hearing before the Commission, according to the terms of the
Historic Districts statute, in order -to present the designs
for the new parking lot structures and seek a Certificate of
Appropriateness for their installation.
