TOWN WARRANT
Town of Lexington
Special Town Meeting
Commonwealth of Massachusetts Middlesex, ss.
To any of the Constables of the Town of Lexington Greetings:
In the name of the Commonwealth of Massachusetts, you are hereby directed to notify the inhabitants of the
Town of Lexington qualified to vote in elections and in Town affairs to meet at Cary Memorial Building, in
said Town on Wednesday, November 29, 2006 at 7:30 p.m., at which time and place the following articles are
to be acted upon and determined exclusively by the Town Meeting Members in accordance with Chapter 215 of
the Acts of 1929, as amended, and subject to the referendum provided for by Section eight of said Chapter, as
amended.
ARTICLE 1 REPORTS OF TOWN BOARDS, OFFICERS, COMMITTEES
To receive the reports of any Board or Town Officer or of any Committee of the Town.

ARTICLE 2AMEND FY2007 OPERATING BUDGET
To see if the Town will vote to amend the FY2007 operating budget or make supplementary appropriations, to
be used during the current fiscal year in conjunction with money previously appropriated under Article 17 of
the warrant for the 2006 Annual Town Meeting, or make any other adjustments to the current fiscal year budget
and appropriations that may be necessary; to determine whether the money shall be provided by the tax levy or
by transfer from available funds; or act in any other manner in relation thereto.

DESCRIPTION: This article will permit adjustments to current fiscal year (FY2007) expenditures.
ARTICLE 3 AMEND FY 2007 ENTERPRISE FUND BUDGETS
To see if the Town will vote to amend or make supplementary appropriations to the Water and Sewer Enterprise
Funds, to be used during the current fiscal year in conjunction with money appropriated under Article 18 of the
warrant for the 2006 Annual Town Meeting; to determine whether the money shall be provided from user
charges or by transfer from available funds; or act in any other manner in relation thereto.

DESCRIPTION: This article will permit adjustments to the current fiscal year (FY2007) expenditures
from the Water and Sewer Enterprise Funds.
ARTICLE 4 COMMUNITY PRESERVATION FUND
To see if the Town will vote to hear and act on the report of the Community Preservation Committee and,
pursuant to the recommendations of the Community Preservation Committee: (i) to appropriate a sum of money
to the Community Preservation Fund ? Historic Reserve; and (ii) to appropriate sums of money from the
Community Preservation Fund for (a) Phase I of the Hancock-Clarke restoration project; (b) a freight elevator
for the Lexington Depot; and (c) shelving for the main vault of the Cary Memorial building; or act in any other
manner in relation thereto.

FUNDS REQUESTED: (i) $20,000; (ii) $129,000
DESCRIPTION: This article requests that: (i) funds received from a developer of an historic structure be
added to the Community Preservation funds reserved for historic resources; and (ii) Community
Preservation Funds be appropriated for the listed projects as recommended by the Community Preservation
Committee.
ARTICLE 5 ACCEPT MGL CHAPTER 39 SECTION 23D
To see if the Town will vote to accept Section 23D of Chapter 39 of the Massachusetts General Laws as
inserted by Chapter 79 of the Acts of 2006 relating to attendance at public adjudicatory hearings by members of
any municipal board, or act in any other manner in relation thereto.

DESCRIPTION: This article proposes that Town Meeting vote to accept a provision of a recent state
law that would allow a member of a Town board, committee or commission to miss one session of an
adjudicatory hearing and still participate in the decision on the matter provided that the member has
viewed a video recording, listened to an audio recording, or read a written transcript of the missed
session and examined any evidence for the record submitted during the missed session.
ARTICLE 6 APPROPRIATE FOR AFFORDABLE HOUSING PURPOSES
To see if the Town will vote to appropriate a sum of money received from Brookhaven at Lexington as a
contribution for affordable housing to LexHAB to support the provision of affordable housing within the Town,
or act in any other manner in relation thereto.
FUNDS REQUESTED: $50,000
DESCRIPTION: This article requests that funds received from Brookhaven at Lexington for affordable
housing purposes be transferred to LexHAB in accordance with the Brookhaven development plan
approved by Town Meeting.
ARTICLE 7 ACCEPT MGL CHAPTER 71, SECTION 37M (JOINT FACILITIES DEPARTMENT)
To see if the Town will vote to accept Section 37M of Chapter 71 of the Massachusetts General Laws relating
to the consolidation of maintenance functions of the School Committee with those of the Town, or act in any
other manner in relation thereto.
DESCRIPTION: This statute permits the consolidation of maintenance functions of the School
Committee and the Town if it is accepted by a vote of the Town Meeting and a vote of the School
Committee. A vote by Town Meeting at this time would aid in the preparation of final plans for the
proposed new Department of Public Works facility.
ARTICLE 8 APPROPRIATE FOR SENIOR SERVICE PROGRAM
To see if the Town will vote to raise and appropriate a sum of money, in addition to the sum appropriated under
Article 22 of the warrant for the 2006 Annual Town Meeting, for a Senior Service Program, to be spent under
the direction of the Town Manager; determine whether the money shall be provided by the tax levy, by transfer
from available funds, or by any combination of these methods; or act in any other manner in relation thereto.
FUNDS REQUESTED: $11,000
DESCRIPTION: The response to the Town?s Senior Services Program voted at the 2006 Annual Town
Meeting exceeded expectations. The funds requested would enable the Human Services Department to
accommodate all qualified seniors who requested to participate in the program.
And you are directed to serve this warrant fourteen days at least before the time of said meeting as provided in
the By-Laws of the Town.
Hereof fail not and make due return of this warrant, with your doings thereon, to the Town Clerk, on or before
the time of said meeting.

equipping and furnishing a new Department of Public Works facility, to be spent under the direction of the
Permanent Building Committee and the Town Manager, and determine whether the money shall be raised by
borrowing or otherwise; or act in any other manner in relation thereto.

FUNDS REQUESTED: unknown at press time
DESCRIPTION: This article requests funds for designing and constructing a new Department of Public
Works facility on the site of the existing facility on Bedford Street. If approved by Town Meeting, it is
anticipated that a debt exclusion vote for the project will be placed on the ballot for the annual town
election in March 2007.
And you are directed to serve this warrant fourteen days at least before the time of said meeting as provided in
the By-Laws of the Town.
Hereof fail not and make due return of this warrant, with your doings thereon, to the Town Clerk, on or before
the time of said meeting.
