HomeMy WebLinkAbout2004-06-10-BOH-min Lexington Board of Health June 10, 2004 Meeting Minutes Police Guard Room, 1575 Massachusetts Avenue, Lexington, Massachusetts Attendees: Board of Health: James Fearnside; Wendy Heiger-Bernays; Sharon MacKenzie, Burt Perlmutter Health Department: Derek Fullerton Public: Ingrid Klimoff, Alexandra Bartsch Fearnside called the meeting to order at 7:00 p.m. Fearnside read a memo from Margery M. Battin, Moderator dated May 14, 2004, concerning appointments to the Ad Hoc Committee Established by the 2004 Annual Town Meeting under Article 40. Battin requested the names of two of the Board of Health to serve on the committee. Heiger-Bernays and MacKenzie volunteered to have their names submitted for consideration. At 7:05 p.m. the meeting began. Chief William Middlemess addressed the Board regarding Arlex Oil’s permits for storage tanks of gasoline, diesel, kerosene and fuel oil as well as above ground fuel/waste oil tanks and a propane tank. Middlemess indicated there is no evidence that any fire or explosion hazard exists. Middlemess explained that Arlex Oil Corp./C&W Transportation Inc. have filed the necessary paperwork for reporting under the Emergency Planning and Community Right to know Act of 1986 (SARA) which contains emergency contact information. Middlemess indicated that if an incident occurs at either of these locations, the fire department will respond with the appropriate equipment and standard operational procedures to negate any hazard and protect the public’s safety and welfare. Middlemess told the Board that he is part of the Seabrook Nuclear Power Disaster Planning and the Chair of the Red Cross Disaster Team in Lawrence, MA. Middlemess informed the Board that if an emergency occurred, he would contact FEMA who would then activate a DMAT team from another part of the country.Middlemess is preparing protocols for emergency preparedness. Middlemess also told the Board that a comprehensive emergency plan is being updated and should be ready to submit for certification late summer. Police Chief, Chris Casey addressed the Board concerning emergency planning. Nancy Peterson, Public Health Nurse, addressed the Board. Nancy has taken over tracking communicable diseases. There have been no new level 3 TB cases since October, 2003. A 17 year old female who had traveled to Russa and Armenia was diagnosed with Hep A. Alexandra Bartsch of 205 Follen Road, Lexington addressed the Board to request a special purpose variance determination for the hot tub at her establishment, Morgan’s Rest Bed & Breakfast. The Board decided that to make the hot tub available to your guests, it will need to comply with all the requirements of 105 CMR 435.00 with special attention to the regulations that apply to “special purpose pools”. The Health Department will conduct two inspections a year. Fullerton began a discussion concerning rDNA facility inspections. It was decided that Fullerton would send a letter to all the rDNA facilities informing them that their facility will be inspected annually by a biosafety inspection officer. The notice also indicated that the rDNA facility would be responsible for the salary and expenses paid by the town for inspections, reviews, staff and consultants for work directly related to carrying out these regulations. It was also decided that Karen B. Byers, Biosafety Officer at Dana Farber Cancer Institute, Boston will be conducting the inspections. Fullerton informed the Board about the successful Food Safety Seminar attended by approximately 25 food establishment personnel on June 9, 2004, sponsored by Brunetta Associates. Fullerton advised the Board that the Skin Cancer Grant was sent out from MHOA one week before it was due. Fullerton hand delivered. If the grant is awarded, Fullerton would like to purchase umbrellas and a warning sign for the Town Pool. Fearnside asked Fullerton about the status of the grease trap regulation. Fullerton is still looking for information from Denver. The Board reviewed the minutes of May 13, 2004. Perlmutter moved to approve. Fearnside seconded. All approved. Fearnside informed the Board that according to Palmer & Dodge, the Board can overturn a decision made by the Selectmen. At 9:00 p.m., Perlmutter motioned to adjourn the meeting. MacKenzie seconded. All approved. .
