HomeMy WebLinkAbout2004-07-07-BOH-min Lexington Board of Health July 7, 2004 Meeting Minutes Police Guard Room, 1575 Massachusetts Avenue, Lexington, Massachusetts Attendees: Board of Health: James Fearnside; Wendy Heiger-Bernays; Sharon MacKenzie, Health Department: Derek Fullerton Public: Ingrid Klimoff, Joe Marino of Homes Development Co. The meeting opened at 7:05 p.m. Fullerton began a discussion on a bamboo-lined shower inspection conducted at 32 Hill Street by Kathy Fox. Fox indicated in a report that the shower area was clean and free of any fungus, mold, or any other kind of build-up. The bamboo remains completely intact with no signs of any breakdown or wear. The surface was impermeable. All caulking and other seals were intact and there was no indication of any leakage problems. MacKenzie motioned to approve a permanent variance to Tom Harden and Sylvia Mihich of 32 Hill Street for the bamboo-lined shower. Heiger-Bernanys seconded. All approved. Fullerton informed the Board of Drummer Boy Condominium Association’s request for a continuance of the variance granted to the Association since 1995. These variances are to Chapter V of the State Sanitary Code, Section 435.25 and 435.36 (minimum Standards for Swimming Pools) and section 425.23 (Lifeguards Minimum Standard for Swimming Pools). Pending a site visit to confirm pool sign complies with State Pool regulations, MacKenzie motioned to approve the variance request. Heiger-Bernays seconded. All approved. Joe Marine of Homes Development Corporation requested a variance from section 155- 86 of the Code of Lexington from Section 155-84 that prohibits new on-site sewage disposal systems and an exemption from Section 155-85 that requires that all buildings be connected to the municipal sewer system to construct a single family dwelling on two lots of land on Piper Road. The lots are shown on Assessors Map 10 as Lot 69 and as a portion of the formerly Commonwealth of Massachusetts owned abutting and unnumbered parcel to the North. Fullerton witness deep soil testing which passed as sandy loom. The closest sewer hookup is 1000 ft. away. Heiger-Bernays motioned to approve. MacKenzie seconded. All approved. Ms. Maureen Joseph, owner and operator of Fireside Bed and Breakfast requested from the Board of Health a permanent or at least another one year variance from the certified food protection manager requirement of 105 CMR 590.009. The Board had granted variances in the past on a year-to-year basis. Heiger-Bernays motioned that a variance be granted for one year at which time the food manager certification must be taken by the owner/operator. MacKenzie seconded. All approved. Fullerton began a discussion concerning the grease trap regulations. Fearnside asked Fullerton if the Health Department keeps a rational for the basis of the regulations for future reference. Fearnside recommended doing a calculation check with a reference check. Fullerton informed the Board of a Tobacco Sting to be held on September 7. Students who will receive community service have volunteered for the sting operation. Results will be forthcoming. Fullerton and Fox will be sending a letter and fact sheet to all food establishments concerning Hep A. Heiger-Bernays asked if a procedure/protocol should be established in case a food worker in Lexington was diagnosed with Hep A. It was decided that Fearnside will be asking Jean Kelley to develop a protocol. Fullerton updated the Board regarding the Public Health Nurse position. The advertisement will be run until July 25, 2004. Interviews will take place in August. MacKenzie and Perlmutter will serve on the interview panel. Fullerton informed the Board of that Eastern Middlesex Mosquito Control will be doing catch basin treatments. At 8:45 p.m. , MacKenzie motioned to adjourn the meeting. Heiger-Bernays seconded. All approved.
