Notice is hereby given that at a hearing of the Historic Districts Commission held on Thursday,
August 5, 1999, the Commission granted a Certificate of Appropriateness to Steve Hurley,
representing the Design Advisory Committee,with respect to installation of benches along
Massachusetts Avenue at Hastings Park which is located within the Battle Green District.
Participating in the decision were Commissioners Stephen Politi, Ian Adamson, Mark DiNapoli,
Joann Gschwendtner and Lynn Hopkins.

This certificate is issued pursuant to Chapter 447,Acts of Massachusetts, 1956,as amended,to
Steve Hurley,representing the Design Advisory Committee
with respect to the
installation of benches on Massachusetts Avenue at Hastings Park,
which is in the Battle Green District.
The approved work shall be as follows:
Installation of eight(8)teak benches along Massachusetts Avenue in Hastings Park facing the
Bandstand.
Installation of benches cannot occur until after the Patriot's Day 2000 celebrations.
The work shall conform to the information submitted on August 5, 1999 and be completed to the
satisfaction of the Commission.After completion,the work shall,in the judgement of this Commission,
be maintained in good repair.
This Certificate shall be void if it is not acted upon within one year from the date of this
Certificate,or if the work described is removed,abandoned,or replaced.

DOTE TO THE FILE CONCERNING BABY SAFE HAVEN HEARING
On N wt,:_►').14,2004,Michael Morrissey came before the Hi wtic Listricts
Commission requesting signage for both fire stations- 45 Bedford Street and 1006
Massachusetts Avenue—as well as the Police Station at 1575 Massachusetts Avenue.
Mr. Monissey and his wife were the people who led the Baby Safe Haven Act through
the Massachusetts Legislature,a demanding and arduous task. The purpose of this Act is
to allow a mother to drop her baby off at a Safe Haven site rather than abandoning it to
die in a dumpster,or wherever. The woman would be asked no questions and would not
be prorecuted for abandonment. Massachusetts is the 46`"state to approve a Baby Safe
llave4 act.
j The Commission commended Mr.Morrissey for his diligence and stated its admiration
for him and his wife for shepherding this important issue to passage in Massachusetts.
Mr. Morrissey wished to place a sign on the front of each of the above-mentioned brick
buildings; he was not sure of the design, color or materials. He had no drawings,no
photographs of the buildings with areas marked.
Most irlportantly,the Historic Districts Commission only gives a Certificates of
Appropriateness to building owners,their agents or attorneys. As the buildings in {
question are owned by the Town of Lexington,it is inappropriate to give Mr. Morrissey
approval for the signage. Furthermore,there was no one representing the Town at the
hearing: no one from the Engineering or Public Works Departments, which manage
Town-owned buildings;also no Selectman nor the Town Manager,nor the police or fire
chief had written a letter expressing approval for these signs.
It would be inappropriate for signage for various causes to be placed on Town buildings.
The Commission recommended that Mr. Morrissey have some publicity in the local
newspaper about his important contribution and also have an item on the front pages of
both the Verizon telephone book and the small local telephone book giving information
about Baby Safe Haven locations.
The Commission also recommended that it might be appropriate to place a sign on the
inside of a window at each of the above locations if the Town approved same;this would
not require Historic Districts Commission approval; but it would not be appropriate to
place signage on the exterior of these buildings nor on any other Town-owned buildings.
