Lexington Board of Health August 12, 2004 Meeting Minutes

The meeting began at 7:05 PM. There was no public participation.
Fearnside asked the Board to review the minutes of the July 7, 2004. MacKenzie motioned to
accept the minutes as amended. Heiger-Bernays seconded. All approved.
Fearnside began a discussion concerning the noise measurements at Arlex Oil Company.
Fearnside said that a variance had been granted to Arlex Oil Company forever unless the
Selectmen take the variance away. Fearnside said that noise measurements would be taken at
Arlex Oil in September. Fullerton will arrange for the testing with the Police Department. Per
Fearnside, Susnock should be made aware of the testing date as well as Susnock’s attorney.
Fearnside began a discussion concerning possible dates for the continuation of the Arlex Oil

hearing. Fearnside recommended either Thursday, October 7 or Thursday, October 21.
Fullerton should arrange the hearing date with the parties involved.
Carla M. Moynihan, Robinson & Cole, LLP representing Arlex Oil Company, informed the
Board of their intention to have noise measurements done at the Arlex Oil facility.
Fearnside began a discussion concerning the Public Health Nurse opening. Fearnside mentioned
about the $70,000.00 for visiting nurse coverage that is available through the COA. MacKenzie
wanted to be assured that the temporary public health nurse from All Care would be utilized
until a public health nurse is hired.
Fearnside began a discussion about the amount of money received annually from health permits.
Fearnside stated that approximately $37,000.00 is received from all Health permits. Fearnside
said the BOH has jurisdiction for the cost of permits Fearnside suggested increasing the fees
and giving the general fund one half and then having a fund for the health department to use in
the community. Fearnside would like to review the current permit fees at the next meeting.
Heiger-Bernays wanted to know the percentage of the fines that get paid. Fox informed Heiger-
Bernays that about 80% of the fines get paid.
Fearnside began a discussion concerning the health director position. Heiger-Bernays stated that
Linda Vine, Acting Town Manager, had asked Heiger-Bernays to be on the committee for
recruiting the health director. Fearnside gave a draft to the Board of the qualifications and
reporting structure.
Fearnside asked when he was appointed as Chairperson. Fearnside also wanted to know the
expiration dates for the other board members.
Biosafety committee reviewed the procedures for Eyetech Pharmaceuticals rDNA permit
application. The Biosafety Committee recommended approving the permit with the
understanding that all confidential documents will be made available. Perlmutter motioned to
approve. MacKenzie seconded. All approved.
MacKenzie motioned to adjourn the meeting. Wendy motioned to second. All approved.
The meeting ended at 8:40 p.m.
