Lexington Board of Health April 13, 2005, Meeting Minutes

The meeting began at 7:05 PM. There was no public participation.
Perlmutter served as Chair and called the meeting to order at 7:05 p.m.
The Board reviewed the minutes of the March 13, 2005 meeting. Perlmutter motioned to accept the minutes with
correction. MacKenzie seconded. All Approved.
Fox informed the Board of the Metro West Tobacco Control group compliance checks at various establishments.
Fox mentioned that 5 establishments were not in compliance.
Perlmutter began a discussion concerning new Mercury Regulations for the Town of Lexington and suggested
tabling further discussion until other members of the Board are present.
A discussion began concerning the Battle Green Inn. Fox informed the Board that DEP is dropping the issue for
lack of evidence. DEP had never issued an RAO. Fullerton will be updating the Board at the next meeting.
Fox informed the Board of the recent letter sent to residents who have a private septic system or cesspool and who
have not had these systems pumped out within the timeframes required under the Lexington Board of Health
regulations.
Ethan Mascoop began a discussion concerning the condemnation of 81 Westview Street. Mascoop went over the
property history from 1997 until 2004. Mascoop informed the Board the property is condemnable. Mascoop
suggested that the Board has authority to have property cleaned up and the Town of Lexington would get
reimbursed if a lien were placed on the property. Mascoop feels it would take many months for this process and
some things that the Defelice family might feel valuable could be destroyed. Another approach might be to go to
Probate Court and have a conservator of the estate appointed. The conservator would be acting for the court. Mr.
Defelice’s doctor would need to approve this action. Mascoop also stated that the Town of Lexington attorney
would also need to be consulted. MacKenzie asked if possibly someone has already been appointed having power
of attorney.
Mascoop wants to check to see if the condemnation is still valid. The Board suggested securing the property with
chain link fencing and place a lien on the property to pay for the fencing.
The Board also wants 81 Westview on the agenda until resolved.
A discussion began concerning the chlordane investigation at 1947 Massachusetts Avenue after the Board reviewed
Heiger-Bernays’ notes. It was mentioned that the Health Department has no record or complaint regarding the use
of chlordane at 1947 Massachusetts Avenue, at the time of the chlordane application and investigation. Perlmutter
recommended tabling 1947 Massachusetts Avenue until the next meeting.
Perlmutter motioned to adjourn. MacKenzie seconded. All approved.
