Lexington Board of Health Meeting, Wednesday, July 11, 2012 at 7:00 p.m.

Wendy Heiger-Bernays called the meeting to order at 7:00 p.m.
The Board reviewed the minutes of May 9, 2012. Perlmutter motioned to accept the
minutes as written. MacKenzie seconded. All approved.
Environmental Health Report – Food Inspection Program
Environmental Health Reports – The Board reviewed the Environmental Health Report
for May/June 2012.
Three Gorges – Cody informed the Board that Three Gorges has requested relief in the
form of a variance from the use of a three bay sink; Food Code 4-301.12, Manual
Warewashing, Sink Compartment requirements states in part that “a sink with at least
three compartments shall be provided for manually washing, rinsing and sanitizing
equipment and utensils.” After a discussion, Perlmutter motioned that The Lexington
Board of Health grants the variance request from the requirement of a three compartment
sink as listed under Food Code 4-301.12 to Three Gorges, 211 Massachusetts Avenue,
Lexington, MA 02420. The variance applies to the current owner. In the event of a
change in ownership, the variance request is null and void. Flynn seconded. All
approved.
Khushboo – Cody advised the Board that Khushboo had failed to identify a Person in
Charge at a recent food inspection that took place on June 26, 2012. Khushboo had
appeared before the Board of Health in September 2011 for failure to identify a Person in
Charge. A reinspection on July 11, 2012 revealed that there was compliance with all the
violations noted on June 26, 2012. After a discussion, Flynn motioned that the Lexington
Board of Health considers the lack of a Person in Charge to be a serious threat to properly
operating a food establishment. As a result, Cody advised Khushboo that they are
required to hire a food consultant that will train your staff to be competent in the
requirements of a Person in Charge according to the Food Code. There shall be a general
staff training and two inspections conducted by the Food Consultant. All training and

inspections shall be completed by August 31. Attendance at the August 8, 2012, Board
of Health meeting is required. At the August Board of Health meeting, the food
consultant will provide an update on the training activities at Khushboo. Please contact
Gerard Cody, Health Director for further details. Perlmutter seconded. All approved.
Community Health Update/Report – The Board reviewed the Community Health Report
for May/June 2012 prepared by David Neylon, R.N., and follow-ups for the 10
communicable diseases had been done in a timely manner.
State Sanitary Code Case Review
New Housing Case
116B School Street – Cody inspected 116B School Street at the request of the tenant
where a child under the age of six is living and as a result, Cody is required to test for
lead in the paint. Cody is a lead determinator and performed the test. The house was
built in 1780. There were at least four locations that had high lead ratings. Cody sent a
letter to the owner informing him that a lead determination took place with an order to
correct to include plumbing and electrical defects and asbestos. The tenant informed
Cody that her child had been recently tested for lead and there was no indication that she
had been poisoned by the lead. Cody also mentioned that there had been a complaint
about a possible dog boarding/kennel at 116A School St. At the time of the inspection,
there was no sign of any dogs. Stephanie Doucette, the Animal Control Officer, had been
there several times and never saw signs of dogs. Cody said that there is a registered dog
walking business and possibly sometimes dogs are dropped off at this location. Cody
said the property owner has 90 days to come into compliance with the lead law. The first
30 days need to have another lead inspection and after 60 days they must have a
contractor and submit a plan to the Health Dept. and come into compliance within the 90
days.
Community Health Update/Report – The Board reviewed the Community Health Report
for May and June, 2012 prepared by David Neylon, R.N., and follow-ups for the ten
communicable diseases had been done in a timely manner.
Organic Waste Processing – Cody advised the Board that at a recent NEHA Seminar in
San Diego, Felix Zemel had presented a poster on organic waste processing. Zemel
thanked the Board for the opportunity to work on this project. Zemel said the purpose of
this poster was to look at the role Public Health plays in siting these organic waste
facilities. A discussion followed.
Jay Flynn presented to the Board an update on the meetings to date concerning the
Anaerobic Digester Facility.

Emergency Preparedness – Cody informed the Board about a Table Top Exercise to be
held on July 13, 2012, dealing with best practices for emergency sheltering.
Perlmutter motioned to adjourn. Geller seconded. All approved.
