HomeMy WebLinkAbout2012-02-21 CONCOM-min MINUTES – LEXINGTON CONSERVATION COMMISSION February 21, 2012 Commissioners present: Joyce Miller, Charlie Wyman, Stew Kennedy, Duke Bitsko, Dick Wolk, David Langseth Commissioners absent: Phil Hamilton Others present: Louise Vinci, Conservation Clerk Chair Joyce Miller opened the meeting at 7:37 pm in the Room G-15, Town Office Building 7:37 pm Meeting: 4 Ryder Lane DET# 12-04; Map 32, Lot 213 Present for the applicant: James Fenway, contractor Documentation: Request for Determination with attachment Public Notice James Fenway presented a plan to remove and replace a three season porch. Comments from the Commission: the Commission requested the limit of work line be marked at a distance no more than fifteen feet from porch. Motion made and seconded to issue a negative determination with conditions, 6-0 in favor. 7:41 pm Hearing: 19 Ledgelawn Avenue DEP# 201- 848, BL 806; Map 71, Lot 21 Present for the applicant: Zoltan Juhasz, Uniterra Consulting Stephen Parus, applicant Documentation: Notice of Intent with attachments Public Notice Zoltan Juhasz presented a project to construct an addition and deck. Comments from the Commission follow: David Langseth requested an alternative analysis be submitted. Stew Kennedy would like elevation data provided and requested the limit of work to be more restrictive on the east side of the property. Duke Bitsko would like a cap on the proposed drywell instead of proposed grating. Motion made and seconded to continue hearing to March 6, 2012 at the applicant’s request, 6-0 in favor Cont. Hearing: NOI, 20133 & 2027 Massachusetts Avenue, DEP# 201-837, BL 795; Map 49, Lot 2 and Map 57, Lot 12 Page 1 of 2 MINUTES – LEXINGTON CONSERVATION COMMMISSION MEETING February 21, 2012 Motion made and seconded to continue hearing to March 6, 2012 at the applicant’s request, 6-0 in favor. 8:02 pm Land Donation: 187 Woburn Street, The Commission discussed issues surrounding gift of land and if the town would prefer conservation restriction as opposed to gift. Attorney Tom Fenn conveyed that as the land was willed to the town there may be complications if it were not accepted as a gift. Charlie Wyman moved to rescind previous decision to accept donation and explore conservation restriction, no second, motion failed. Commission decided to consider ways to manage lot. 8:20 pm Cont. Hearing: 14 Whittier Road DEP# 201-847, BL 805; Map 76, Lot 54 Present for the applicant: Zoltan Juhasz, Uniterra Consulting Scott Zhu, applicant Documentation: Letter from Consultant with attachments, dated February 15, 2012. Zoltan Juhasz went over revisions. Comments from the Commission follows: David Langseth requested a cap on the proposed inspection pot instead of proposed grating. The commission felt soil tests were inconclusive and requested additional testing. Motion made and seconded to continue hearing to March 6, 2012 at the applicant’s request, 6-0 in favor. 8:37 pm Hearing: 44 Winthrop Road, DEP# 201-846, BL 804; Map 40, Lot 239 Motion made and seconded to continue hearing to March 6, 2012 at the applicant’s request, 6-0 in favor. 8:38 pm Request to Amend Order of Conditions: 9 Brigham Road, DEP# 201-815, BL 773; Map 56, Lot 214 David Sperduto asked the Commission if the Order of Conditions could be amended to include a basement under the garage or if it would require a new Notice of Intent. The Commission felt the proposal would require a new Notice of Intent. Page 2 of 3 MINUTES – LEXINGTON CONSERVATION COMMMISSION MEETING February 21, 2012 8:55 pm Certificate of Compliance: 24 Ingleside Road DEP# 201-703, BL 660; Map 39, Lot 90B The Commission discussed recent site visit and determined that the project was not in compliance with the permit at this time. 8:58 pm Issue Order of Conditions: 2 Forbes Road, DEP# 201-845, BL 803; Map 43, Lot 9C Motion made and seconded to issue Oder of Conditions, 5-0 in favor. David Langseth recused himself. Issue Order of Conditions: 8 Cutler Farm Road, DEP# 201-844, BL 802; Map 25, Lot 1 Motion made and seconded to issue Oder of Conditions, 6-0 in favor. Issue Order of Conditions: 111 Grant Street, DEP# 201-839, BL 797; Map 55, Lot 45 Motion made and seconded to issue Oder of Conditions, 4-1 in favor, Stew Kennedy against. Extend Order of Conditions: 6 Moon Hill Road, DEP# 201-655, BL 613; Map 14, Lot 81 Motion made and seconded to extend Order of Conditions of 1 year, 6-0 in favor. 9:46 pm The Commission voted by roll call vote to go into executive session for the purpose of discussing land acquisition and announced that it would not be returning to open session. It is declared that an open session would have a detrimental effect on the Town’s negotiating position. The Commission will not return to open session at the conclusion of executive session.
